ASR/APC/RO/R-55 dated 14/09/2011, (under Red Category), for a period up to 31/03/2015 with suitable conditions mentioned therein, which was further extended vide no. R15ASRCTOA2860089 dated 26/06/2015 up to 30/09/2019 for gravity dust settling chamber.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';"> The brick kiln was visited by JEE of this office on 15/02/2020 and observed that the construction work for high draft technology was under process. Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 was issued vide Zonal Office letter no. 1656 dated 24/06/2020. Thereafter, reminder was issued to The District Food & Supply Controller, Amritsar vide this office letter no. 2943 dated 09/07/2020 for compliance of the orders issued by the competent authority. District Food & Supply Controller, Amritsar vide its letter endst no. 6900 dated 29/12/2020 has issued orders to cancel the license of the brick kiln.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';"> Now, the subject cited brick kiln has applied for varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent under Water (Prevention & Control of Pollution) Act, 1974 (under Orange Category) for the manufacturing of bricks and tiles @ 25000 Nos/day.<span style="color: red;"> </span>The brick kiln has deposited Rs. 30,600/- vide UTR No. N339222233253794 dated 05/12/2022 under Air Act, 1981 and Rs. 27,500/- vide UTR No.<span style="color: red;"> </span>N339222233254657 dated 05/12/2022 under Water Act, 1974 (including Rs. 500/- as an application form fee), to make the consents fee adequate up to 30/09/2032 under both Acts against the fixed assets of the industry below 50 Lakhs.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 0.5in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The Brick Kiln has submitted the copy of Design adequacy cum Completion certificate issued by Central Building Research Institute, Roorkee vide dated 26/12/2020, mentioning that the subject cited brick kiln has constructed hi-draft brick kiln with zig-zag technology, rectangular in design as per CSIR-CBRI design. The Brick Kiln<span style="color: red;"> </span>has also submitted the copy of dimensional drawing/plan & section of Kiln showing the length of Central Island of brick kiln less than 245 ft. The brick kiln has submitted an Certificate duly authenticated by C.A. Ravinder K. Sharma & Co., regarding that the brick kiln has closed down its operations from Jan 2019 to May 2019 and from July 2019 till Aug 2020. The brick kiln has operated for the month of June 2019 only and the brick kiln owner has also deposited Rs. 20,000/- vide R.No. 52/5420 dated 19/12/2022 as Environmental Compensation fee.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 0.5in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">It is further intimated that Punjab Pollution Control Board vide its order no. 346 dated 01/08/2016 has decided that Environmental Clearance for mining of brick earth will not be a pre-requisite for the grant of consent to operate to the brick kilns.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 0.5in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The subject cited brick kiln was visited by AEE of this office on 21/12/2022 and observed as under:-</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 0.75in; text-align: justify; text-indent: -0.25in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The brick kiln has been converted into Induced draft technology with zig-zag settings.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 0.75in; text-align: justify; text-indent: -0.25in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The passage around the vessel was stabilized with Brick Bats & Keri etc.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 0.75in; text-align: justify; text-indent: -0.25in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">No un-authorized fuel seen in the premises of the brick kiln at the time of visit.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 0.0001pt 0.75in; text-align: justify; text-indent: -0.25in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The plantation along the boundary is adequate. However it was guided to plant more saplings in the season.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 0.5in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">Keeping in view of the above, if approved:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 0.75in; text-align: justify; text-indent: -0.25in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as a raw material for the manufacturing of bricks as per Head Office order no. 346 dated 1/8/2016.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 0.75in; text-align: justify; text-indent: -0.25in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The brick kiln shall get its stack emission analyzed as per policy of the Board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 0.75in; text-align: justify; text-indent: -0.25in; line-height: 20.8px;"><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 12pt; line-height: 20.8px; font-family: Arial, 'sans-serif';">The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.</span></p>
