<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry had earlier obtained consent to operate under Water Act, 1974 and Air Act, 1981 upto 30/06/2020 for manufacturing of products M.S. & Alloy Steel Ingots @ 40 Metric Tonnes/Day.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">All the induction furnace units of the State of Punjab were requested to get its Air Pollution Control Device (APCD) alongwith its collection system evaluated from Punjab State Council for Science & Technology (PSCST), Chandigarh regarding efficiency, alongwith side hood design by 31.10.2018.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry failed to provide side hood and APCD as per design of PSCST, as such, the industry was given hearing before the Chief Environmental Engineer, Ludhiana on 04.06.2019, wherein, it was decided as under:-</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; text-indent: -30.0pt; mso-list: l4 level1 lfo1; background: white; margin: 0in 0in 0in 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: Arial; color: black;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry shall obtain the design of APCD alongwith side collection hood from the PSCST Chandigarh within 15 days.</span></p>

<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; text-indent: -30.0pt; mso-list: l4 level1 lfo1; background: white; margin: 0in 0in 0in 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: Arial; color: black;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry shall submit bank guarantee amounting to Rs 1.0 Lacs within one week as an assurance to comply with hearing decision 1 & 2 as above and comply with the provisions of the Air Act, 1981 & Water Act, 1974.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; text-indent: -30.0pt; mso-list: l4 level1 lfo1; background: white; margin: 0in 0in 0in 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: Arial; color: black;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">Environmental Engineer, Regional office shall visit the industry after 31.07.2019 to verify the compliance of hearing decision & process the consent cases on merit within one week.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="text-align: justify; text-indent: -30.0pt; mso-list: l4 level1 lfo1; background: white; margin: 0in 0in 0in 27.0pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: Arial; color: black;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">Further action in the matter will be taken after receipt of report from Regional office.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry had neither deposited the bank guarantee nor submitted the compliance of hearing decisions. The industry was visited by officer of the Board on 22.06.2021 & 22.10.2021 and observed that the industry has not provided APCD alongwith side hood as per design of PSCST. During visits, the industry was also persuaded to apply for consents under the Water Act, 1974 & the Air Act, 1981. The industry was also issued show cause notice vide letter no. 119 dated 06.01.2022 for violation of the provisions of Water Act, 1974 and the Air Act, 1981. But the industry has not applied for consents so far.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">To check latest status, the industry was again visited by officer of the Board on 21.09.2022 in the presence of Sh. Mahesh Gupta, Director of the industry. During visit, it was observed as under:-</span></p>

The representative of the industry told that unit is operated off & on basis.</span></p>

The industry has not yet provided side hood & APCD as per design of PSCST. However, the work regarding installation of new APCD was in progress.</span></p>

But the representative failed to show any document/feasibility report of PSCST.</span></p>

D.G. set of 125 KVA capacity equipped with canopy.</span></p>

<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">Accordingly, the directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 were issued vide letter no. 5189 dated 23.11.2022 for closure of unit and the PSPCL authority have also been directed to disconnect electric connection of the industry.</span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;"> </span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">The industry was also issued notice to impose Environmental Compensation (EC) with hearing before Chairman of the Board on 06.12.2022. </span></p>
<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">Sh. Mahesh Gupta, Director of the industry attended the hearing and gave his statement as under:</span></p>

It was informed that the APCD will be completed soon.</span></p>

<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">After hearing the representative of the industry, officers of the Board and considering background of the case and material facts on the record, the Chairman of the Board decided that:-</span></p>

<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">Now, the industry has applied for consent to operate under Water Act, 1974 & Air Act, 1981. The industry has submitted consent fees under Water Act, 1974 & Air Act, 1981 valid upto 30.06.2023. The industry was visited on 21.12.2022 and it was observed as under :-</span></p>

The industry has submitted completion certificate from PSCST vide no. TFD/610 dated 09.12.2022 mentioning that the industry has installed the induction furnace and APCD as per the prescribed SOPs/guidelines prescribed by PSCST.</span></p>

<p class="ydp8b25cf8eyiv6589084485ydp48a32f10msonormal" style="margin: 0in; text-align: justify; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial',sans-serif; color: black;">In view of above, it is recommended as under:</span></p>
