R13SASCTOA454740 dated 24/12/2013, having validity upto 31/3/2016 for residential township having Shops @ 25 Nos., School @ 1 No. & Residential Plots/ houses @ 500 Nos and for discharge of domestic effluent @ 818 KLD onto land for irrigation and GMADA sewer at Sector 90-91, SAS Nagar.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>The project proponent has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, which same were refused after giving an opportunity of personal hearing before the Chairman of the Board on 13/9/2018. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>The project proponent was again applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, which were refused vide no. CTOW/Renewal/ SAS/2020/9338580 dated 3/1/2020 under the Water (Prevention & Control of Pollution) Act, 1974 and no. CTOA/Renewal/SAS/2020/9328320 dated 03.01.2020 under the Air (Prevention & Control of Pollution) Act, 1981, respectively.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>The project proponent has already added 5.03 acres of land in the said project out of which some land is allotted to project proponents namely M/s Foothill Cooperative Homes, M/s Gill Developers and Promoters Pvt. Ltd., M/s Foothill Cooperative Homes and M/s Gill Developers and Promoters Pvt. Ltd., were applied consent to establish (NOC), which were returned to the project proponents as per compliance of SEIAA letter no. 4423-33 dated 25/6/2021. </span></p>

SEIAA/MS/2022/236 dated 4/7/2022. Further, SEIAA has already issued directions to the Board to launch the prosecution against the responsible persons of JLPL for carrying out the construction activities in the additional land of 5.08 Acre area without obtaining Environmental Clearance. Draft complaint is being prepared so that the same may be got approved from the competent authority before filing in the lower court. </span><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%;">The project proponent has installed 2 modules of STP 1250 KLD each based on MBBR technology for the treatment of wastewater. The STP outlet monitored and as per analysis results the parameters were found to<span style="mso-spacerun: yes;"> </span>be within the prescribed limits. </span><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">But the project proponent has not obtained environmental clearance expansion as required under the EIA notification dated 14/9/2006 till date. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>The Member Secretary (SEIAA) vide its letter no. 4423-33 dated 25/6/2021 has informed that the matter was considered in the 12th Joint meeting of SEIAA/SEAC held on 9/6/2021, wherein it was decided that all concerned regulatory and other authorities (including Electricity and Water Supplies Department) be asked not to provide NOC’s, Completion Certificates or any statutory clearances/ services to Projects which have been established in violation of EIA Notification dated 14/9/2006. In Vide letter under reference, it has been communicated that NOC’s, completion certificate of any statutory clearances/ services to Building Construction/ Area Development and Townships projects which have been established in violation of the EIA Notification 14/9/2006 shall not be issued and they shall be directed to obtain Environmental Clearance from SEIAA, Punjab.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"> <span style="mso-tab-count: 1;"> </span><span style="mso-tab-count: 1;"> </span>The project proponent does not comply with the conditions imposed in the environmental clearance and in compliance to order of Hon'ble NGT in OA no. 34/2020, an Office Memorandum F. no. 22-21/2020-IA.III dated 7/7/2021 was issued by MoEF&CC, GoI, New Delhi in which SOP for identification and handling of violation cases under under the EIA notification dated 14/9/2006 had been defined.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>The project proponent did not comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as conditions mentioned in the consent to operate earlier granted to it under the Water (Prevention & Control of Pollution) Act, 1974 the Air (Prevention & Control of Pollution) Act, 1981 and conditions mentioned in the environmental clearance earlier granted to it, willfully causing water and air pollution in the vicinity, thus, violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 intentionally and deliberately. It was proposed to refuse the varied consent to operate applied by the project proponent under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause/ hearing.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>Therefore, the project proponent was given an opportunity to personal hearing w.r.t show cause notice for <span style="mso-bidi-font-weight: bold;">refusal of varied consent to operate applied under the Water Act, 1974 and the Air Act, 1981 </span>vide Board's letter no. 7583-84 dated 9/12/2022 before the Chairman of the Board on 21/12/2022.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>The representative of the project proponent who attended the hearing submitted that they have applied for environmental clearance. They have obtained TORs. They are complying with the environmental laws for their existing project. The STP is running properly and efficiently. The construction work being carried out on the additional land has been stopped till they obtain the environmental clearance for the same. They may be granted consents to operate under the Water Act, 1974 and Air Act, 1981 for their existing project.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in .7pt 6.0pt 0in;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>After hearing the officers of the Board and the representatives of the project proponent, the Chairman of the Board decided as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">1.<span style="mso-tab-count: 1;"> </span>The project proponent shall operate its STP regularly and efficiently so as to achieve the effluent standards prescribed by the Board.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">3.<span style="mso-tab-count: 1;"> </span>The construction work being carried out on the additional land shall be stopped immediately and shall not restart the same till it obtains the environmental clearance/CTE (expansion).</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">3.<span style="mso-tab-count: 1;"> </span>The project proponent shall be granted consents to operate under the Water Act, 1974 and Air Act, 1981 for its existing project till 31.03.2024.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">4.<span style="mso-tab-count: 1;"> </span>PP shall also develop the vermicomposting to manage the biodegradable solid waste. PP shall not throw burn or burry any solid wastes in open outside premises or in drain / water bodies.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">5.<span style="mso-tab-count: 1;"> </span>PP shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; background: white; mso-fareast-language: EN-IN;">6.<span style="mso-tab-count: 1;"> </span>PP shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt 6.0pt .5in;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">7.<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Regional Office, SAS Nagar shall verify the statements given by the project proponent and monitor the STP, verify the mode of disposal and to verify the compliance with environmental laws as per protocol framed by the Board.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-tab-count: 2;"> </span>If approved, proceedings of the personal hearing as above may be conveyed to the project proponent and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.</span></p>
