The industry was initial in operation in the name and style of M/s H.Hero Agro Industries Pvt. Ltd., for production of saila rice or raw rice @ 80 TPD and sorted rice @ 4 TPH. The unit was divided into two units namely M/s H.Hero Agro Industries Pvt. Ltd. and M/s H.Hero Agro Export Pvt. Ltd., by dividing the land area and existing machinery into two parts and accordingly the consents were granted to both the units for production of steamed rice or raw rice @ 40 TPD and sorted rice @ 2 TPH. The bifurcation of one unit into two units was allowed on the basis of the undertaking obtained from the industrial units "That with the bifurcation of one unit into two units, there will be no increase in production capacity, in land area & the power load of both the units in comparison to the single unit earlier operated under the name & style of M/s H.Hero Agro Industries Pvt. Ltd. with the consents of the Board. Now the industry has applied for obtaining varied consents for production of steamed rice/raw rice @ 80 TPD and sorted rice @ 2 TPH i.e. at double capacity. The legal opinion in the matter has already been obtained by the Regional Office vide e-office file no. 139387 (copy attached vide note dated 26.12.2022 at 9:49), wherein the Senior Law Officer has given his opinion in the matter that:                    " The examination of the record has revealed that at the initial stage, the single unit was set up and established with the NOC of the Board and the unit was operating with the consents of the Board under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. Later on, bifurcation was allowed by the Board and two units have come into existence as explained above. When the unit has been established with the NOC of the Board, the sitting criteria laid down by the Government allows the expansion of Rice Mills and Saila Plants located at the Municipal Limits and in the designated area of the cities, within their existing premises if pollution load of existing unit has been taken care of.                              In view of the above stated facts, I do not find any restriction in allowing the expansion of the unit M/s H. Hero Agro Industries Pvt. Ltd from 40 TPD to 80 TPD. However, the said expansion has to be carried out in the existing premises i.e land area of 34K 16M (K : Kanal, M : Marla) with no increase in pollution load and electricity load of 300 KW which is already available to the unit."           Further, the Regional Office has reported that the industry was visited by the AEE of RO, Faridkot on 23.09.2022 and found that the industry was complying with the provisions of the Water Act, 1974 & Air Act, 1981.        Submitted for consideration and further orders please.
