It is submitted that earlier, </span><span style="mso-bidi-font-size: 11.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">the industry was given personal hearing before the Chief Environmental Engineer (B) of the Board u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 on 29.9.2022 and decided as under:-</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal;"><span style="mso-bidi-font-size: 11.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be issued that the industry shall not operate its unit without taking adequate pollution control measures as well consents to operate of the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal;"><span style="mso-bidi-font-size: 11.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">2. It was made clear to the industry, in case the unit was found violating the directions issued under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as above, strict action may be taken, which includes the disconnection of power connection as well as imposition of Environmental Compensation without affording any opportunity/personal hearing.</span></p>

The Environmental Engineer, Regional Office, Fatehgarh Sahib shall ensure the compliance of the direction as above and submit the report accordingly.</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal;"><span lang="EN-IN" style="mso-bidi-font-size: 11.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-US; mso-bidi-language: PA;">Accordingly, </span><span style="mso-bidi-font-size: 11.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 issued to the industry that it shall not operate its unit without taking adequate pollution control measures as well consents to operate of the Board under Water Act, 1974 and Air Act, 1981. Now, the industry has applied for CTOs and is operating its unit in violations of the directions<span style="mso-spacerun: yes;"> </span>issued by the Board. The Environmental Compensation is required to be imposed upon the industry for non- compliance of directions. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; line-height: normal;"><span style="mso-bidi-font-size: 11.0pt; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">If approved, SCN for refusal of renewal of CTOs and notice for imposition of Environmental Compensation be issued to the industry with an opportunity of personal hearing before the Worthy Chairman of the Board, please.</span></p>
