CTOA/Renewal/PTA/2018/7407229 dated 14/05/2018 having validity upto 31/03/2023 <strong style="mso-bidi-font-weight: normal;">for manufacturing of Tin coated Plates @ 310 TPD or @ 1,10,000 TPA by using HR Coils @210 Metric Tonnes/Day</strong>, Chromic acid @15.5 Kgs/day, Hydrochloric/sulphuric acid @4.5 Metric Tonnes/Day, Caustic flakes @25 Kgs/day, Sodium dichromate @155 Kgs/day, Stannous sulphate @31 Kgs/day, CR coils @110 Metric Tonnes/Day, Tin @1.55 Metric Tonnes/Day as raw material subject to certain conditions as mentioned therein.</span></p>

CTE/Mod/PTA/2020/12858553 dated 11/08/2020 which was valid upto 18/06/2021</strong> <strong style="mso-bidi-font-weight: normal;">for manufacturing of Tin Coated Plates @ 310 Metric Tonne/Day by using HR Coils @ 210 Metric Tonne/Day, CR Coil @ 110 Metric Tonne/Day</strong>, Tin @ 1.55 Metric Tonne/Day, Hydrochloric/Sulphuric Acid @ 4.5 Metric Tonne/Day, Caustic Flakes @ 25 Kg/Day, Sodium Dichromate @ 155 Kg/Day, Stannous Sulphate @ 31 Kg/day, Ethoxylated naphthol Syltonic Acid (ENSA) @ 9 Kg/Day, Di-octyl Sebacate (DOS) @ 1.5 Kg/Day and Chromic Acid @ 15 Kg/Day as raw material under red category subject to conditions as mentioned therein and some of the additional conditions as under:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 72.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif;">This consent is issued to the industry for installation of high tech cold rolling mill (6Hi) (technology upgradation from 4Hi to 6Hi) in addition with the existing cold rolling mill (4Hi) for achieving better quality of the product at the same production capacity.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 72.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif;">The industry shall get its revised building plans approved from the competent authority and submit to this office at the time of obtaining varied consent to operate. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 72.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif;">The industry shall ensure that there will be no increase in the pollution load with the proposed modernization and industry shall bound to install APCD/ upgrade its ETP if found generating any additional wastewater/ emissions. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 72.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif;">The industry shall submit technical report including sampling report of the stack to ascertain its submission regarding non-requirement of APCD/ recovering system to treat the process emissions being generated from cold rolling process due to use of coolant within one month.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><strong><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></strong><!--[endif]--><strong><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">It is pertinent to mention here that the industry had specifically submitted request letter at the time of applying for ‘Consent to Establish’ for modernisation that there shall be no increase in the production capacity after the implementation of their proposed modernisation project and it shall remain the same @ 120000 TPA. (copy attached)</span></strong></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">Thereafter, the aforementioned ‘Consent to Establish’ for modernisation was issued to the industry for installation of high tech cold rolling mill (6 Hi) technology upgradation from 4 Hi to 6 Hi in addition with the existing cold rolling mill (4 Hi) for achieving better quality of product at the same production capacity and the industry shall stick with its production capacity of tin coated plates @ 310 MTD after the installation of new cold rolling mill. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-bidi-font-weight: bold;">Lately, the industry had applied for </span><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">varied consent to operate under the Water Act, 1974 and under the Air Act, 1981 <strong style="mso-bidi-font-weight: normal;">for manufacturing of Tin coated plates @ 420 Metric Tonnes/Day and CR Coil (for captive consumption) @ 330 Metric Tonnes/Day by using HR coil (for cold rolling) @ 345 Metric Tonnes/Day, CR coil @ 110 Metric Tonnes/Day,</strong> Tin @ 2 Metric Tonnes/Day, Caustic @ 30 Kgs/day, Hydrochloric/Sulphuric acid @ 4.5 Metric Tonnes/Day, Di-octyl sebacate (DOS) @ 2 Kgs/day, Ethoxylated naphthol syltonic acid (ENSA) @ 12 Kgs/day, Stannous sulphate @ 40 Kgs/day, Sodium dichromate @ 190 Kgs/day, Chromic acid @ 20 Kgs/day as raw material. The RO had recommended to grant the same to the industry upto 31.03.2023 after regularising the enhanced production capacity manufacturing of Tin coated plates @ 420 Metric Tonnes/Day and CR Coil (for captive consumption) @ 330 Metric Tonnes/Day.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">In this regard, the industry had submitted feasibility report prepared by M/s TerraSyn Initiatives, Patiala wherein it is mentioned that the industrial unit has modernized its existing CR mill by installation of new 6Hi CR mill, which resulted in much better & increased production capacity and the augmentation will increase the installed production capacity of tin coated plates @ 420 MT/day (~150000 MT/annum). Further, Inhouse cold rolling of ~345 MT/day of the HR coil, will result in ~330 MT/day CR coil (exclusively for captive consumption). Thus, total CR coil quantity available for process use will be ~440 MT/day (at rated installed capacity), resulting in final product of ~420 MT/day. