<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: normal;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><strong>Background:- </strong>It is submitted that the industry is a medium scale red category CETP for treatment of trade effluent generated by the electroplating and allied industries. The CETP Operator was granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH4/2019/10762938 dated 03/10/2019, upto 30/06/2024 and under the Water (Prevention & Control of Pollution) Act, 1974 vide no. <span style="mso-bidi-font-style: italic;">CTOW/Renewal/LDH4/2022/16981292 dated 29/08/2022, upto 28/02/2023 </span>with certain conditions.</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: normal;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="EN-IN">The CETP operator was granted authorization under Hazardous & Other Wastes (Management & Trans-boundary Movement) Rules, 2016 vide no. HWM/LDH/CETP/2016-21/R-001 dated 17/06/2016, which was expired on 16/06/2021 with certain conditions. </span></span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: normal;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;">It is intimated that the CETP Operator was given hearing before the Chairman of the Board on 16.07.2021 and various ex-party decisions were taken as under: -<span style="mso-spacerun: yes;"> </span></span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">1.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The act and conduct of the operator of the CETP has caused damage to the environment, as such Environmental Compensation w.e.f. 16.08.2019 shall be imposed on the operator of the CETP for continuous violation and noncompliance towards pollution control norms and for making agreements with the existing/new member units over and above the consented capacities without prior permission of the Board in violation of the decision taken during the hearing held on 19.10.2020. Environmental Engineer, Regional Office-4, Ludhiana shall calculate the Environmental Compensation on the CETP Operator as per above and get it approved from the EC verification Committee. A separate order for imposition of Environmental Compensation will be passed. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">2.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP Operator shall submit a Bank Guarantee of Rs. 10.00 Lacs as an assurance to complete all the works in accordance with the decisions already taken during the hearing dated 27.05.2021, within 04 days failing which legal action shall be initiated against the CETP. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">3.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The Ludhiana Effluent Treatment Society (LETS) being the supervisory/administrative arm for control of the functioning of CETP shall ensure that the CETP complies with all the observations made by Er. J.S. Kamyotra, Ex. Member Secretary, CPCB. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">4.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall comply with all the observations made by the NGT Monitoring Committee during earlier visit made on 06.10.2018 and 16.08.2019 and the observations made by the officers of the Board during the visit dated 27-12-2019 and shall submit detailed compliance report to the Board within 07 days. LETS shall ensure compliance of the above decisions. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">5.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->Apart from the above, the CETP operator shall comply with all the decisions taken during the hearing held on 11.09.2020 and 27.05.2021. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">6.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP Operator shall provide the EMF meters at all components of the CETP and ensure the connectivity of the same to the SCADA system to enable a fool proof mechanism. The entire work shall be completed within a time bound manner i.e. 30 days as already decided in the earlier hearing held on 11.09.2020. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">7.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP Operator shall provide piezometers at relevant locations in the CETP premises to monitor the quality of ground water, within 10 days. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">8.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP Operator shall ensure that no new/revised agreements are made by the facility. Ludhiana Effluent Treatment Society (LETS) shall ensure that all the execution works i.e. the membership of the CETP/cancellation of agreements/revision of agreements are carried out through LETS and with the prior permission of the Board in order to maintain a proper statutory regulatory regime. LETS shall be held responsible for any additional agreements made by the CETP Operator. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoHeader" style="text-align: justify; text-indent: -.25in; mso-list: l6 level1 lfo1; tab-stops: .5in center 3.0in right 6.0in; margin: 0in 0in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">9.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The Ludhiana Effluent Treatment Society (LETS) shall be given separate hearing in the case and in future LETS shall be responsible for proper operation of CETP, hearings and other responsibilities. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: normal;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;">These decisions were conveyed to the CETP operator vides no. 5245 dated 16.07.2021. Further, Environmental Compensation amounting to Rs. 1,05,15,000/- was imposed upon the CETP operator vide Board order no. 59 dated 17.07.2021. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: normal;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;">The CETP operator was again given personal hearing before Chairman of the Board on 10.06.2022 for show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974. The proceedings of the said hearing was issued vide Board letter no. 5471 dated 29.08.2022 and wherein it was decided that:-</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">1.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall comply with the all hearing decision dated 16.07.2021, 11.09.2020 and observations of monitoring from 04.08.2021 to 06.08.2021, without any delay. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">2.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall provide list to Board of those industries regularly by 10th of every month, which are not getting their effluent lifted on daily basis, so that the Board can check the operation of the unit.</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">3.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall install device before the equalization tank to measure the lifted effluent from the industries, within a month.</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">4.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall provide the EMF meters at all components of the CETP and ensure the connectivity of the same to the SCADA system to enable a fool proof mechanism. The entire work shall be completed within a time bound manner i.e. 30 days as already decided in the earlier hearing held on 11.09.2020.</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">5.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall monitor the quality of ground water of piezometers installed in the CETP premises and submit report in the office of Environmental Engineer, Regional Office-4, Ludhiana on monthly basis.</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">6.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall achieve the prescribed standards to ensure reuse its RO permeate effluent into industrial premises. CETP operator shall explore the possibilities to utilize its entire treated waste water for construction/sprinkling/dust suppression/onto land for plantation inside and surrounding areas of Focal Point and submit the proposal in this regard in the office of Environmental Engineer, Regional Office-4, Ludhiana within a period of one month.</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">7.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->The CETP operator shall deposit Bank Guarantee of Rs. 10 Lacs, within 07 days. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; mso-list: l2 level1 lfo2; margin: 0in 0in 6.0pt 1.0in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">8.<span style="font-style: normal; font-variant: normal; font-weight: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]-->Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 be granted to the CETP operator for short term i.e. for six months.</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;">The CETP operator has failed to submit bank guarantee of Rs. 10.00 Lacs and the compliance of the decision dated 16.07.2021 and 10.06.2022 to the Board till date. </span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: normal;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;">Thereafter, the CETP Operator has applied for obtaining Consent to Establish (NOC for expansion) for increasing the capacity from 500 KLD to 800 KLD through OCMMS on 12.07.2022 and same was returned on 21.11.2022 due to reasons as below:-</span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; margin: 0in .5in 6.0pt .5in;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><em style="mso-bidi-font-style: normal;">”That consent to establish (CTE) for expansion of CETP shall be applied by the SPV i.e. Ludhiana Effluent Treatment Plant (LETS) which is the overall custodian of the CETP. The consent to establish cannot be given in the hands of M/s JBR Technologies Pvt. Ltd who is mere operator of the said CETP."</em></span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>

DIC/Tech/CETPs-LDH/5988-B dated 16.12.2022 issued by the Secretary-cum-Director of Industries to the Board regarding consent to establish/NOC for expansion for CETP installed for electroplating unit at Phase-VIII, Focal Point, Ludhiana under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981, The relevant content of the letter is as under:-</span></p>

The application of the operator has been returned with the condition that Custodian Department of CETP and SPV-Ludhiana Effluent Treatment Society for Electroplating may apply for expansion of CETP so that same may be processed for necessary action.</em></span></p>
<p><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"> </span></p>
