It is submitted that the BKO was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/PTA/2018/7216761 dated 27/03/2018 & under the Air (Prevention and Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2018/7216749 dated 27/03/2018, which are valid upto 31/03/2019, for manufacturing of bricks @30000Numbers/Day by using Coal @3T/day, CLAY @82500Kgs/day as raw material under orange category subject to certain conditions as mentioned therein.  <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Now, the BKO has applied for obtaining renewal consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of bricks @30000Numbers/Day by using Coal @3T/day, CLAY @82500Kgs/day as raw material under orange category along with requisite documents. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The industry has deposited Rs. 26600/- vide UTR No. AXISF22068048135 dated 09.03.2022 as consent fee under the Water (Prevention & Control of Pollution) Act, 1974 (including penalty fee) & Rs. 27900 /- vide UTR No. AXSK220680003736 dated 09.03.2022 as consent fee under the Air (Prevention & Control of Pollution) Act, 1981 (including penalty and NOC regularization fee), which is adequate upto 30.09.2027, against the investment of Rs. 42.402 lakh as per CA certificate dated 31.10.2022 submitted by it. The BKO has submitted Environment Compensation of Rs. 50,000/- vide R. no. 95/5346 dated 07.04.2022. The BKO has submitted compliance report with the conditions of previous consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to it. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">As per record file, the BKO was visited on 29.01.2020 and found that it had converted its Kiln into induced draft technology with zig zag pattern. Further, the BKO has submitted design adequacy cum completion certificate issued by M/s CSIR-CBRI, Roorkee to the effect that the BKO has constructed its induced draught brick kiln with zig- zag technology, rectangular in shape as per CSIR-CBRI design. Design details given by our licensee M/s Pollution Consultants & Engineers, Faridabad via drawing no. 19/1060 and completed construction as per norms. The industry has submitted an undertaking to the effect that there is no change/addition in existing plant & machinery of unit as on date as well as production capacity and shall comply with code of practice prescribed for the BKO and condition granted to it in the consents. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">                   It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The Board vide office order SEE(HQ-2)/2018/606 dated 18.12.2018 has issued directions to the Regional Offices as under: <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">1. The brick kilns which have adopted induced / high draft zig-zag technology certified by Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board are allowed to operate their brick kilns in the State of Punjab. (Category – I). <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">2. The brick kilns which have adopted induced / high draft zig-zag technology but yet to obtain the completion / adequacy certificate from Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board or to whom the provisional certificate has been given by the technology provider for making corrective measures, are allowed to operate their brick kilns in the State of Punjab, (Category – II). <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">3. The consent to operate to above brick kiln owners / brick kiln shall be granted with the following special condition: - <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">a) Regular consent shall be granted to Category – I brick kilns and consent for shorter period of one year with condition to submit the final completion / adequacy certificate within three months shall be granted to Category-II brick kilns as mentioned above. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">b) The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana/Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">c) The consent is subject to the performance evaluation of new technology adopted by the brick kilns. In view of above, the industry is complying with the provisions of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981.  Keeping in view of the above, it is recommended that the renewal Consent to Operate may be granted to industry under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981 upto 30.09.2027 for manufacturing of bricks @30000Numbers/Day by using Coal @3T/day, CLAY @ 82500 Kgs/day as raw material under orange category, subject to the suitable conditions along with following special condition that: a)          The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. b)         The consent is subject to the performance evaluation of new technology adopted by the brick kilns. c)          The brick kiln will pave moving area around the main brick kiln with the bricks to minimize the fugitive dust emissions. d)         The kiln shall provide sampling arrangement within one month, so that air emission sample may be collected by the Board.
