Respected Sir, it is submitted that, the Board vides its order no.6676-77 dated 27.02.2022 has already defined following necessary documents to be obtained from the BKO for levying the Environmental Compensation on Brick Kilns, which were operated without converting to induced draft technology. a)   The Coal Register duly signed by the BKOs and getting an undertaking <a name="_Hlk123313985"></a>to the effect that the entries made in the Coal Register are true & correct, may be taken as documentary evidence. e) For the Brick Kiln, which are using other authorized fuel than coal such as agro fuels/biomass, may be asked to submit a self-undertaking mentioning the period for which the BKOs had operated the Brick Kiln without conversion into Induced Draught Technology. b)   The documents as mentioned in Para a & b above are to be authenticated by the Charted Accountant.   <span lang="EN-US" style="font-size: 13.5pt; font-family: Verdana, sans-serif; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"> In present case, the industry has already submitted certified copy of coal register, which shows that the industry was not operated after May, 2019, till its conversion to induced draft technology i.e. issuance of completion certificate by CBRI, Roorkie dated 19/02/2020. Further, the industry has also submitted self-undertaking <span lang="EN-US" style="font-size: 13.5pt; font-family: Verdana, sans-serif; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">to the effect that the entries made in the Coal Register are true & correct, may be taken as documentary evidence. <span lang="EN-US" style="font-size: 13.5pt; font-family: Verdana, sans-serif; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Accordingly, the industry has deposited the requisite environment compensation amounting to Rs. 44,000/- for the actual period of its operation, in compliance of the above said decisions. However, no specific directions were issued by the Board to ascertain the actual date of commissioning of BKO to high draft technology. As per the documentary evidence, the BKO had converted to high draft technology in the period 01.06.2019 to 19.02.2020. Furthermore, a<span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">s per the record available in this office, the DFSC had issued show cause notice to the BKO vide its letter 299 dated 16.01.2019 with an opportunity of personal hearing to the industry on 22.01.2019. Thereafter, no correspondence has been received from the office of DFSC regarding the same. <span lang="EN-US" style="font-size: 12pt; font-family: Verdana, sans-serif; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">As now, the industry is complying with the guidelines/ procedure laid down by the Board for levy of EC and is also complying with the Environmental Laws from pollution angle. As such no separate NOC is required to be taken from DFSC at this stage. <span lang="EN-US" style="font-size: 12pt; font-family: Verdana, sans-serif; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">  <span lang="EN-US" style="font-size: 12pt; font-family: Verdana, sans-serif; color: #5d5d5d; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"> Keeping in the view of above, it is recommended that:- 1. Directions earlier issued to the BKO u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may please be dropped. 2. This office may be allowed to grant fresh Consent to operate under Water Act, 1974 for manufacturing of Bricks / Tiles @ 20,000 Numbers/Day for a period upto 30.09.2029 & varied consent under the Air Act, 1981 may be granted to BKO for manufacturing of Bricks / Tiles @ 20,000 Numbers/Day for a period upto 30.09.2023, with suitable conditions as per policy of the Board. 3. Personal Hearing may be given to the DFSC, Sangrur before the competent authority for not complying with the Direction issued by the Board.
