Clarification Note: Subject: Show cause notice for refusal of the consent to operate under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Whereas, it is mandatory on the part of the industry to obtain consent to establish (NOC) / consent to operate of the Board u/s 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 for discharging of waste water and air emissions from its premises. And whereas, it is mandatory on the part of industry to install proper and adequate pollution control devices so as to ensure that the various pollutants in effluent / emissions to be discharged by industry, conforms to the effluent/emission standards as prescribed by the Board / Ministry of Environment and Forests New Delhi under Environment (Protection) Act 1986. And whereas, the industry was granted 'consent to establish' (NOC) of the Board vide no. CTE/Fresh/SGR/2022/18713587 dated 20.05.2023 valid upto 19.05.2023 for processing of paddy @ 4.0 TPH (with mechanical drier and sortex plant) for processing of paddy @6.0 TPH) subject to the conditions mentioned therein. And whereas, the industry has now applied for obtaining fresh consents under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974. And whereas, the industry was visited by the AEE on 12/12/2022 and it was observed that the industry has not provided paved brick road inside their premises for the movement of vehicles. Moreover, the industry has not provided adequate plantation area along with the boundary wall. And whereas, the rice shelling unit is not complying with the code of practice prescribed by Board for the rice sheller units. And whereas, it has now been proposed to refuse the application of the industry for obtaining consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 after affording an opportunity of show cause. As such, you are hereby given an opportunity to show cause within 10 days as to why the proposed action may not be initiated, failing which, it will be presumed that the industry has nothing to say and the proposed action will be taken against the industry without giving any further notice/opportunity.
