CTE/Ext/SAS/2020/14196024 dated 18.11.2020 for establishment of a Hotel consisting of 24 double rooms, a restaurant having 30 seats, conference hall having capacity of 100 people and two party halls having capacity of 200 persons and for generation of domestic effluent @ 32 KLD into MC sewer after 40 KLD based on MBBR technology, which was valid till 21.09.2022 with certain condition as mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin; background: white;">The promoter company has proposed that fresh water shall be consumed as per detail below at the time of obtaining NOC: </span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">Thereafter, the project proponent had applied fresh Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The application was refused under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2022/20239527 dated 12.12.2022 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2022/20239523 dated 12.12.2022 due to the fact that the industry has not submitted building plan which is a pre-requisite document as per Govt. Order no. 326110 dated 2/3/2022.<span style="mso-tab-count: 1;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">Now, the project proponent has again applied fresh partial Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operating a Hotel with 07 Rooms and 02 party halls and conference hall <span style="mso-spacerun: yes;"> </span>and has once again not submitted approved layout plan of the building</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The project proponent ha submitted CA Certificate with the value of fixed assets of Rs. 2.15 crore on 17.10.2022. The project proponent has deposited Rs. 65,880/- vide UTR no. KARBN22299050947 dated 26.10.2022 under Water Act, 1974 and Rs. 66,380/- vide UTR no. KARBN22299050868 dated 26.10.2022 under Air Act, 1981. The industry has deposited NOC regularization fees amounting to Rs. 1,100/- vide no. KARBN22333218972 dated 29.11.2022. The consent fee is adequate till 30.09.2028 under both acts.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The promoter company has submitted the letter obtained from Department of Town and Country Planning Punjab through Chief Town Planner Punjab, Chandigarh vide Memo no. 3404 CT(PB)/5P-432-M dated 12.06.2019 wherein the plot no. 350 measuring in an area of 3533.06 sq. yards in falling at Industrial, Phase-IX, SAS Nagar has been converted for hotel purpose (under conversion policy dated 08.09.2016) subject to terms and conditions as mentioned in the said letter as per notification issued by the Government of Punjab, Department of Housing & Urban Development vide no. 17/17/01-5hg2/836008/1 dated 08/09/2016, Therefore, the site is suitable for establishment of a hotel. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin; background: white;">The industry was visited by undersigned on 24.11.2022 and contacted Sh. Jagdeep Singh, Son of Prop. (98144-36672). During visit it was observed as under:</span></p>

The representative informed that the rooms will be used as changing rooms for the relative of the parties during any function and further kitchen provided by the project proponent is not permanently used as no staff has been kept by the project proponent for its operation and its only during marriage function that cater from outside is arranged by the party. Hence the rooms cannot be treated as hotel rooms.<span style="mso-spacerun: yes;"> </span></span></p>

The size of oil & grease trap consisting of 3 chambers is 4ft*1.5ft*1.5 ft each. The waste-water generated from toilets/washrooms is disposed into MC sewer directly further leading to GMADA sewer. The project proponent has not installed STP.</span></p>

The reading of water meter provided over MC supply was 03678.8 m3. As per last water bill checked the reading of water meter was 3285 KL on 30.09.2022 and accordingly 7.1 KLD fresh water has been consumed. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">In view of above, it is recommended that show cause notice for refusal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, may be issued to the project proponent with an opportunity of personal hearing as the project proponent has failed to submit approved building plan in compliance of special condition of NOC.</span></p>
