It is submitted that Zonal Office-I, Patiala has sought comments from EPA cell w.r.t gap analysis report before deciding the application of consent to establish submitted by M/s Rainbow Environments Pvt. Ltd., Mohali. The comment w.r.t gap analysis are as under: 1)         A gap analysis report was submitted by the committee constituted by the Appellate Authority in appeal filed by M/s Rainbow Environments Pvt. Ltd., Mohali. The findings of the said report are reproduced as under:         i)            All the CBWTFs operators are catering to bed capacity beyond 10,000 beds and 75 km. The comparison regarding the bed strength in 2022 and 2032, installed treatment capacity in the State presently and proposed BMW generation in the year 2032.       ii)            Proper coverage of area may be catered within 75 km of the radius as per guidelines.     iii)            Present, all the 5 CBWTFs are catering more than 10,000 beds due to the fact that the total bed strength in the State is 81,842 and some of the CBWTFs is catering to HCFs more than 150 km.     iv)            To keep the coverage area within 75 km of radius for new facilities and maximum no. of beds allotted to a CBWTF 10,000 in compliance of the Central Pollution Control Board guidelines and also keeping in view the proposed bed strength in the State in 2032 as 1,20,395 beds, 8 no. more CBWTFs are required to be established by year 2032. 2)       Further, AEE of the Regional Office vide note dated 11.11.2022 informed that the facility is already operating a CBMWTF under the name & style of M/s Rainbow Environment Pvt. Ltd. at Vill. Baliyali, Teh. Mohali, Distt. SAS Nagar, which is located at an aerial distance of approx. 17 km from the proposed CBMWTF site. The facility has already installed 02 no. incinerator at the existing site of capacity 65 Kg/hr & 150 Kg/hr. Therefore, the common facility is required to de-commission the old unit before commencing operations of the proposed unit with suitable transition period (not more than 1 month). Besides the above, Regional Office, Mohali vide note dated 11.11.2022 recommended that the consent to establish (NOC) under Water Act, 1974 and Air Act, 1981 may be granted for one year for the establishment of a Common Bio-Medical Waste Treatment Facility (CBMWTF) at Plot No. A-8A & C-79A, Industrial Focal Point, Chanalon, Kurali for the processing of Bio Medical Waste @ 6.75 Ton/ day with certain conditions. 3)       From the above, it is evident that the findings of the gap analysis report are not creating any hindrance to the grant of consent to establish to the applicant. Moreover,  numbers of Common Bio-medical Waste Treatment Facilities remain the same as the applicant is shifting its existing to the designated industrial zone i.e. industrial focal point Chanalon, Kurali. 4)       In view of the above, it is proposed that the recommendations made by the Regional Office, Mohali vide note dated 11.11.2022 may be accepted by the Zonal Office-1, Patiala with the same conditions.                                           The above is submitted for approval, please.
