<p class="MsoNoSpacing" style="margin-top: 12.0pt; text-align: justify; text-indent: 72.0pt; line-height: 115%;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">It is submitted that the rice sheller was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FGS/2019/11224279 dated 26/10/2018 and the Air Act, 1981 vide no. CTOA/Renewal/FGS/2019/11224210 dated 23/09/2019 both valid upto 30/09/2022 for Processing of Paddy @ 6 TPH to produce Raw Rice @ 4 TPH (Without drier) with suitable conditions mentioned therein.</span></p>
<p class="MsoNoSpacing" style="margin-top: 12.0pt; text-align: justify; text-indent: 72.0pt; line-height: 115%;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">The industry had applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air Act, 1981, which was returned with certain observations.</span></p>
<p class="MsoNoSpacing" style="margin-top: 12.0pt; text-align: justify; text-indent: 72.0pt; line-height: 115%;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">Now, the industry has again applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents and fee through OCMMS. </span></p>
<p class="MsoNoSpacing" style="margin-top: 12.0pt; text-align: justify; text-indent: 72.0pt; line-height: 115%;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">The rice sheller has deposited additional fee of Rs. 14500/- vide online R no. 000127609136 dated 27/09/2022 and Rs. 14500/- vide UTR no. 000127608849 dated 27/09/2022 as Air consent fee against the fixed assets of Rs. 41.82 Lacs as on 31/03/2022, as per CA Certificate dated 13/12/2022. The total consent fee is adequate upto <strong>30/09/2027</strong> under air act, as per Board's Office Order dated 29/10/2018. The industry has deposited penalty of Rs. 580/- (Rs. 290/- each) under both acts vide UTR no. 000127609136 dated 27/09/2022 and 483506566 dated 15/12/2022. There is an increase in the cost of fixed assets of Rs. 60,000, which is attributed towards addition of blending machine. The industry has deposited NOC regularization fee of Rs. 700/- vide UTR no. 000127609136 dated 27/09/2022, which is adequate. The industry has also submitted that there is no increase in the pollution load and production capacity due to above said increase.</span></p>
<p class="MsoNoSpacing" style="margin-top: 12.0pt; text-align: justify; text-indent: 72.0pt; line-height: 115%;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">The land of the rice sheller is taken on lease from Sh. Tarlok Singh and Sh. Santosh Singh S/o Sh. Gian Singh, w.e.f. 01/09/2019 and valid upto 31/08/2029 for Rs. 40000/Annum.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; margin: 12.0pt 0cm .0001pt 0cm;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman';">The industry has submitted the analysis report of the stack emission sampling carried out by M/s Noida Testing Laboratories (NABL approved lab) i.e. on 22/03/2022. As per the analysis results, the concentration of SPM was found to be 280.5 mg/Nm3, which are within the permissible limit as laid down by the Board.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-layout-grid-align: none; text-autospace: none; margin: 12.0pt 49.8pt .0001pt 99.25pt;"><em><span style="font-family: 'Tahoma',sans-serif;">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.</span></em></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; margin: 12.0pt 0cm .0001pt 0cm;"><span style="font-family: 'Tahoma',sans-serif;">The industry has submitted compliance report of previous conditions of CTO granted to it under the said Acts and has agreed that all the conditions imposed for code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated. 15/10/2013 are being complied with.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; margin: 12.0pt -.9pt .0001pt 0cm;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman';">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. The consent fee deposited by the industry is adequate upto 30/09/2027.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; margin: 12.0pt -.9pt .0001pt 0cm;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman';">Further, PPCB has issued office order no. 443 dated 09.08.2021<span style="mso-spacerun: yes;"> </span>subject Auto 'Acknowledgement-cum- Renewal Certificate' for regulatory clearances has mentioned that in suppression of Board's office order no. SEE(HQ)/F. No. 957/2016/59 dated 02.02.2016 and to provide ease of doing business to the entrepreneurs, the Board in its 185th meeting held on 07.01.2021 has decided to extend the facility for auto generated renewal to all categories of small scale industries / projects, without inspection / physical verification of the environmental parameters at the time of submission of such application(s) subject to the certain stipulations.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 12.0pt 0cm .0001pt 0cm;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman';"><span style="mso-tab-count: 2;"> </span>The industry has been established by obtaining NOC from the Board in 2007 and as per the Master Plan of Fatehgarh Sahib, Village Barass (beyond village abadi) falls in agricultural zone.</span></p>
<p class="MsoNormal" style="text-align: justify; margin: 12.0pt 0cm .0001pt 0cm;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman';"><span style="mso-tab-count: 2;"> </span>Keeping above in view, if approved, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be renewed <strong>upto </strong></span><strong><span style="font-family: 'Tahoma',sans-serif;">30/09/2027 </span></strong><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman';">for Processing of Paddy @ 6 T/hour to produce Raw Rice @ 4 T/hour <strong>without drier</strong> with suitable conditions alongwith the following special conditions as under:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -42.55pt; mso-list: l0 level1 lfo1; margin: 12.0pt 0cm .0001pt 70.9pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif;">The rice sheller shall get its stack emission samples analyzed from Boards lab in the upcoming paddy shelling season and submit compliance.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -42.55pt; mso-list: l0 level1 lfo1; margin: 12.0pt 0cm .0001pt 70.9pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif;">The industry shall comply with the Laws and Bye-laws of the Master Plan of Fatehgarh Sahib-Sirhind.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -42.55pt; mso-list: l0 level1 lfo1; margin: 12.0pt 0cm .0001pt 70.9pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif;">The industry shall provide plantation all along the boundary wall of the unit, wherever space is available, within 15 days and submit compliance in this regard to the Board immediately thereafter.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -42.55pt; mso-list: l0 level1 lfo1; margin: 12.0pt 0cm .0001pt 70.9pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif;">The rice sheller shall put in place all the hoods, ducting’s & enclosures and other components of the APCD well before commissioning of the unit for next paddy shelling season and report the compliance in the regard to the Board prior to commissioning of the unit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -42.55pt; mso-list: l0 level1 lfo1; margin: 12.0pt 0cm .0001pt 70.9pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif;">The industry shall provide rotary valve (if earlier not provided) below the cyclone for removal of particulate matter contained by the APCD and sampling arrangements along with the stack attached to the APCD within 15 days and submit compliance in this regard to the Board immediately thereafter.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -42.55pt; mso-list: l0 level1 lfo1; margin: 12.0pt 0cm .0001pt 70.9pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif;">The industry shall abide by the fresh directions (if any) issued by the Hon'ble Punjab & Haryana High Court/ Govt./ Board for compliance of code of practice of rice sheller.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -42.55pt; mso-list: l0 level1 lfo1; margin: 12.0pt 0cm .0001pt 70.9pt;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif;">The industry shall be bound to upgrade/ replace the APCD as per latest notification issued by the Ministry of Environment & Climate Change, New Delhi to achieve the emissions stands as amended time to time.</span></p> |