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;"> </span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">The above report clearly indicates that the industry has increased its <strong style="mso-bidi-font-weight: normal;">manufacturing capacity of Tin coated plates from 310 Metric Tonnes/Day to 420 Metric Tonnes/Day</strong> by way of increasing consumption of raw materials & installation of new cold rolling mill machinery, thus violating the conditions of the ‘Consent to Establish’ (NOC) for modernisation earlier granted to it. Further, no compliance given by the RO as well as the industry regarding the aforementioned additional conditions of the NOC for Modernisation. Moreover, the said NOC for modernisation had expired on 18/06/2021.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">Therefore, due to no merits in the application for grant, the same was returned online due to the following reasons:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 72.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-bidi-font-weight: bold;">The industry has carried out expansion in violation of conditions imposed in the NOC (for modernization) and misguiding the Board by taking NOC for modernization instead of NOC for expansion.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 72.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-bidi-font-weight: bold;">The industry had not deposited the NOC expansion fee / regularization fee since NOC for modernization expired since 18.06.2021.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 72.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-bidi-font-weight: bold;">Moreover, the unit is required to obtain environmental clearance as per MoEF&CC vide notification no. S.O. 3250(E) dated 20.07.2022.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">Now, the industry has again applied for varied consent to operate under the Water Act, 1974 and under the Air Act, 1981 <strong style="mso-bidi-font-weight: normal;">for manufacturing of Tin coated plates @ 420 Metric Tonnes/Day and CR Coil (for captive consumption) @ 330 Metric Tonnes/Day by using HR coil (for cold rolling) @ 345 Metric Tonnes/Day, CR coil @ 110 Metric Tonnes/Day,</strong> Tin @ 2 Metric Tonnes/Day, Caustic @ 30 Kgs/day, Hydrochloric/Sulphuric acid @ 4.5 Metric Tonnes/Day, Di-octyl sebacate (DOS) @ 2 Kgs/day, Ethoxylated naphthol syltonic acid (ENSA) @ 12 Kgs/day, Stannous sulphate @ 40 Kgs/day, Sodium dichromate @ 190 Kgs/day, Chromic acid @ 20 Kgs/day as raw material.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana; color: black;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">The industry has now submitted request letter with the application mentioning that the increase in installed production capacity was not as per the original plan of modernization, but an indirect consequence of the modernization. The MoEFCC notification (vide no. SO 3250 (E), dated 20.07.2022, endorsed by the PPCB (vide letter no. 20242-57, dated 23.09.2022), has mandated the requirement of “Environmental Clearance” for “cold rolling” based activities, within one year; however, their proposed modernization was achieved much before July 2022. Further submitted that till now industry is being operated at consented capacity of 310 MT/day and requested that it shall be granted CTO (Varied) for increased installed production capacity, which was in place prior to 20.07.2022.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: Verdana; mso-bidi-font-family: Verdana; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">9.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-bidi-font-weight: bold;">It is worthwhile to mention here that the MoEF&CC vide notification no. S.O. 3250(E) dated 20.07.2022, has notified that:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; margin: 0cm 26.05pt 8.0pt 2.0cm;"><em style="mso-bidi-font-style: normal;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-bidi-font-weight: bold;">“</span></em><em style="mso-bidi-font-style: normal;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif;">Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non–toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B;</span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; margin: 0cm 26.05pt 8.0pt 2.0cm;"><em style="mso-bidi-font-style: normal;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif;">Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs <strong style="mso-bidi-font-weight: normal;">that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grant of Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation.</strong></span></em></p>

Therefore, the existing consented capacity of the unit as per the said notification can only be considered as 310 TPA. Moreover, the industry has not submitted any proof for application of TOR followed by EC for the existing consented capacity of 310 TPA, which indicates that the industry intends to get the enhanced production capacity of 420 TPA regularised via this varied CTO and apply for TOR followed by EC for the same enhanced capacity as its existing production capacity, to abate the public consultation step for EC (if applicable to such projects) in lieu to the provisions of the aforesaid notification. <span style="mso-spacerun: yes;"> </span></span></strong></p>

<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; margin: 0cm 26.05pt 8.0pt 35.45pt;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif;">Keeping above in consideration, if approved, the application of the industry </span><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-bidi-font-weight: bold;">for </span><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-bidi-font-family: Tahoma; color: black; background: white;">varied consent to operate under the Water Act, 1974 and under the Air Act, 1981 for regularizing its enhanced manufacturing capacity of Tin coated plates @ 420 Metric Tonnes/Day and CR Coil (for captive consumption) @ 330 Metric Tonnes/Day, be refused without affording any opportunity of personal hearing to it.</span></p> |
