It is submitted that the subject cited industry is a small-scale induction furnace unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/FGS/2021/15347639 dated 28/04/2021 & under the Air Act, 1981 vide no. CTOW/Fresh/FGS/2021/15347639 dated 28/04/2021 both valid upto 30/09/2021 for the manufacturing of M.S. Ingots & Castings @ 70 TPD with suitable conditions. The industry had applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 but as  approved by the competent authority of the Board, the subject cited application was returned back to the applicant with a request to file its consent applications based on authenticated and requisite documents to prove that the applicant is a rightful/legal occupier of the industry as well as responsible for environmental liability due to operations of said industry. The industry then through its director Gaganinder Chattley filed an appeal on 04/07/2022 before the Appellate Authority constituted under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, Department of Science Technology and Environment, Government of Punjab, against the order-cum-proceedings dated 18/06/2022 of Punjab Pollution Control Board vide which the consent to operate application of the applicant industry has been returned/ rejected. The Appellate Authority has passed following Orders on 01/12/2022  in the said appeal : ‘In view of the above record facts, observations and the undertaking given by the appellant for deposit of adequate fee, I do not find any reason to decline consent to operate to the appellant industry. Accordingly, the Board is directed to grant consent to operate to the appellant industry with suitable conditions under the provisions of the Water (Prevention and Control of Pollution) Act, 1981 and the Air (Prevention & Control of Pollution) Act, 1981 . The person to whom the consent is granted by the Board shall be liable for action under the provisions of the above statures in case of any non-compliance’.           Incompliance to the above said Orders, now the industry namely M/s Narindra Castings Private Limited B5 B6, Focal Point, Mandi Gobindgarh Amloh,  Fatehgarh Sahib  through its director Gaganinder Chattley has again applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981.   It was observed that the industry has submitted CA certificate as on 30/08/2021, whereas, as per the documents required to be submitted alongwith the application, the industry is required to submit CA certificate regarding un-depreciated value of the fixed assets of the industry at the end of last financial year. Further, as per the Orders of Appellate Authority (dated 01/12/2022) constituted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, Government of Punjab, the industry (Appellant) has submitted an undertaking dated 16/11/2022 w.r.t. no increase in the assets from the year 2017-18. The industry was requested to submit the same alongwith the application. The industry in reply to the clarification has submitted CA certificate as on 31/03/2022 according to which the cost of fixed assets is 2.29 cr. (under the fee slab Rs. 2 to 5 cr.).  The CA has mentioned a note in the certificate that as the company is yet to adopt the Financial Statements for F.Y. 2017-18, 2018-19, 2019-20, 2020-21 and 2021-22 thus we have verified the above said figures from unaudited copy of accounts of above stated Assets for the F.Y. F.Y. 2017-18, 2018-19, 2019-20, 2020-21 and 2021-22 produced before us. The variation (if any) on A/c of Statutory Audit cannot be commented as on date. The industry has  submitted undertaking 16/11/2022 w.r.t. no increase in the assets from the year 2017-18. Copy attached in the note history. The consent fee deposited by the industry on account of Water consent fee and Air Consent fee is adequate upto 30/09/2025 (details given in the agenda note) as per Board's Office Order dated 29/10/2018 against the un-depreciated fixed assets of Rs. 229.54 Lacs as on 31/03/2022, as per CA certificate dated 19/12/2022.  On raising clarification, the industry has got its stack emission samples analyzed from SIMA Lab (NABL approved Lab)on 19/12/2022 and submitted stack emission analysis report in this office during the visit and through email in this office on 26/12/2026 and as per analysis report the SPM level found in the stack is 56.8 mg/Nm3, which is within the prescribed limit of 150 mg/Nm3 for such type of industries. Accordingly, the industry was visited by the E.E. alongwith AEE of this office on 26/12/2022 during evening hours and contacted Sh. Gaganinder Chattley, Director at site. During the visit, it was observed as under: <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: 12.85pt; mso-line-height-rule: exactly; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 58.5pt; text-autospace: none; margin: 0cm 0cm .0001pt 96.4pt;">1)                   The industry was found not in operation. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: 12.85pt; mso-line-height-rule: exactly; mso-pagination: none; mso-list: l0 level1 lfo2; text-autospace: none; margin: .05pt 0cm .0001pt 96.4pt;">2)                             The industry has installed induction furnace of capacity 5 TPH, as informed by the representative of the industry. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: 0cm 18.9pt .0001pt 96.4pt;">3)                             The industry has installed dust collector followed by bag house filter as APCD alongwith side hood with its induction furnace. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: .1pt 19.15pt .0001pt 96.4pt;">4)                             The industry has installed separate energy meter for APCD operation and is maintaining record regarding the same. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: 0cm 18.95pt .0001pt 96.4pt;">5)                             As per the record file, the industry has already obtained completion certificate from PSCST, Chandigarh vide no. 1641 dated 04/01/2021 for bag filter as APCD over induction furnace of capacity upto 6 TPH. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: 0cm 18.85pt .0001pt 96.4pt;">6)                             The industry has installed 1 no. DG set of capacity 115 KVA, which is equipped with canopy and stack of adequate height. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: .05pt 0cm .0001pt 96.4pt;">7)                             No water is used in the process, so no trade effluent is generated. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: 12.85pt; mso-line-height-rule: exactly; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: .05pt 0cm .0001pt 96.4pt;">8)                             Domestic effluent is discharged into PSIEC sewer. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: 12.85pt; mso-line-height-rule: exactly; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: 0cm 0cm .0001pt 96.4pt;">9)                             The industry has not stabilized its vehicular movement area. <p class="MsoListParagraph" style="text-align: justify; text-indent: -60.4pt; line-height: 12.85pt; mso-line-height-rule: exactly; mso-pagination: none; mso-list: l0 level1 lfo2; tab-stops: 96.45pt; text-autospace: none; margin: 0cm 0cm .0001pt 96.4pt;">10)                          Incompliance to the special condition no.5 and 6 imposed in the consent to operate, the industry has not installed night vision high definition CCTV cameras covering the emission generation from the crucible and connected with the server of the Board. <p class="MsoListParagraph" style="text-align: justify; line-height: 12.85pt; mso-line-height-rule: exactly; mso-pagination: none; tab-stops: 96.45pt; text-autospace: none; margin: 0cm 0cm .0001pt 96.4pt;">  The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: "The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."           No complaint has been received / pending in this office against the industry. The industry is located in the Industrial Focal Point of Mandi Gobindgarh.    In view of above mentioned facts, if approved, Senior Environmental Engineer, Zonal Office – II, Patiala may be recommended that 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981, be granted to the industry upto 30/09/2025 with suitable conditions and following special conditions: 1.        The industry shall stabilize its vehicular movement area within 2 months and submit compliance. 2.        The industry shall install night vision high definition CCTV cameras covering the emission generating from the crucible and connect the camera with the server of the Board within 2 months and submit compliance. 3.        The industry shall be bound to install adequate and appropriate pollution control device/system as per the design of reputed institute for control of secondary emissions generated from furnace unit. 4.        The industry shall be bound to submit NOC regularization fee / Balance consent fee to the Board, if there is an increase in the cost of fixed assets, after the industry  gets the statutory audit completed. 5.        The industry shall not generate and discharge any trade effluent. 6.        The industry shall apply for renewal of authorization under Hazardous and Other Waste (Management and Trans-boundary) Rules, 2016 within 1 week. 7.        The industry shall comply with Punjab Water Regulation and Development Authority (PWRDA) guidelines.
