PTA/WPC/04/340 dated 31.03.2004 and under the Air (Prevention and Control of Pollution) Act, 1981 vide no. PTA/Air/04/265 dated 31.03.2004, which were valid upto 06.04.2019 for manufacturing of Eggs @ 285 egg Per Birds Per year by using 50,000 layer birds.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">Now, the poultry farm has applied for varied consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention &amp; Control of Pollution) Act, 1981 for manufacturing of Eggs @ 1,65,000 egg Per day by using 1,80,000 layer birds and Maize, Bajra, Soya, Doc etc. @ 18 T/day with latest CA certificate, Compliance report of previous consent conditions, MC certificate, Tehsildar Certificate etc. The industry has deposited Rs. 84000/- Vide UTR No. N336222230168425 dated 02.12.2022 &amp; Rs. 42000/- Vide online receipt&nbsp;&nbsp;No. 498347265&nbsp;dated 19.12.2022 as water consent fee and Rs. 84000/- vide UTR No. N336222230180026 dated 02.12.2022 &amp; Rs. 42000/- Vide online receipt&nbsp;&nbsp;No. 827592837 dated 19.12.2022 as air consent fee against the fixed assets of Rs. 274.65 Lacs as on 31.03.2022. After, deducting of penalty for four years, The consents fee deposited by the industry is adequate up to 06.04.2030. The industry has also deposited Rs. 8400/- Vide online receipt No. 827592837 dated 19.12.2022 as NOC regularization fee due to increase in fixed assets. The industry has also submitted compliance report of conditions of consents earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">The representative of the industry informed that the poultry farm has continuously increased its birds capacity before the year 2011 to 1.8 lakh birds. In this regard, the poultry farm has submitted year wise fixed assets certificate indicating the increase in the building / assets upto the year 2011 certified by the Chartered Accountant, which shows that the expansion of the project with regard to building and machinery has been made before the issuance of the guidelines for poultry farm (copy attached).</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">A similar case of M/s Alpine Poultry, Village Kheri Musalmania, Tehsil &amp; Distt. Patiala was granted by this office, in which the promoter has made capacity expansion of the farm before 2015 and submitted its balance sheet from Chartered Accountant as documentary proof.&nbsp;&nbsp;&nbsp;&nbsp;</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">As per the certificate issued from Nagar Council, Samana vide letter no. 2467 dated 18.08.2022, the site of the poultry farm is located outside the MC limit of Samana. Further, the industry has submitted letter of Naib Tehsildar, Samana dated 11.08.2022, wherein it is mentioned that there are no 15 pucca houses within 100 m radius of the poultry farm. The poultry farm has also submitted revised building plans for the unit.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">The industry was visited by the AEE of this office on 08.12.2022. Sh. Karan Gupta, Manager of the industry was present at site. During visit, it was observed as under:&nbsp;</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">The industry is a poultry farm of capacity 1,80,000 layer birds.&nbsp;</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">The bird droppings are being stored below the poultry farm. The bird droppings are removed twice a year at the time of new crops to be used as manure in the fields as per informed by representative.&nbsp;&nbsp;</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">The poultry farm has provided septic tank to treat domestic effluent generated from the toilet, the treated effluent is discharged into channel to utilize the same in the fields along boundary of the shed.</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">The poultry farm has installed one D.G. set of capacity 125 KVA, which is without canopy and stack of adequate height.</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">No problem of odour and flies was observed at the time of visit.</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">As per record file, no compliant case is pending against the poultry farm.</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">During visit, it was found that no MC limit, Lal Lakir / Phirni of any village, residential area comprising of 15 pucca houses and wild life sanctuary / zoo falls within the radius of 100 mtr of the poultry farm.</span></p> <p class="MsoListParagraph" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -0.25in; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; line-height: 20.8px;">The industry is complying with the provisions of Water Act, 1974, Air Act, 1981 and Environmental Guidelines framed by CPCB.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">As, the poultry farm has made expansion upto the year 2014 i.e. well before the siting guidelines notified by CPCB for poultry farms in the year 2016. Thus, General siting guidelines would be applicable in the said matter.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">As per the report of MC Samana/ Naib Tehsildar, Samana/ visit of the undersigned, the site of the poultry farm is suitable for expansion, which has already been done by the unit upto the year 2014.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span style="font-size: 12pt; line-height: 20.8px;">Keeping above in view, it is recommended that varied of consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of Eggs @ 1,65,000 egg Per day by using 1,80,000 layer birds&nbsp;&nbsp;may be granted to the industry upto 31.12.2029 with suitable conditions as per policy of the Board as special conditions as under:</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span lang="EN-IN" style="font-size: 12pt; line-height: 20.8px;">1. The poultry farm shall not increase its bird capacity without obtaining prior NOC/ varied consent to operate from the Board as well as without providing adequate pollution control measures.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span lang="EN-IN" style="font-size: 12pt; line-height: 20.8px;">2. The poultry farm shall adopt latest environmental guidelines for poultry farms issued by the CPCB in true letter and spirit.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span lang="EN-IN" style="font-size: 12pt; line-height: 20.8px;">3. The industry shall ensure that there is no public nuisance polluted in the area due to activities within its premises.</span></p> <p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; line-height: 20.8px; background: white;"><span lang="EN-IN" style="font-size: 12pt; line-height: 20.8px;">4. The industry shall comply with the guidelines of the Punjab Water Regulation and Development Authority (PWRDA).</span></p>
