It is intimated that the industry is a medium scale orange category unit and was granted consent to establish NOC under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/LDH1/2022/17553905 dated 19.05.2022 valid upto 18.05.2023 with special conditions mentioned therein.           Thereafter, the industry applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and the application was returned, as the industry failed to obtained environmental clearance.           Now the industry has again applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The application has already been scrutinize by AEE PBIP and has been forwarded to this office for verification of the proposal of the industry, carrying out field visit of the project site & submission of report/ recommendation.           In order to verify the facts, the industry was visited by the officer of this office on 30.12.2022 and it was observed as under:- 1.    The industry was in operation and is a rolling mill. 2.    The industry has installed one REVERBERATORY furnace of capacity @ 637 MTD and presently furnace oil was being used as fuel. 3.    The industry has an option for using gas as fuel, as the company namely think gas has started laying pipelines in the area. 4.    The industry has installed alkali scrubber as APCD along with stack of adequate height and proper sampling arrangements. 5.     The industry has also installed 3 nos. D.G sets of capacity @62.5 KVA, 125 KVA and 250 KVA. All the D.G sets are equipped with canopy and stack of adequate height. 6.    There is no source of generation of trade effluent and only domestic effluent is generated, which is discharged onto land for plantation after treatment in STP. The STP comprises of bar screen collection tank, MBBR, Tube settler, pre-filtration tank, DMF, Sludge drying bed. 7.    The industry has submitted completion certificates of APCD as well as STP. 8.    The industry has maintained the record of operation of APCD as well as STP. It is pertinent to mention here that the industry was granted consent to establish prior to the notification dated 20.07.2022. Further, SEIAA vide its letter dated 1308 dated 23.12.2022 has clarified that the industry may be considered as an existing industry so far as the provisions of notification dated 20.07.2022 are concerned and the grant of consent to operate under the water Act, 1974 and Air Act, 1981 to the industry upto 19.07.2023 may be considered on merits by PPCB subject to the condition that the industry shall obtain Environmental clearance under the EIA Notification dated 14.09.2006 before 20.07.2023. In case the EC is not granted by this date, the case will be reviewed and decided as per then obtaining circumstances and directions of the MoEF&CC.             In view of the above it is recommended that the application may be forwarded to the PBIP for grant of 'Consent to operate under the provisions of Water Act, 1974 & Air Act, 1981 upto 19.07.2023 with suitable terms and condition, please.   (Comp: CEE, PBIP, Chandigarh.)
