<p class="MsoNormal" style="text-align: justify;">In compliance of decisions of hearing taken by Chairman of the Board on 7/11/2022, RO has reported that the project proponent submitted copy of approved building plan dated 05.06.2014 as per which the FAR area is 195644 Sqft and covered area is 217116.60 Sqft (including basement + mumty). As such the total built up area of the project is 20170.8 Sqmt, which is greater than 20000 Sqmt and the project proponent was required to obtain prior Environmental Clearance under category 8b of the EPA notification dated 14.09.2006. However, the project proponent has not obtained Environmental Clearance as per record file of this office and has wrongly obtained consents from the Board for built up area of 195594.52 sq. meter (i.e. 18171.33 sqm).</p>
<p class="MsoNormal" style="text-align: justify;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>Further record of fresh water consumption for the period 01.10.2022 onward was checked and average fresh water consumption is 83 KL and the highest fresh water consumption was noted to be 234 KL on 13.10.2022, which is much more than the fresh water requirement of the project @ 88 KLD. Further, the occupancy of the project is about 22 -25% as such the total fresh water requirement of the project when fully occupied will be much more than the 88 KLD claimed during the time of CTE.<span style="mso-spacerun: yes;"> </span>The samples of STP were collected during visit on 05.12.22 and as per analysis results BOD-39 mg/lt against 30 mg/lt is beyond the prescribed limits of the Board.</p>
<p class="MsoNormal" style="text-align: justify;"><span style="mso-spacerun: yes;"> </span>In view of above, it is recommended that consent applied by the project under Water Act, 1974 and Air Act, 1981 may be refused and action for failure to obtain prior Environmental Clearance as necessitated under MoEF&CC office memorandum dated 12.12.2012 may be initiated against the Project Proponent with hearing before Chairman of Board pl.</p> |
