The details of the case are given in the note of AEE, which may kindly be perused. The industry is a small-scale induction furnace unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/FGS/2021/15347639 dated 28/04/2021 & under the Air Act, 1981 vide no. CTOW/Fresh/FGS/2021/15347639 dated 28/04/2021 both valid upto 30/09/2021 for the manufacturing of M.S. Ingots & Castings @ 70 TPD with certain conditions mentioned therein. The industry applied for obtaining consent to operate under Water Act, 1974 and Air Act, 1981, but as approved by the Competent Authority of the Board, the applications were returned back to the industry with a request to file its consent applications based on authenticated and requisite documents to prove that the applicant is a rightful/legal occupier of the industry as well as responsible for environmental liability due to operations of said industry.   Thereafter, the industry through its Director Gaganinder Chattley filed an appeal on 04/07/2022 before the Appellate Authority constituted under the Water Act, 1974 and the Air Act, 1981, Department of STE, Government of Punjab against the order-cum-proceedings dated 18/06/2022 of the Board vide which the consent to operate application of the applicant industry were returned/ rejected. The Hon’ble Appellate Authority heard both the parties and passed Orders on 01/12/2022, the operative part of the same is reproduced as under: ‘In view of the above record facts, observations and the undertaking given by the appellant for deposit of adequate fee, I do not find any reason to decline consent to operate to the appellant industry. Accordingly, the Board is directed to grant consent to operate to the appellant industry with suitable conditions under the provisions of the Water (Prevention and Control of Pollution) Act, 1981 and the Air (Prevention & Control of Pollution) Act, 1981. The person to whom the consent is granted by the Board shall be liable for action under the provisions of the above statures in case of any non-compliance’.           Incompliance to the above said orders, now the industry namely M/s Narindra Castings Private Limited, B5 B6, Focal Point, Mandi Gobindgarh Amloh,  Fatehgarh Sahib  through its director Gaganinder Chattley has again applied for obtaining renewal of consent to operate under the Water Act, 1974 and under the Air Act, 1981 alongwith requisite documents & fee.  The industry has got its stack emission samples analyzed from SIMA Lab (NABL approved Lab) on 19/12/2022 and as per analysis report the conc. of particulate matter is 56.8 mg/Nm3 against 150 mg/Nm3. As reported by RO, the industry was visited by the E.E. alongwith AEE of RO on 26/12/2022 during evening hours and contacted Sh. Gaganinder Chattley, Director at site and observed as under: 1.       The industry was found not in operation. It has installed induction furnace of capacity 5 TPH, as informed by the representative of the industry. 2.       The industry has installed dust collector followed by bag house filter as APCD alongwith side hood with its induction furnace as per design of PSCST, Chandigarh. 3.       The industry has installed separate energy meter for APCD operation and is maintaining record regarding the same. 4.        No water is used in the process, so no trade effluent is generated. Only, domestic effluent is discharged into PSIEC sewer. 5.       The industry has not stabilized its vehicular movement area. 6.       Incompliance to the special condition no.5 and 6 imposed in the consent to operate, the industry has not installed night vision high definition CCTV cameras covering the emission generation from the crucible and connected with the server of the Board.    Regional Office has recommended that renewal of 'consent to operate' under the Water Act, 1974 and under the Air Act, 1981 may be granted to the industry upto 30/09/2025 with suitable conditions and following special conditions as mentioned in the note of AEE. Since, the industry is yet to comply with the 2 no. special conditions as imposed in previous consents. Therefore, in view of the facts mentioned above and order passed by the Hon’ble Appellate Authority, if approved, renewal of Consent to Operate under Air Act, 1981 may be granted to the industry for one year with the following specific conditions : 1.         The industry will operate & maintain its air pollution control device (APCD), regularly and efficiently, so as to achieve the stack emission standards, consistently as prescribed by the Board/ MoEF&CC as amended from time to time. 2. The industry shall ensure that no black smoke should be emitted from the stack of the industry at any time. 3. The industry shall get the stack emission monitoring from Board within one month. 4. The industry shall stabilize its vehicular movement area within 15 days and submit compliance. 5.        The industry shall install night vision high definition CCTV cameras covering the emission generating from the crucible and connect the camera with the server of the Board within 15 days and submit compliance. 6.        The industry shall be bound to install adequate and appropriate pollution control device/system as per the design of reputed institute for control of secondary emissions generated from furnace unit. 7.        The industry shall be bound to submit NOC regularization fee / Balance consent fee to the Board, if there is an increase in the cost of fixed assets, after the industry gets the statutory audit completed. 8.        The industry shall obtain authorization under Hazardous and Other Waste (Management and Trans-boundary) Rules, 2016 within one week.         (Competency : Worthy Chairman)
