<p style="text-align: justify;">The industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2021/14552267 dated 06.01.2021 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2021/14551942 dated 06.01.2021, which was valid upto 31.12.2022 for offices only and operation of DG set of capacity 750 KVA with special conditions as under:</p>
<p style="text-align: justify;">I. The industry shall not consume any fuel except HSD for DG set, without prior written permission of the Board.</p>
<p style="text-align: justify;">II. The industry shall not carry out any wet process without prior written permission of the Board, as such, it shall not generate or discharge any kind of trade effluent. The industry shall discharge only domestic effluent into sewer.</p>
<p style="text-align: justify;">Now, the industry has now applied for obtaining renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents.</p>
<p style="text-align: justify;">The industry has submitted the CA certificate wherein the value of fixed assets of the industry as on 31.03.2022 is Rs. 1.26 crores. There is no change in the value of CA certificate submitted by the industry. The industry has deposited the consent to operate fee of Rs. 6400/- vide UTR no. SBIN122353424599 dated 19.12.2022 & Rs. 1500/- vide UTR no. SBIN122353423281 dated 19.12.2022 under Water Act, 1974 and Rs. 6400/- vide UTR no. SBIN122353425662 dated 19.12.2022 under Air Act, 1981. The fees deposited by the project proponent, the consent fee under Water Act, 1974 is adequate till 31.03.2024 and consent fee under Air Act, 1981 is adequate till 31.12.2023.</p>
<p style="text-align: justify;">It is worth to mention here that as per the office order dated 02/02/2016, it has been directed to process the cases of Orange and green category of industries solely on the undertaking submitted by the industry and since the project proponent has submitted the compliance report of the conditions imposed in the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, the same may be considered as good as the undertaking to the effect that it is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Further, as per Board office order no. PPCB/SEE HQ-2/2020/88 dated 30.01.2020 no inspection of the unit shall be carried out by the Board officers/ officials upon the receipt of the application except in those cases where some pollution related complaint or violation proceedings are pending against the specific unit. In cases, where no complaint or violation proceedings are pending, consent to establish/ operate will be issued on the basis of information provided in the simplified form and undertaking appended it.</p>
<p style="text-align: justify;">In view of above, it is recommended that the ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed to the industry upto 31.12.2023 subject to the same conditions as mentioned in the previous Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</p>
