<p style="text-align: justify;"><span lang="EN-US">Subject: Proceeding of the personal hearing given on 03.01.2023 by the Chairman of the Board to M/s Punjab Chemicals & Crop Protection Ltd. (Pharma Division), Villages Kolimajra & Samalhari, Lalru, Tehsil Dera Bassi, Distt. SAS Nagar for refusal of renewal consent to operate granted under the Air Act, 1981</span></p>
<p style="text-align: justify;">The following were present:</p>

<p style="text-align: justify;"> </p>
<p style="text-align: justify;"> The officers of the Board brought out that the industry was earlier granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2022/17813715 dated 12/4/2022, valid upto 31/12/2022 for manufacturing of 25 no. API/ Intermediate products and 5 no. of bye-products, subject to certain condition as mentioned therein.</p>
<p style="text-align: justify;"> The industry has submitted air auditing report carried out by TIET, Patiala. As per report, TIET has concluded that:</p>
<p style="text-align: justify;">"In the present study PM10, PM2.5 and NOx in ambient air are within the permissible limits for both locations. Level of SPM for boiler stack was also within limit. Unit has provided heat exchanges to control fugitive emissions from plant and it was found that there is no odour emitting from the plants. Through detailed air audit, it was found that company has taken all the measures to control pollutants in air. Company has provided extra heat exchangers to control the fugitive emissions."</p>
<p style="text-align: justify;"> </p>
<p style="text-align: justify;"> TIET has also given suggestions, which is as under:</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->§ <!--[endif]-->Company can enhance the recovery of solvents by providing additional condensers wherever needed to enhance the recovery of the solvents.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->§ <!--[endif]-->To minimize the use of drums for storage of raw material. </p>
<p style="text-align: justify;"> The industry has now applied for renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 along with requisite document. But the industry has not complied with the observations made by the TIET, Patiala while carrying out the audit w.r.t air pollution and its control measures. The TIET has pointed as under:</p>
<p style="text-align: justify;">1) The industry has not provided additional condenser, wherever, needed to enhance the recovery of the solvent.</p>
<p style="text-align: justify;">2) To minimize the use of drums to storage of raw material.</p>
<p style="text-align: justify;"> The persistent complaints w.r.t smell on the Jharmal choe being received from the local residents. This industry is located on the bank of the Jharmal choe. The industry from the past years was not carried any suitable measures to curb the air pollution (odour covered under the purview of air pollution). The industry even has not complied with the suggestions given by TIET, Patiala while carrying out the audit w.r.t air pollution till date.</p>
<p style="text-align: justify;"> The industry does not comply with the provision of the Air (Prevention & Control of Pollution) Act, 1981 as well as not comply with the conditions imposed in the consent to operate granted to it, willfully causing air pollution in the vicinity, thus, violating the provisions of the Air (Prevention & Control of Pollution) Act, 1981 intentionally and deliberately. It was proposed to refuse the renewal of consent to operate applied by the industry under the Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause/ personal hearing.</p>
<p style="text-align: justify;"> Therefore, the industry was served show cause notice for refusal of renewal of consent to operate granted under the Air Act, 1981 vide Board's letter no. 7676-77 dated 21/12/2022 before the Chairman of the Board on 3/1/2023.</p>
<p style="text-align: justify;"> The representatives of the industry who attended the hearing submitted that</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->(i) <!--[endif]-->They have provided additional condenser at the SRP Unit. VOC online analyser has also been installed at the SRP unit and its data is also uploading on Glens server.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->(ii) <!--[endif]-->They are removing the storage from the drum and turning the raw materials that are utilized most frequently into tanks. Recently they have increased the tank storage capacity of toluene and methanol in order to avoid its excess storage into drums.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->(iii) <!--[endif]-->They have covered their effluent storage tank with complete new tarpaulin and additionally, they have also installed one scrubber of alkaline hypo chloride dosing to collection tank and also provided another chemical scrubber to equalization tank followed by chlorination system.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->(iv) <!--[endif]-->They have taken adequate measures so that there is no odour from their factory processing and they also assure that there won’t be any odour/smell problem in their surrounding because of their operation/process.</p>
<p style="text-align: justify;"> After hearing the officers of the Board and the representatives of the industry, the Chairman of the Board decided as under:</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->The industry shall carry out the plantation emitting fragrance in consultation with Horticulturist all along the boundary wall of the unit so as to create a mask towards the road side, within a period of one month. </p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->The industry shall also install mist spray system in all corners of unit so as to mitigate the odour problem.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->The industry shall upgrade its air pollution control device as per the suggestions made by the TIET in its air audit report.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->4. <!--[endif]-->The industry will store the solvent in a scientific manner in a closed building so as to ensure that there is smell/odour problem in the vicinity.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->5. <!--[endif]-->The industry shall dismantle the old ETP civil structure immediately.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->6. <!--[endif]-->The industry be granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 upto 31.8.2023.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->7. <!--[endif]-->The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry after one month to verify the statement of the industry and the compliance of the hearing decisions made by the industry and send his report/recommendations accordingly.</p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; line-height: 150%;"> If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.</p> |
