Subject:      Application for obtaining renewal of 'consent to operate' under the provisions of the Water Act, 1974 and Air Act, 1981 – M/s M.P. Foundry, Guru Ki Nagri, Mandi Gobindgarh, Distt. Fatehgarh Sahib. Reference: Industry’s online Application ID 20629667 (W) and 20629655 (A) dated 13/12/2022. It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. R16FGSCTOW4351677 dated 08/08/2016 and under the Air Act, 1981 vide no. R16FGSCTOA4351679 dated 08/08/2016, both valid upto 30/06/2021 for the manufacturing of CI Castings & Rolling Mill Parts @ 480 MT/Year by using raw material CI Scrap & Pig Iron etc. @ 580 MT/Year. Now, the industry has applied for obtaining renewal of consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has earlier deposited consent fee of Rs. 11000/- vide UTR no. BARBX22342779417 dated 08/12/2022 as Water and Air consent fee against the un-depreciated fixed assets of Rs. 4.50 Lacs as on 31/03/2022 as per CA certificate dated 13/12/2022, which is adequate upto 30/09/2026 as per Board’s Office Order dated 29/10/2018 after deducting NOC regularization fee Rs. 700/-, which is adequate. There is no increase in production capacity as well as pollution load due to increase in the fixed assets. Accordingly, the industry was visited by the undersigned on 19/12/2022. During the visit, it was observed as under: 1.        The industry has installed 1 no. cupola furnace of capacity < 3.0 T/hr, which was not in operation & wet cap is installed as APCD with cupola furnace and is using hard coke as fuel. 2.        The industry has submitted the analysis report of the stack emission sampling carried out by NABL approved lab i.e. M/s Evapo Tech Technical Service and Consultants on 09/10/2022. As per the analysis results, the concentration of SPM was found to be 165 mg/Nm3, which is within the permissible limit as laid down by the Board. 3.        The industry has not installed any D.G. set. 4.        The industry has provided recirculation system to re-circulate the scrubbing water. 5.        There is no generation of any trade effluent except generation of domestic effluent, which is being discharged into MC sewer.   It is pertinent to mention here that the industry was given personal hearing by the Sr. Environmental Engineer, Zonal Office-II, Patiala for refusal of renewal of authorization of under the Hazardous & Other wastes (Management and Trans-boundary Movement), Rules 2016, on 31.08.2016, wherein, it was decided as under: <ol style="margin-top: 0in;" start="1" type="a"> <li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; mso-list: l2 level1 lfo3;">The industry shall make an agreement for its hazardous waste with common storage, treatment and disposal facility (CSTDF), Nimbuan, within 15 days.</li> <li class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; mso-list: l2 level1 lfo3;">The industry shall get its hazardous waste lifted by CSTDF, Nimbuan within one month.</li> </ol> In compliance to the above, it has already signed an agreement with TSDF Nimbuan and is regularly disposing off its hazardous waste. Further, the industry has assured to apply for obtaining authorization under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 within 15 days. Further, the industry is located in the industrial area of Mandi Gobindgarh. Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:                    The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries. It is further intimated that as per Board Office Order no. 244 dated 3/6/2013, the powers have been delegated to the Environmental Engineers of the Regional Offices of the Punjab Pollution Control Board to grant 'consent to establish' / operate under the Water Act, 1974 and Air Act, 1981 for Cupola Furnaces irrespective of its capacity. It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only upto 30/09/2026. It is pertinent to mentioned here that a meeting was taken by the Hon'ble Chairman with the officers of the Board on 29/01/2021 at 11:00 AM in the Committee Room, Head Office, Patiala, wherein, it was decided that Consents to operate be issued to the industries for longer duration as per protocol laid down by the Board and more emphasis shall be laid on the monitoring. In view of above, it is therefore recommended that renewal of 'consent to operate' under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry upto 30/09/2026 with suitable conditions and additional conditions that:  a.        It shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">b.        The industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">c.        The entrepreneur/industry shall obtain necessary statutory permissions /clearances from all other concerned departments. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">d.        The industry shall not generate and discharge any kind of trade effluent. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">e.        The industry shall not start wet process without prior approval of the Board. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">f.         The industry shall not install boiler, furnace without prior approval of the Board. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">g.        The industry shall obtain NOC of the Board, if it changes any of its product/capacity of the plant. <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">h.       The project proponent shall not throw, burn or burry any solid wastes in open, outside premises or in drain / water bodies. <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">i.         The project proponent shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities. (See attached banner). <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">j.         The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises.  <span lang="EN-US" style="mso-bidi-font-size: 11.0pt; line-height: 115%; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; font-weight: normal; mso-bidi-font-weight: bold;">k.        The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
