It is submitted that the subject cited industry is a small scale induction furnace unit. The industry was granted consent to operate under the Air Act, 1981 vide no.  CTOA/Renewal/FGS/2020/14203447  dated 12/11/2020, valid upto 30/09/2022 for the manufacturing of Steel Ingots & Castings @ 84 MTD with suitable conditions. Now, the industry has applied for obtaining renewal of consent to operate under the Air Act, 1981 with requisite documents and fee. The consent fee deposited by the industry under against the un- depreciated fixed assets of Rs. 542.68 Lacs as on 31/08/2022 as per CA certificate dated 10/10/2022 is adequate upto 30/09/2027 including penalty. There is an increase in the cost of fixed assets of about Rs. 1.2 crores. The industry has submitted details of the same alongwith NOC regularization fee of Rs. 8400/-, which is adequate. The stack emission sampling of the industry was carried out by Board's lab on 12/01/2022. As per the analysis results, the concentration of particulate matter is found to be 44 mg/Nm3 which is within the prescribed limit of 150 mg/Nm3. It is further submitted that as per circular no. CEE (HQ)/F.No./957/2016/59 dated 02/02/2016, the case for renewal of NOC/Consent to operate for Orange & Green category industries is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. The industry has submitted compliance report of previous conditions of CTO granted to it under the said Act. It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 07.03.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. Consent fee deposited by the unit is adequate upto 30/09/2027. Further, PPCB has issued office order no. 443 dated 09.08.2021 with subject Auto 'Acknowledgement-cum- Renewal Certificate' for regulatory clearances has mentioned that in suppression of Board's office order no. SEE(HQ)/F. No. 957/2016/59 dated 02.02.2016 and to provide ease of doing business to the entrepreneurs, the Board in its 185th meeting held on 07.01.2021 has decided to extend the facility for auto generated renewal to all categories of small scale industries / projects, without inspection / physical verification of the environmental parameters at the time of submission of such application(s) subject to the certain stipulations. <a name="In_view_of_above,_it_is_therefore_recomm"></a>In view of above, it is therefore recommended that the 'consent to operate' under the Air (Prevention & Control of Pollution) Act, 1981 be renewed upto  30/9/2027  with suitable conditions and special conditions that: <p class="MsoListParagraph" style="mso-margin-top-alt: auto; margin-right: 0cm; mso-margin-bottom-alt: auto; margin-left: 70.9pt; text-indent: -1.0cm; mso-pagination: widow-orphan; mso-list: l0 level1 lfo1; text-autospace: ideograph-numeric ideograph-other;">1.        The industry shall be bound to install adequate & appropriate pollution control device/system as per the design of reputed institute, for control of secondary emissions generated from the furnace unit, as and when directions will be issued by the Board. <p class="MsoListParagraph" style="mso-margin-top-alt: auto; margin-right: 0cm; mso-margin-bottom-alt: auto; margin-left: 70.9pt; text-indent: -1.0cm; mso-pagination: widow-orphan; mso-list: l0 level1 lfo1; text-autospace: ideograph-numeric ideograph-other;">2.        The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD in true letter and spirit. <p class="MsoListParagraph" style="mso-margin-top-alt: auto; margin-right: 0cm; mso-margin-bottom-alt: auto; margin-left: 70.9pt; text-indent: -1.0cm; mso-pagination: widow-orphan; mso-list: l0 level1 lfo1; text-autospace: ideograph-numeric ideograph-other;">3.        The industry shall execute annual maintenance contract (AMC) for APCD from the repute agency and/or depute a technical hand to operate the APCD and maintain record. <p class="MsoListParagraph" style="mso-margin-top-alt: auto; margin-right: 0cm; mso-margin-bottom-alt: auto; margin-left: 70.9pt; text-indent: -1.0cm; mso-pagination: widow-orphan; mso-list: l0 level1 lfo1; text-autospace: ideograph-numeric ideograph-other;">4.        The industry shall ensure that no black smoke should be emitted from the stack of the industry and shed of the unit at any point of time.
