R14NWSCTOA1027868 dated 21/03/2014 which was expired on 31/01/2019 for manufacturing of Brick & Tiles @ 6,00,000 Per round subject to the suitable terms & conditions mentioned therein.</span></p>
<p class="MsoBodyText" style="margin: 5.2pt 5.85pt 0.0001pt 0cm; text-indent: 76.55pt; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Thereafter, the brick kiln was issued show cause notice vide this office letter no. 1293 dated 05.11.2022 for violating the provisions of the Air Act, 1981 with an opportunity of personal hearing on 18.11.2020, wherein, it was decided as under:</span></p>
<p class="MsoBodyText" style="margin: 5.2pt 5.85pt 0.0001pt 36pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The brick kiln will apply for Varied Consent to Operate under the Air Act, 1981 and Fresh Consent to Operate under the Water Act, 1974 within 07 days.</span></p>
<p class="MsoBodyText" style="margin: 5.2pt 5.85pt 0.0001pt 36pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The brick kiln will provide proper sampling platform with the stack of the brick kiln for carrying out stack monitoring within 07 days.</span></p>
<p class="MsoBodyText" style="margin: 6pt 5.9pt 0.0001pt 0cm; text-indent: 71.95pt; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Now, the brick kiln has applied for obtaining varied of consents to operate under the Air (Prevention & Control of Pollution) Act, 1981 and fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Brick & Tiles @ 30,000 numbers per day alongwith requisite documents and consent fee. </span></p>
<p class="MsoBodyText" style="margin: 6pt 5.9pt 0.0001pt 0cm; text-indent: 71.95pt; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The brick kiln has submitted adequacy cum completion certificate issued by Punjab State Council for Science & Technology, Industrial Area, Sector 26, Chandigarh vide letter no. PSCST/CC/1036 dated 26.02.2020 wherein, it has been mentioned that M/s Arora Brick Kiln Co. has constructed Induced Draft Brick Kiln with Zigzag firing as per the technology evolved by Punjab State Council for Science & Technology. The brick kiln has attached the self-attested and CA attested coal register wherein, the brick kiln was operated for the months of May and June 2019 and thereafter it was not operated upto March 2020. </span></p>
<p class="MsoBodyText" style="margin: 6pt 5.9pt 0.0001pt 0cm; text-indent: 71.95pt; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry has deposited EC of Rs. 50,000/- vide no. 05/5292 dated 20.03.2020 for operating the brick Kiln for 2 months without converting into </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Induced Draft technology.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The brick kiln has submitted the CA certificate, wherein, the value of fixed assets as on 09.08.2022 is Rs. 33.77 lakhs with value of machinery is Rs. 16.37 lakhs. As per the record file, the unit has deposited consent to operate fee under the Water Act, 1974 and Air Act, 1981 and the details are as given below:</span></p>

<p class="MsoBodyText" style="margin: 5.85pt 5.9pt 12pt 0cm; text-indent: 0cm; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';"><span style="mso-tab-count: 2;"> </span>As such, the fee deposited by the brick kiln under the Water Act, 1974 is adequate upto 30.06.2030 after deducting 300% penalty as late application fee and under the Air Act, 1984 is adequate upto 31.03.2031 after deducting 400% penalty as late application fee as </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">per circular dated 29.10.2018</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">.</span></p>
<p class="MsoBodyText" style="margin: 5.9pt 6pt 0.0001pt 0cm; text-indent: 71.95pt; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Accordingly, the brick kiln was visited by the AEE of this office on 02.01.2023 and Sh. Pankaj Kumar, representative of the brick kiln was contacted. During visit, it was observed as under:</span></p>
<p class="MsoListParagraph" style="margin-top: 5.95pt; text-indent: -18.05pt; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The brick kiln was not in operation during<span style="letter-spacing: -.55pt;"> </span>visit.</span></p>
<p class="MsoListParagraph" style="margin-top: 6.5pt; text-indent: -18.05pt; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The brick kiln has adopted induced draft<span style="letter-spacing: -.4pt;"> </span>technology.</span></p>

<p class="MsoBodyText" style="margin: 4.3pt 6.25pt 0.0001pt 0cm; text-indent: 71.95pt; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">From above, it is clear that the brick kiln is complying with the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974.</span></p>

<p class="MsoBodyText" style="margin: 0cm 5.85pt 0.0001pt 0cm; text-indent: 71.95pt; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">In view of above, may if approved, varied consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 and fresh consent to operate under the under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30.09.2029 for manufacturing of bricks & tiles @ 30,000 numbers/day, being culmination period for such units subject to the suitable conditions and additional conditions as<span style="letter-spacing: -.15pt;"> </span>under:</span></p>

<p class="MsoBodyText" style="text-indent: 0cm; line-height: 12.75pt; text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">S.O. 763 (E) dated 14.09.1999 as amended from time to time.</span></p>

<p class="MsoListParagraph" style="margin-right: 6.35pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry shall not use any illegal fuel at any stage of firing of the brick kiln.</span></p>
<p class="MsoListParagraph" style="margin-right: 6pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry shall operate the brick kiln on induced draft technology with Zig- Zag brick setting and shall not operate it on natural draft in any<span style="letter-spacing: -1.05pt;"> </span>case.</span></p>
<p class="MsoListParagraph" style="margin-right: 6.2pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The brick kiln will obtain Environmental Clearance under the EIA notification dated 14.09.2006 for the mining of brick clay/earth to be used as raw<span style="letter-spacing: -1.8pt;"> </span>material for manufacturing of<span style="letter-spacing: -.4pt;"> </span>bricks </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">as amended from time to time.</span></p>
<p class="MsoListParagraph" style="text-indent: -18.05pt; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The brick kiln shall not use any DG set in its premises without<span style="letter-spacing: -1.05pt;"> </span>canopy.</span></p>
<p class="MsoListParagraph" style="margin: 6.35pt 6.4pt 0.0001pt 46pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The brick kiln shall obtain permission for abstraction of ground water from CGWA, if<span style="letter-spacing: -.25pt;"> </span>required.</span></p>
<p class="MsoListParagraph" style="margin-right: 6.2pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US" style="letter-spacing: -.05pt;"><span style="mso-list: Ignore;">9.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The consents granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked, if found violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act,<span style="letter-spacing: -.15pt;"> </span>1981.</span></p> |
