<p style="text-align: justify;">It is submitted that the industry was issued show cause notice without hearing on 02.12.2022 and 22.12.2022. The industry had submitted the reply of the show cause notice on 12.12.2022 in its OCMMS application as under:</p>
<p style="text-align: justify;">"We have received your office letter 1279 dated 2 December 2022 regarding show cause notice for refusal of consent to establish under the water act 1974 and air act 1981 as per your letter we have applied consent to establish for dying of all type of fabrics (polyester/PC/cotton) @ 10650 kg per day with the discharge of Trade effluent @ 498 kld and domestic effluent 2.0 kld into CETP 50 MLD. we have also submitted share certificate of 500 KLD issued from PDA on dated 10/10/2022. but as per previous letter submitted by PDA on dated 22 July 2022 same has allotted shares 870 kld to us but we had applied NOC 500 KLD only. reference to your letter it is to inform you that we had applied shares to PDA 870 KLD but due to some reason our payment (cheque) not transfer to same as per last date fixed by PDA. only 500 KLD payment (cheque) cleared upto last date, due to same reason PDA has issued us only 500 KLD shares certificate. so we have applied consent to establish 500 KLD only it is also inform you that if in future PDA will issued us certificate 870 KLD we will apply immediately consent to establish for expansion. Now you are humbly requested to please issued us consent to establish for dying for all type of fabrics (polyester, PC ,cotton) 10650 kg with discharge of trade effluent 498 KL and domestic effluent 2.0 KLD as possible."</p>
<p style="text-align: justify;">As already mentioned with OCMMS application, as per the list regarding allotment of share dated 22.07.2022 supplied by the Punjab Dyers Association, Tajpur Road, Ludhiana this unit has been granted shares of 870 KLD. However, thereafter the industry had transferred the 100 KLD share to M/s Narrang Son International & 121 shares to M/s Ganga Dyeing & Processors. Further the PDA vide letter dated 10.10.2022 has issued the share certificate of 500 KLD to this unit.</p>
<p style="text-align: justify;">Further, the industry was again issued show cause notice of 7 days without hearing as was directed to submit share allotment certificate duly signed by Chairman, directors and company secretary of CETP 50 MLD. However, the industry has not submitted any reply in this regard till date.</p>
<p style="text-align: justify;">May if approved, it is recommended that NOC application of the industry may be refused, please.</p>
