<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">T</span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">he industry is a hot mix plant and in operation since January, 2019. The hot mix plant was granted consents to operate under the Water Act, 1974 & Air Act, 1981 on 30.09.2021 (valid upto 29.03.2022), subject to main conditions that:-</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt .5in;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">The hot mix plant shall submit prior schedule of its operation to the Board, so that re-sampling of the stack emissions can be carried out.</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt .5in;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">The industry will obtain the permission from the DTP regarding its operation beyond 14.01.2022 at its own level and submit the same to the Board.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">But the hot mix plant failed to submit any compliance of the consent conditions.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"> </p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="text-indent: 1in; font-family: Tahoma, 'sans-serif'; font-size: 11pt;">The hot mix plant was visited by officers of the Board on 02.06.2021 and collected emissions sample from the stack of air pollution control device installed to control emissions from hot mix plant. As per analysis report, conc. of SPM was 232 mg/Nm</span><sup style="text-indent: 1in; font-family: Tahoma, 'sans-serif';">3</sup><span style="text-indent: 1in; font-family: Tahoma, 'sans-serif'; font-size: 11pt;"> against permissible limit of 150 mg/Nm</span><sup style="text-indent: 1in; font-family: Tahoma, 'sans-serif';">3</sup><span style="text-indent: 1in; font-family: Tahoma, 'sans-serif'; font-size: 11pt;">. Consequent to the non-achievement of emissions standards, the industry stated that air pollution control device has been set right / rectified and requested for re-sampling.</span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold; font-style: normal;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">The site of hot mix plant was visited by officer of the Board on 21.01.2022 and found not in operation. During visit, representative of the hot mix plant informed the visiting officer of the Board that the hot mix plant will be restarted in the fourth week January or first week of February 2022 and will be informed to the Board, accordingly for carrying out stack emissions sampling. But no intimation was received from the industry in this regard. Therefore, the hot mix plant was again visited by officer of the Board on 10.05.2022 and emission sample was collected by the Board and as per analysis report, the conc. of SPM was found within the permissible limits, however, the hot mix plant was in operation without having valid 'consents to operate' under the Water Act, 1974 & Air Act, 1981.</span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA; font-style: normal;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">The hot mix plant was issued show cause notice with an opportunity of personal hearing before Senior Environmental Engineer on 20.06.2022 & again on 08.07.2022, but neither any representative of the industry attended the hearings nor submitted any reply in the matter.</span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA; font-style: normal;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">The industry was issued notice u/s 33-A of the Water Act, 1974 & u/s 31-A of Air Act, 1981 with an opportunity of personal hearing before the Chief Environmental Engineer (B) of the Board, wherein it was</span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">decided that directions u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 be issued to the effect that the hot mix plant shall not be operated without obtaining valid 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 as well as further NOC from the Deptt. of Town & Country Planning.</span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA; font-style: normal;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">Accordingly, directions u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 were issued to the hot mix plant that it shall not be operated without obtaining consents to operate under Water Act, 1974 & Air Act, 1981 as well as further NOC from the Deptt. of Town & Country Planning.</span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA; font-style: normal;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">Now, the hot mix plant has applied for obtaining consents to operate under Water Act, 1974 & Air Act, 1981.</span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA; font-style: normal;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">The site was visited by officer of the Board on 12.12.2022 and reported that the hot mix plant is complying with the provisions of Water Act, 1974 & Air Act, 1981 as well as with the code of practice prescribed for such type of units, however, the industry has failed to submit further NOC from the Deptt. of Town & Country Planning.</span></p>
<p class="MsoPlainText" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA; font-style: normal;"> </span><span style="font-family: Tahoma, 'sans-serif'; font-size: 11pt;">In view of above, if approved :-</span></p>
<p class="MsoPlainText" style="margin-left: .25in; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA; font-style: normal; mso-bidi-font-style: italic;"><span style="mso-list: Ignore;">(A)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA; font-style: normal; mso-bidi-font-style: italic;">Consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the hot mix plant upto 30.09.2027, subject to the following special conditions :-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-margin-bottom-alt: auto; mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 150%; mso-list: l1 level1 lfo2; background: white; vertical-align: baseline;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">(i)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The hot mix plant shall obtain necessary statuary clearances from the DTP Ferozepur and other departments at its own level, the Board will not be responsible for any financial loss, in case permission is not granted by the concerned department. </span></p>

Admn./SA-2/F.No.178/99/03 dt. 26.04.1999.</span></p>
