The industry has deposited Rs. 10800/- vide UTR no. MAHBH22255387810 dated 12/09/2022 as NOC fee against the project cost of Rs.<span style="color: red;"> </span>185.79 Lacs, which is adequate for one year as per Board's Office Order dated 29/10/2018</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">Accordingly, the industry was visited by the AEE of this office on <strong>22/12/2022</strong>. During the visit, it was observed as under:</span></p>

The firm has completed construction of its boundary wall & office and engaged in construction of foundation for machinery. However, it has not installed any plant and machinery. </span></p>

However, the subject cited industry is located in Industrial zone as per Master Plan (2010-2031) of Khanna. The industry has submitted land use classification certificate from DTP, Ludhiana vide letter no. 2541 dated 07/11/2022, which is reproduced as under:</span></p>

However, the Site Clearance u/s 41 (A) of the Factories Act, 1948 will not be necessary for grant of consent to establish/ operate/ authorization by the Board. It is submitted that the subject</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;"> </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: AR-SA;">cited industry is located in Industrial zone as per Master Plan (2010-2031) of Khanna. Therefore, there is no requirement of Site Clearance u/s 41 (A) of the Factories Act, 1948.</span></p>
<p class="MsoNormal" style="margin-right: -4.5pt;"><strong><u><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">Applicability of EIA notification dated 14/09/2006</span></u></strong></p>
<p class="MsoNormal" style="margin-right: -4.5pt; text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;"><span style="mso-tab-count: 2;"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';"><span style="mso-spacerun: yes;"> </span>The subject cited industrial process is covered under EIA notification dated 14/09/2006 but the proposed production will be less than 5,000 TPA. So, the industry is not required to apply for obtaining Environmental Clearance under EIA notification dated 14/9/2006. </span></p>
<p class="MsoNormal" style="margin-right: -4.5pt; text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';"><span style="mso-tab-count: 2;"> </span>Further, MoEF & CC OM dated 23.06.2011 regarding applicability of Environmental Clearance for New / Expansion of existing aluminum recycling project is reproduced as under:</span></p>
<p class="MsoNormal" style="margin-right: -4.5pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">"Ministry of Environment and Forests has received a reference from Metal Recycling Association of India seeking clarification regarding applicability of EIA Notification, 2006 for setting up of new/expansion of existing Aluminum recycling projects.</span></em></p>
<p class="MsoNormal" style="margin-right: -4.5pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">It is clarified that the Aluminum Recycling Units based on gas/ oil fired furnace are not covered under the EIA Notification, 2006 and no environmental clearance is required for such projects under the provisions thereof. However, NOC under the Air and Water Acts, Authorization / Registration under the Hazardous Waste (Management, Handling and Transboundary Movement) Rules, 2008<span style="color: red;"> </span>as may be applicable to such cases may be required.</span></em></p>
<p class="MsoNormal" style="margin-right: -4.5pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">It is further suggested that the raw material used should not have radioactive and harmful alloying element additions like lithium, selenium, vanadium etc. and there should not be any hazardous chemical contamination. Preferably, natural gas should be used as fuel. In case of use of oil, it should have low sulphur concentration; otherwise, lime scrubbing should be done to mitigate the SO</span></em><em><span lang="EN-US" style="font-family: 'Cambria Math','serif'; mso-bidi-font-family: 'Cambria Math';">₂</span></em><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: 'Bookman Old Style';"> emissions."</span></em></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="mso-bidi-font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-bidi-language: AR-SA;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-justify: inter-ideograph; line-height: 115%; tab-stops: 481.5pt; margin: .15pt 0in 12.0pt 13.5pt;"><strong><em><span lang="EN-US" style="font-size: 11.0pt; mso-bidi-font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></em></strong></p>
<p class="MsoHeading8" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-size: 11.0pt; mso-bidi-font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; font-style: normal;">In view of the above, it is recommended that the industry may be granted NOC for one year <strong>i.e. 21/12/2023</strong> for manufacturing of Aluminium Billets/Ingots @ 2055 MT/Year</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; font-style: normal;"> </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial; font-style: normal; mso-bidi-font-style: italic;">with suitable conditions </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; font-style: normal; mso-bidi-font-style: italic;">and additional conditions that:</span></p>
