The industry was granted 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 on 31.03.2022 and 20.04.2022 respectively upto 31.12.2022, subject to the conditions mentioned therein along with special conditions as under: 1.    The industry shall not discharge any trade effluent, cooling water, effluent from ash quenching or domestic effluent into any drain. 2.    The industry shall install water meter on all the lines leading to different sections for supply of water to ascertain water consumption and waste water generation etc. within 01-month and maintain the records on daily basis. 3.    The industry shall treat the entire effluents generating while cleaning of cooling towers, neutralization tanks etc. as well as domestic effluent in ETP installed & operated by Sugar Mill in the premises. 4.    The industry shall execute agreements for proper disposal of hazardous wastes of all categories with the concerned authorized companies and apply for authorization under Hazardous Wastes (Management, Handling & Transboundary Movement) Rules, 2016 within 01-month. 5.    The industry shall cover 100% fuel storage area by 31/05/2022. 6.    The industry shall maintain arrangements to avoid flow of baggasse fuel ash in atmosphere by covering all transfer points of fuel conveying system properly & sprinkling water etc. 7.    The industry shall maintain & operate the air pollution control device installed regularly & efficiently all the times to achieve the prescribed parameters. 8.    The industry shall maintain the record of paddy straw procured / stored & used as fuel and submit the same to the Punjab Pollution Control Board on monthly basis. To verify the above compliance, it is submitted that the industry was visited by the AEE on 28.06.2022 and it was observed that the industry was not complying with the consent conditions under Water Act, 1974 and Air Act, 1981. Accordingly, show cause notice for revocation of consent granted under the Water Act 1974, Air Act 1981 & show cause notice for violation of provisions of Hazardous & other Wastes Rules, 2016 was issued to industry with hearing before Chairman of the Board on 04/10/2022.                      After hearing, the officer of the Board and representative of the industry, the Chairman of the Board decided that:-   1.    The industry shall submit the name of the bailers/rakers alongwith their contact numbers to whom the paddy is given by the industry within 15-days.   2.    The industry shall remove all the shortcomings as observed during the visit on 28.6.22 and make 100% compliance before the commissioning of the unit in November 2022.   3.    Environmental Engineer Regional Office, Hoshiarpur shall visit the industry and submit the compliance alongwith recommendations in the matter within 2 months.              Now, the industry has applied for 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.  The industry has submitted Authority letter, list of directors, , compliance report of consent conditions, CA Certificate. The industry has submitted the CA certificate for undepreciated cost of fixed assets of Rs. 93.50 crores. The industry has already deposited 'consent to operate' fee under both the Acts upto 31.03.2024. The penalty for late application @ 10% is deposited under both Act of Rs. 21,120/- vide receipt no. 000433193179 dated 13.12.2021, which is adequate.   Accordingly, the industry was visited by the undersigned on 19.12.2022 and contacted Sh. V.K. Chhajad, Site Incharge of the industry. The detail of the industry / visit is as under: General Information: 1.          The industry is engaged in production of electricity through Co-generation power plant from biomass produced from Sugar Mill. During visit, the industry was under mechanical breakdown and was not in operation.   2.          The industry is generating power @ 15 MW from bio-mass @ 22 TPH. The bio-mass includes Bagasse, Parali, Fuel wood, Wood chips, Cane trash.   3.          The industry has submitted the bank guarantee of Rs. 3.0 lacs vide no. 166519IGPER0001 dated 15.10.2019 which has expired on 14.10.2020 and extended upto 14.10.2022 only. The industry has not renewed its said bank guarantee.   4.          The manufacturing process is as under:   Soft Water (8%) + Power plant condensate (6.5%) + Steam condensate from sugar mill (85.5%) – De-aerator- Booster feed pump – HP heater – Economizer – Steam Drum – Saturated steam – Primary super heater – Secondary super heater – Turbine - Electricity. The exhaust steam from turbine is supplied to sugar mill process.     Water Pollution and its Control:   1.       The industry has installed a tubewell as source of fresh water. The digital water meter is installed with the tubewell and the reading of the same is noted as 330401 m3. 2.       The industry has installed RO system having components: Multi grade filters, Quartz filter (membrane), RO system, De-gasifier (removal of O2), Mixed bed filter, Storage tank.  3.       