<span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">Kindly peruse the report/ recommendations sent by RO, Fatehgarh Sahib. <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">  <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">The following facts have been observed from the report of RO as well as the application of the industry: <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">  1.   <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">The industry was granted 'consent to establish' (NOC) under the Water Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/FGS/2022/18326415 dated 13/05/2022 valid upto 21/04/2023, for the manufacturing of Seamless pipe & Tubes (Cold) @48Metric Tonnes/Day Seamless pipe & Tubes (Hot) @72 Metric Tonnes/Day, subject to suitable conditions and one of the additional conditions that “The industry shall not carry out any activity in its premises which is covered under the ambit of EIA notification dated 14.09.2006.” 2.   <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">Meanwhile, the MoEF&CC vide notification no. S.O. 3250(E) dated 20.07.2022, has notified that: “Central Government is of the view that steel re-rolling operations fall under the purview of the secondary metallurgical processing industry and require Environment Clearance as per item 3(a), relating to Metallurgical Industries (Ferrous and Non-ferrous), of the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification number S.O. 1533 (E), dated the 14th September, 2006, mandating the requirement of prior environmental clearance for the projects covered in its Schedule (hereinafter referred to as the said notification), wherein all non–toxic secondary metallurgical processing units with capacities greater than 5000 tonnes/annum (TPA) fall under category B; Now, therefore, in exercise of the powers conferred by section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby directs that all the standalone re-rolling units or cold rolling units, which are in existence and in operation as on the date of this notification, with valid Consent to Establish (CTE) and Consent to Operate (CTO) from the concerned State Pollution Control Board or the Union territory Pollution Control Committee, as the case may be, shall apply online for grant of Terms of Reference (ToR) followed by Environment Clearance and the said units shall be granted Standard Terms of Reference as per item 3(a) of the said notification and shall be exempted from the requirement of public consultation Provided that the application for the grant of ToR shall be made within a period of one year from the date of this notification.” Furthermore, the Board has endorsed the said notification vide letter no. 20242-57 dated 23.09.2022, with advisory to all concerned industries to comply with the above-mentioned provisions of said notification in true letter & spirit. 3.   Also, PPCB vide OM no. 383 dated 16.11.2022 has directed the seamless pipe plants for manufacturing of pipe & tubes having processes Green like reheating, rolling, piercing/manderling, drawing (elongation) etc. (using CNG/PNG/LPG as fuel to obtain Environmental Clearance (EC) from MoEF&CC/SEIAA, Punjab as mandated under the provisions laid down under the MoEF&CC Notification No. S.0. 3250(E) dated 20.07.2022 before starting any activity regarding its establishment at site. 4.   The industry has not neither obtained Environment Clearance from the competent authority nor has applied for grant of ToR, as mandated by the MoEF notification for such units. 5.   Now, the industry has applied for obtaining partial 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">for the manufacturing of Seamless pipe & Tubes (Cold) @48Metric Tonnes/Day only. 6.   As such, the industry cannot be granted CTO under the Water & Air Act without obtaining Environment Clearance from the competent authority; as Environment Clearance is prerequisite for grant of CTO in accordance with PSSTE notification dated 02.03.2022 & policy of the Board dated 30.04.2013 and submission of necessary compliance & requisite fees. 7.   <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Verdana',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Arial; background: white; mso-fareast-language: EN-IN;">The industry has applied for generation & lifting of trade effluent @ 4.8 KLD to CETP operator at Chanalon; however, the agreement executed with CETP operator is for 100 KL/ month (~3.33 KLD) only. Keeping above in consideration, if approved, the application be sent back to RO, Fatehgarh Sahib for returning the same to the industry with request to resubmitting its application in lieu to the above points.
