Gazipur, Sub-Tehsil Zirakpur, Tehsil Dera Bassi, Distt. SAS Nagar </span><span lang="EN-US">for refusal of consent to establish (NOC) of the Board</span></strong></p>
<p style="text-align: justify;"><span lang="EN-US"> </span>Following were present:</p>

<p style="text-align: justify;"><span lang="EN-US"> </span><span lang="EN-US">It is intimated that the officer of the Board brought out that the </span><span lang="EN-US">project proponent has applied for obtaining consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the development of a Residential Plotted Colony having @ 133 general, @ 15 EWS and 01 Community Centre having 21978 sqm under the name and style of M/s Vision Homes to be developed by M/s Vision Developers and for proposed wastewater to be generated of 90 KLD, out of which 5 KLD will be used for green belt and 37.8 KLD will be used for construction purposes within premises in plotting housing project and 47.2 KLD shall be supplied to M/s N K Sharma Enterprises, Zirakpur through water tankers after treatment with STP. The project proponent has not submitted the proposal of the adequate scientific mode of disposal to handle the wastewater to be generated from the project like the availability of adequate land for utilizing treated effluents for plantation or to adopt other environmentally sound effluent disposal arrangements. Moreover, project proponent has submitted a proposal, same is illegal as this practice is not legally tenable as per the policy of the Board. Further, project proponent namely N K Sharma Enterprises has to install STP for its own projects. The project proponent is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, willfully causing water and air pollution in the vicinity, thus, violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 intentionally and deliberately. It was proposed to refuse the consent to establish (NOC) from pollution applied under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause/ hearing. Therefore, the industry was served show cause notice </span><span lang="EN-US">for </span><span lang="EN-US">refusal of consent to establish (NOC) from pollution angle as under </span><span lang="EN-US">the </span><span lang="EN-US">Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 7585-86 dated 9/12/2022 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 21/12/2022. </span></p>
<p style="text-align: justify;"><span lang="EN-US">The representative of the project proponent attended the personal hearing and submited its reply during the hearing in which it has been mentioned that</span></p>
<p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">1. </span><!--[endif]--><span lang="EN-US">The project proponent submitted water requirement of the project is calculated as under:</span></p>

<p style="text-align: justify;"><span lang="EN-US"> </span></p>
<p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">3. </span><!--[endif]--><span lang="EN-US">As per layout plan, 1100 sqm of land area is to be develop as green belt. Therefore, consumption of treated wastewater in this land area during summer, winter and rainy season will be 6.05KLD, 1.98 KLD and 0.55 KLD, respectively. In addition, a no. of construction activities is being undertaken by the promoter companies in the vicinity of the proposed project and these promoter companies are liable to use treated wastewater for construction activities in compliance to the order passed by the Hon’ble NGT. Therefore, we will supply the treated wastewater to other promoter companies/ own construction and it is estimated that about 10 KLD of treated wastewater will be utilized. Therefore, quantity of excess treated wastewater will be 40.45 KLD (84-28-6-10).</span></p>
<p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">4. </span><!--[endif]--><span lang="EN-US">Since there is no alternate scientific arrangement for utilization of 40.45 KLD of treated wastewater except to install an ELECTRIC EVAPORATOR of capacity 2.0 KL/hr capacity, which is the most robust technology to handle the treated wastewater. The operation of this evaporator will be stopped as soon as the new STP of adequate capacity will be installed and commissioned by MC, Zirakpur.</span></p>
<p style="text-align: justify;"><span lang="EN-US">They also submitted that no treated water will be discharged outside premises. it is plotted project and occupancy will be started after two years. They have already obtained permission from MC Zirakpur.</span></p>
<p style="text-align: justify;"><span lang="EN-US"> </span><span lang="EN-US">After hearing the officers of the Board and the representative of the project proponent, the Senior Environmental Engineer (ZP-1) of the Board decided as under:</span></p>
<p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">A) </span><!--[endif]--><span lang="EN-US">The consent to establish (NOC) from pollution angle applied by the project proponent be granted </span></p>
<p style="text-align: justify;"><span lang="EN-US">for the development of a Residential Plotted Colony having @ 133 general, @ 15 EWS and 01 Community Centre having 21978 sqm and total wastewater generation @ 84 KLD, out of which 28 KLD will be reused for flushing purposes, 6 KLD will be used in green area measuring of land 1100 Sqm, 10 KLD will be reused in construction purposes in its premises and balance about 40.45 KLD will be evaporated with electric evaporator of capacity 2 Kl/hr, after treatment in STP of capacity 100 KLD upto 21/11/2023 </span><span lang="EN-US">with the following special conditions as under:</span></p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1) <!--[endif]-->The project proponent will not discharge treated/ untreated domestic effluent outside from its premises.</p>
<p style="text-align: justify;">2) The project proponent will not discharge domestic effluent into the sewer leading to terminal STP, Zirakpur without prior written permission of the Board.</p>
<p style="text-align: justify;">3) The project proponent shall not give possessions to the owners without installed the adequate capacity of electric evaporator to handle the treated wastewater load under any circumstances.</p>
<p style="text-align: justify;">4) The project proponent shall install a water meter on fresh water supply as well as on all proposed mode of disposal points and maintain the record of the same so as to verify to achieve the zero discharge. </p>
<p style="text-align: justify;">4) PP will develop the project on its own risk & cost in regard to disposal arrangement.</p>
<p style="text-align: justify;">5) The industry shall obtain the necessary clearance for the abstraction of groundwater from the Punjab Water Regulation & Development Authority (PWRDA).</p>
<p style="text-align: justify;">6) The promoter company shall ensure compliance with the Solid Waste Management Rules, 2016, and being the bulk waste generator shall ensure segregation of solid waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorized waste pickers or the authorized recyclers as prescribed in Solid Waste Management Rules, 2016.</p>
<p style="text-align: justify;">7) The PP shall install the smog gun to control the dust emission to be generated from the construction activities of the project.</p>
<p style="text-align: justify;">8) The promoter company shall ensure that the total built-up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise, the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated14/09/2006.</p>
<p style="text-align: justify;">9) The promoter company shall ensure that the total built-up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise, the project as such is covered under category 8(b) of the schedule appended to the EIA notification and project proponent of the area development project is required to obtain the environmental clearance, failure which, the promoter company shall be liable for action for the violation of EIA notification dated14/09/2006.</p>
<p style="text-align: justify;">11. The bio-degradable waste shall be processed, treated, and disposed of through a mechanical composter. The residual waste shall be given to the waste collectors or agency as directed by the local body.</p>
<p style="text-align: justify;">12. The promoter company shall not consume any fuel except HSD for DG set, for burning purposes without the prior written permission of the Board.</p>
<p style="text-align: justify;">13) The industry shall ensure compliance with provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, and or any other environment law applicable to him and rules, circulars issued by the Board from time to time.</p>
<p style="text-align: justify;">18. In case of any violation action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated for closure of the project proponent without further notice.</p>