The softener plant is installed having components: Multi grade filter, Softener (addition of NaCL) – To cooling tower. 4.       For regeneration of RO, the flushing with raw water is done and dosing of anti scaling agent (Antiscalant 9001 Thermax) is done. The wastewater is used for dust suppression and for wetting of ash.    5.       The industry drains about 3000 KL of wastewater from cooling tower once in season which shall be sent to the ETP of Sugar Mill for treatment. However, the treated effluent from the ETP of the Sugar Mill is being discharged into East Bein. The components of ETP installed in the Sugar Mill is: Grit screen, Equalization tank, Primary Clarifier, Secondary Clarifier & Sludge drying beds. 6.       The housekeeping near the RO section and wet scrubber tanks was very poor. Air Pollution and its Control: 1.         The industry has installed a boiler furnace which is travelling / moving grate type and is not FBC based. 2.         The boiler is producing steam @ 70 TPH and is using Bio-fuel @ 28 TPH to produce power @ 15 MWh. 3.         ESP followed by a wet scrubber is installed as APCD.  A stack of about 60 m is provided with the APCD alongwith sampling arrangements. Separate energy meters are installed with the ESP and wet scrubber. As per record maintained by the industry, it is consuming about 450 KWh power with ESP and about 500 KWh with wet scrubber per day. 4.         A lot of fly ash was found to be air-borne at the falling point of ESP hopper on conveyors, as the conveyors are not properly covered. 5.         A regular complaint is being received from the residents of Nawanshahr city wrt air pollution and ash problem. It is pertinent to mention here that the industry has taken shut down on 13.12.2022 to check the problem and hired a consultant to rectify it. Now, the industry has submitted to DC ,SBS Nagar vide letter dt 16.12.2022 that the necessary amendments and repair of APCD has been done to mitigate the Air pollution problem.   6.        Bio-Mass Handling System:   1.       The bio-mass storage area is uncovered. The transfer points of bio-mass conveying system are not covered properly. Some of transfer points are covered with tarpuline sheet instead of providing a proper shed/ fixed enclosure.   2.       The bio-mass fuel charging area at the ground is full fugitive emissions. No hood system with suction facility / APCD is provided for collection / treatment of emissions being generated from bio-mass handling system.   3.       All the floors under bio-fuel feeding point in the boiler furnace are covered with spillages of fuel which is becomes air-borne during wind flow and during its cleaning. The Slot Chain Area (Main feeding chain of bio-mass) is required to be modernize for proper feeding of bio-mass to the boiler furnace without spillages.   7.        Ash Handling System:   1.        There are two no. of hoppers provided under the boiler furnace from where the ash is dumped over the conveyor belt which is filled with water to wet the ash. This ash is then filled into trollies for disposal of the same for land filling. 2.        The ash heaps are required to be covered. 3.        Water sprinkler over ash handling area is installed which is operated manually as and when required. 4.        The ash handling mechanism needs to be improved. 5.        The industry has made agreement with M/s Chauhan Building Material for whole ash lifting.    8.        Compliance of PH dt 4.10.2022:   1.    The record of paddy management wrt name of bailers / rakers has not been supplied .The transfer points of ash are not covered. Sprinkler system is provided over ash handling area. 2.    The wastewater drain existing in the fuel storage area is plugged. The cooling tower is full of water and representative of industry informed that this water shall be drained after 1-2 years. The ash quenching wastewater is recycled back to treatment facility. The domestic effluent disposal is not known to the unit and it is informed that the same is discharged into sugar mill system of wastewater. 3.    The representative of the industry informed that C.T. is not got empted in all reasons and is required to drain after about 3 years. 4.    The industry has made agreement with M/s Shiv Shanker Traders of Amritsar for category 33.1. 5.    The industry need to maintain proper and regular record of various activities w.r.t. consumption of various utilities generations. 6.    The record of hazardous waste is not maintained.   The emission sample from the stack attached with the boiler was collected on30.11.2022 and as per analysis report, the PM in the emission is 38 mg/Nm3 @ 12% CO2, which is within permissible limits. In view of above, if approved, the ZO may be recommended that the application under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981  may be refused.
