<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 72.0pt;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">The industry had also obtained NOC for expansion vide no. CTE/EXP/RPN/2021/16813562 dated 22.11.2021 which was expired on 31.10.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">The industry was issued show cause notice under the Water Act, 1974 along with an opportunity of personal hearing before the CEE (Patiala) on 15.11.2022, as the industry was not conforming to the prescribed standards. In the said hearing, it was decided as under: </span></p>

<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">Meanwhile, the industry had applied for obtaining varied consent to operate under the provisions of the Water Act, 1974 and the Air Act, 1981 for the products i.e. Juices @ 16 Kilo Liters/Day, Carbonated Juice based beverages @ 140 kilo ltr/day and Other Non-alcoholic beverages @ 6 kilo ltr/day alongwith requisite documents </span><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">in the new name & style of <strong>M/s Archian Foods Private Limited</strong>.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">The industry has also applied for obtaining (NOC) for expansion/'Consent to Establish' under the provisions of the Water Act, 1974 and the Air Act, 1981 for the products i.e. Juices @ 75 kilo ltr/day and Carbonated Juice based beverages @ 460 kilo ltr/day alongwith requisite documents </span><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">in the new name & style of <strong>M/s Archian Foods Private Limited</strong> </span><span lang="EN-US" style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">which <span style="mso-spacerun: yes;"> </span>is being processed separately.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">The industry has submitted the CA certificate dated 09.09.2022, wherein, the value of total assets of the industry as on 31.07.2022 is Rs. 6512.78 lakhs with value of plant & machinery is Rs. 5197.73 lakhs. The industry has deposited consent to operate fee Rs. 72,000/ vide UTR no. AXTB222720236075 dated 29.09.2022 under the Water Act, 1974 and Rs. 74,500/- vide UTR no, AXTB222720236072 dated 29.09.2022 under the Air Act, 1981. As such, the fee deposited by the industry under the Water Act, 1974 and the Air Act, 1981 is adequate upto 31.07.2023 after deducting 10% penalty for late application fee as per circular dated 29.10.2018.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">Further the unit has submitted the project report vide which the project cost of the unit under expansion is Rs. 89.75 cr and the industry has deposited NOC/CTE fee of Rs 86,500/- vide UTR no. AXTB220826104554 dated 23.03.2022 which is adequate for one year.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 70.9pt;"><span lang="EN-US" style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: EN-IN;">The details of existing and proposed wastewater generation and treatment along with adequacy of plantation area are tabulated in the note attached. </span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 70.9pt;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">At present, ETP is having capacity 50 KLD consisting of consisting of<span style="color: red;"><span style="mso-spacerun: yes;"> </span></span></span><span lang="EN-US" style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; color: #222222; background: white;">Collection sump, Coarse and Fine Screen, Equalization tanks, Primary Clarifier, Anaerobic Digester, Primary Clarifier II, MBBR, Aeration Tanks, Secondary clarifier, Dual Media Filter, ultra-filter</span><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">. After expansion, the generation of trade effluent will be about 85 KLD, as such, the unit has proposed additional ETP of capacity 65 KLD making a total ETP capacity of 115 KLD for treatment of trade effluent to be generated after expansion.</span></p>

After expansion, the industry will generate wastewater (domestic + trade effluent ) to the tune of 91.5 KLD (85<span style="mso-spacerun: yes;"> </span>KLD of trade effluent + 6.5KLD of domestic effluent) which will be utilized onto land for plantation of about 2.25 acres, which is adequate taking into account the suggestive hydraulic loading of wastewater to the tune of<span style="mso-spacerun: yes;"> </span>60-70 kl/acre/day. </span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 3.0cm; background: white;"><span style="font-size: 10.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">Accordingly, in compliance to the decisions of the personal hearing and to process the applications, the industry was visited by AEE of this office on 25.11.2022 and it was observed as under:</span></p>

The treated wastewater after sand and carbon filters is being used onto land for plantation. </span></p>

Thereafter, the industry had obtained permission to add product juices and non-alcoholic beverages in the already granted Change of Land Use for industrial purpose vide no. PBIP/CAPA(HUD)2018/1230 dated 12.10.2018 subject to the suitable conditions mentioned therein. The Department of Housing and Urban Development, Punjab has issued notification vide no. PS/PSHUD 206 on 12.11.2021 regarding requirement/non-requirement of CLU for setting up of standalone Green, Orange & White category of industries. As per the said notification, CLU, EDC and other statutory charge as applicable shall be payable at the time of building plan approval. The industry has submitted copy of building plans of the whole project including expansion, approved by director of factories, Punjab dated 10.08.2022. Therefore, the site of the industry is suitable for expansion as per said notification. However, the copy of the NOC (expansion) to be granted may be sent to the Department of Housing & Urban Development with request to intimate if there is any objection regarding suitability of proposed site. <span style="mso-spacerun: yes;"> </span></span></p>
