It is intimated that the industry was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2019/10213901 dated 03/08/2019 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2019/10213856 dated 23/07/2019 both which had expired on 30/09/2021 for production of Individual Quick Freezer @3T/Hour, Frozen Product cold storage capacity @3700 MT/Year, Controlled Atmosphere Cold storage @1300 MT/Year, Sorting Grading Packing Facility for Frozen Products, @2T/Hour, Sorting Grading Packing Facility for Fresh Produce @5T/Hour subject to suitable conditions mentioned therein.                      Now, the industry has applied for renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with requisite documents and consent fee. As per the record file of this office, the consent fee previously deposited by the industry was adequate upto 30.06.2022. Now, the industry has deposited Rs. 174000/- vide R no. 66568380 dated 15.12.2022 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 126000/- vide R no. 776192435 dated 15.12.2022 under the Air (Prevention & Control of Pollution) Act, 1981 the consent fee deposited by the industry is adequate upto 30.09.2027 (considering Rs. 48000/- as penalty for late fees) against the fixed assets of Rs. 1975.70 lacs as on 12.12.2022. It is submitted that while processing the online application, a clarification was raised on 20.12.2022 and the industry vide its online reply has submitted as under:   “At the time of earlier Consent our Processing Plant was not in operation and still also our Plant is not in operation. We also confirms that we will use the all treated water for reuse in processing operation and rest of water shall be discharged for irrigation land. We also ensures and confirms that we will submit the additional Land agreement for use of irrigation before start of the processing operations in the plant. Now we request you to please grant us the Consent for pollution”. Further, along with the online application, the industry has uploaded following undertaking is attached. It is worth to mention here that as per the office order dated 02/02/2016, it has been directed to process the cases of Orange and green category of industries solely on the undertaking submitted by the industry and since the project proponent has submitted the compliance report of the conditions imposed in the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, the same may be considered as good as the undertaking to the effect that it is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.  Hence, the industry was not visited by undersigned since it has apply for renewal of Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974.  In the above, if may approved, the consent to operate granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 for production of Individual @3T/Hour, Frozen Product cold storage capacity @3700 MT/Year, Controlled Atmosphere Cold storage @1300 MT/Year, Sorting Grading Packing Facility for Frozen Products, @2T/Hour, Sorting Grading Packing Facility for Fresh Produce @5T/Hour  may be renewed upto 30.09.2027, subject to suitable conditions and additional conditions that: 1.     This letter shall remain appended with the original consent to operate granted to the industry vide no. CTOW/Fresh/SAS/2019/10213901 dated 03/08/2019 under the Water Act, 1974 and vide no. CTOA/Fresh/SAS/2019/10213856 dated 23/07/2019 under the Air Act, 1981. 2.     The unit shall not start any new process within its unit which may change its category from Orange to Red, without the prior written permission of the Board. 3.     The industry shall intimated this office as and when the processing unit is made operational at the site, so as to enable the Board to carry out effluent as well as stack emission sampling. 4.     The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 5.     The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 6.     In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.   Competency- Chief Environmental Engineer
