<p class="MsoHeader" style="text-align: justify; line-height: 150%; tab-stops: .5in;"><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Arial','sans-serif';"> </span><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Bookman Old Style','serif';"> </span><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Whereas, it is obligatory on the part of each and every industry to obtain the consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. </span></p>
<p class="MsoHeader" style="text-align: justify; line-height: 150%; tab-stops: .5in;"><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Whereas, it is obligatory on the part of each and every industry to obtain the consent to operate of the Board u/s 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 to operate an industrial unit.</span></p>
<p class="MsoHeader" style="text-align: justify; line-height: 150%; tab-stops: .5in;"><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Whereas, it is also obligatory on the part of each industry to install adequate Air Pollution Control Devices and effluent treatment plant so that the conc. of pollutants discharged by the industry does not exceed the permissible limits laid down by the Board.</span></p>
<p class="MsoHeader" style="text-align: justify; line-height: 150%; tab-stops: .5in;"><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Whereas, the poultry farm has granted the consent to operate of the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 which are valid upto 31/12/2022 with certain conditions as mentioned therein. </span></p>
<p class="MsoHeader" style="text-align: justify; line-height: 150%; tab-stops: .5in;"><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Whereas, t</span><span lang="EN-IN" style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-IN;">he poultry farm has applied for obtaining renewal of the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through online. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span lang="EN-IN" style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Whereas, being a complaint matter the poultry farm was visited by the Officer of this office on 02/01/2023 to verify compliance of the guidelines framed for poultry farms and observed that t</span><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">he poultry farm was in operation during visit. The poultry farm has its 04 nos. sheds (pertaining A, B, C & D). During visit it observed that poultry birds were not present in the sheds and the representative Sh. Bua Singh informed that the last lot of poultry birds have completed few days ago therefore, no poultry birds are present in sheds. It observed that the poultry birds droppings of the poultry birds were collected in the same sheds and representative informed that they shift droppings directly from the sheds to the farmers and same are not being collected/stored in the storage pit. It was observed that the sealing of all sheds i.e. A, B, C & D were broken and poultry birds droppings was collected in the same manner in all sheds. It means that the poultry farm is operating its all sheds i.e. A, B, C & D. The poultry farm has constructed cemented underground pit for collection of birds dropping, but one wall of the pit was broken and no birds dropping found stored/collected in the pit. The poultry farm has also provided deep burial pit for disposal dead birds. The poultry farm has planted green belt around each shed as per guidelines. The poultry farm has not provided Environment Data Board at its entrance.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;"> As above, the poultry farm is operating its all sheds i.e. A, B, C & D and hence is operating against the orders dated 08/11/2021 passed by the Worthy Appellate Authority-Cum-Principal Secretary, Department of Science & Technology, Chandigarh. Also violating the guidelines framed for poultry farms as well as conditions of the consent granted earlier under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974.</span></p>
<p class="MsoHeader" style="text-align: justify; line-height: 150%; tab-stops: .5in;"><span style="font-size: 9.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> Whereas, it has now been proposed to refuse the consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 for the above said reasons after affording an opportunity of personal hearing.</span></p>
<p><span lang="EN-IN" style="font-size: 9.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: AR-SA;"> As such, you are hereby given an opportunity of personal hearing before the <strong><u>Environmental Engineer, Regional Office on 12/01/2023 at 11:00 AM in his office, Plot No. 66, Focal Point, Near-Little Paragon Modern School, Aliwal Road, Batala, District-Gurdaspur</u></strong> as to why the action should not be taken, failing which it will be presumed that the poultry farm has nothing to say and Board shall go ahead to take further action without giving any further notice/opportunity.</span><span lang="EN-IN" style="font-size: 9.0pt; mso-bidi-font-size: 10.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: AR-SA;"> </span></p> |
