<p class="MsoBodyText" style="margin: 0in 0.15in 12pt 11pt; text-indent: 61pt; line-height: 150%; text-align: justify;"><span style="font-size: 11.0pt; line-height: 150%;">It is submitted that the above industry established without obtaining the Consent to Establish (NOC) from pollution angle. The industry has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under the name and style of M/s A And K Enterprises A Unit Of Hotel Mandarin, Sco 4-6, Kalka Shimla Highway, Dhakoli, Zirakpur, District SAS Nagar for hotel having 19 rooms capacity under green category <strong>(3052-Hotels (up to 20 rooms and without boilers) and having waste water generation < 10 KLD and no hazardous waste generation)</strong>. </span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 12pt 11pt; text-indent: 61pt; line-height: 150%; text-align: justify;"><span style="font-size: 11.0pt; line-height: 150%;">The industry has deposited Rs. 93534/- vide R. No. 412581214 dated 15.12.2022 (Rs. 32000/- under Water (Prevention & Control of Pollution) Act, 1974, Rs. 56534 late fee / penalty and Rs. 5000/- under VDS Scheme) and Rs. 93534/- vide R. No. 557855395 dated 15.12.2022 (Rs. 32000/- under Air (Prevention & Control of Pollution) Act, 1981, Rs. 56534 late fee / penalty and Rs. 5000/- under VDS Scheme). The total fee deposited by the project proponent is adequate for 5 years i.e. upto 31.03.2028 against the total cost of the project Rs. 152.96 lacs as per latest CA certificate submitted by the project proponent.</span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 12pt 11pt; text-indent: 61pt; line-height: 150%; text-align: justify;"><span style="font-size: 11.0pt; line-height: 150%;">The project proponent has submitted partnership deed between Sh. Amir Singh S/o Hawa Singh R/o H. No. 2811, Sector-21, Panchkula (hereinafter called the party of FIRST PART) and Sh. Kuldeep Rai S/o Late Sh. Ram R/o H. No. 800, Sector-21, Panchkula (hereinafter called the party of SECOND PART).</span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 12pt 11pt; text-indent: 61pt; line-height: 150%; text-align: justify;"><span style="font-size: 11.0pt; line-height: 150%;">The project proponent has submitted site plan approved by Competent Authority for Hotel purpose. The industry shall generates domestic effluent @ 6 KLD and is being treated in the STP installed. After treatment, treated effluent is being used onto land for plantation. </span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 12pt 0in; text-indent: 1in; line-height: 150%; text-align: justify;"><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">The site of the industry was visited by officer of the Board on 22.12.2022. During the visit, it was observed as under:</span></p>

<p class="MsoBodyText" style="margin: 0in 0.15in 0.0001pt 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-language: PA;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">The project proponent has developed a hotel consisting of rooms/banquet/ restaurant</span><span style="font-size: 11.0pt; line-height: 150%;">.</span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 0.0001pt 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-language: PA;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">The project proponent has installed STP and same was in operation during the visit. </span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 0.0001pt 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-language: PA;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">The project proponent submitted that the hotel is partially run due to economic loss / financial loss during COVID-19 pandemic.</span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 12pt 0in; text-indent: 1in; line-height: 150%; text-align: justify;"><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">In view of above, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 31.12.2027 with suitable conditions as per the policy of the Board and additional conditions that:</span></p>

<p class="MsoBodyText" style="margin: 0in 0.15in 0.0001pt 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-language: PA;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">The industry shall discharge only domestic effluent onto land for plantation after treatment in STP.</span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 0.0001pt 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-language: PA;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">The industry shall not generate any trade effluent.</span></p>
<p class="MsoBodyText" style="margin: 0in 0.15in 0.0001pt 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-language: PA;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; mso-bidi-font-family: Raavi; mso-bidi-language: PA;">The industry shall not start any other new process within its unit which may change its category from Green to Orange/ Red, without the prior written permission of the Board.</span></p>
