It will be made operational alongwith the hospital after obtaining CTO from<span style="letter-spacing: 0.05pt;">&nbsp;</span>the<span style="letter-spacing: -0.1pt;">&nbsp;</span>Board<span style="letter-spacing: 0.05pt;">&nbsp;</span>under<span style="letter-spacing: -0.15pt;">&nbsp;</span>the<span style="letter-spacing: -0.05pt;">&nbsp;</span>Water Act, 1974<span style="letter-spacing: -0.05pt;">&nbsp;</span>and<span style="letter-spacing: -0.1pt;">&nbsp;</span>the<span style="letter-spacing: -0.05pt;">&nbsp;</span>Air<span style="letter-spacing: -0.1pt;">&nbsp;</span>Act, 1981.</span></p> <p class="MsoListParagraph" style="line-height: 24px; margin: 5.9pt 55.7pt 0.0001pt 32pt;"><span lang="EN-US" style="letter-spacing: -0.05pt;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span lang="EN-US">The hospital has proposed to<span style="letter-spacing: 3.4pt;">&nbsp;</span>re-circulate/reuse treated waste water @163 KLD in its<span style="letter-spacing: 0.05pt;">&nbsp;</span>flushing system and HVAC system and 24 KLD onto land for plantation. The hospital has<span style="letter-spacing: 0.05pt;">&nbsp;</span>already provided dual plumbing system. The hospital has also developed plantation/green<span style="letter-spacing: 0.05pt;">&nbsp;</span>area<span style="letter-spacing: -0.1pt;">&nbsp;</span>in an<span style="letter-spacing: -0.05pt;">&nbsp;</span>area<span style="letter-spacing: -0.05pt;">&nbsp;</span>of 9 acres approx.<span style="letter-spacing: 0.05pt;">&nbsp;</span>for<span style="letter-spacing: -0.15pt;">&nbsp;</span>the<span style="letter-spacing: -0.1pt;">&nbsp;</span>same.</span></p> <p class="MsoListParagraph" style="margin-right: 55.75pt; line-height: 24px;"><span lang="EN-US" style="letter-spacing: -0.05pt;">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span lang="EN-US">The hospital has installed 9 no. D.G. sets of capacity (2 x 1010 KVA, 3 x 2000 KVA, 2 x 1000<span style="letter-spacing: -3.3pt;">&nbsp;</span>KVA, 1 x 240 KVA, 1 x 25 KVA) equipped with canopies and stack of adequate height. The<span style="letter-spacing: 0.05pt;">&nbsp;</span>representative informed the D.G. set not been serviced once till now. He was advised to<span style="letter-spacing: 0.05pt;">&nbsp;</span>apply for<span style="letter-spacing: -0.2pt;">&nbsp;</span>obtaining<span style="letter-spacing: 0.1pt;">&nbsp;</span>authorization<span style="letter-spacing: -0.05pt;">&nbsp;</span>under<span style="letter-spacing: -0.05pt;">&nbsp;</span>HWM<span style="letter-spacing: -0.05pt;">&nbsp;</span>Rules, 2016<span style="letter-spacing: -0.1pt;">&nbsp;</span>under<span style="letter-spacing: -0.1pt;">&nbsp;</span>cat.<span style="letter-spacing: -0.1pt;">&nbsp;</span>5.1.</span></p> <p class="MsoListParagraph" style="margin-right: 55.65pt; line-height: 24px;"><span lang="EN-US" style="letter-spacing: -0.05pt;">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span lang="EN-US">During visit, the hospital was found segregating Bio-Medical Waste category wise as per the<span style="letter-spacing: 0.05pt;">&nbsp;</span>provisions of Bio Medical Waste Management Rules, 2016 in its OPD section. The hospital<span style="letter-spacing: 0.05pt;">&nbsp;</span>has made agreement with common Bio-medical waste facility for disposal of its Bio-medical<span style="letter-spacing: 0.05pt;">&nbsp;</span>waste<span style="letter-spacing: -0.05pt;">&nbsp;</span>which<span style="letter-spacing: -0.05pt;">&nbsp;</span>is<span style="letter-spacing: 0.05pt;">&nbsp;</span>valid<span style="letter-spacing: -0.15pt;">&nbsp;</span>upto<span style="letter-spacing: -0.05pt;">&nbsp;</span>31/03/2024.</span></p> <p class="MsoBodyText" style="text-indent: 3.45pt; line-height: 23.68px; margin: 6pt 55.7pt 0.0001pt 32pt;"><span lang="EN-US">The hospital has also applied for obtaining authorization under Bio-medical Waste Rules,<span style="letter-spacing: 0.05pt;">&nbsp;</span>2016<span style="letter-spacing: -0.1pt;">&nbsp;</span>which<span style="letter-spacing: -0.05pt;">&nbsp;</span>is<span style="letter-spacing: 0.05pt;">&nbsp;</span>being<span style="letter-spacing: -0.1pt;">&nbsp;</span>processed<span style="letter-spacing: 0.05pt;">&nbsp;</span>separately.</span></p> <p class="MsoBodyText" style="text-indent: 53.95pt; line-height: 24px; margin: 6.15pt 55.95pt 0.0001pt 32pt;"><span lang="EN-US">It is worth to mention here that no specific/general sitting guidelines have been<span style="letter-spacing: 0.05pt;">&nbsp;</span>prescribed<span style="letter-spacing: 0.05pt;">&nbsp;</span>by<span style="letter-spacing: 0.05pt;">&nbsp;</span>the<span style="letter-spacing: 0.05pt;">&nbsp;</span>Board<span style="letter-spacing: 0.05pt;">&nbsp;</span>for<span style="letter-spacing: 0.05pt;">&nbsp;</span>establishment<span style="letter-spacing: 0.05pt;">&nbsp;</span>of<span style="letter-spacing: 0.05pt;">&nbsp;</span>Hospitals.<span style="letter-spacing: 0.05pt;">&nbsp;</span>Thus,<span style="letter-spacing: 0.05pt;">&nbsp;</span>the<span style="letter-spacing: 0.05pt;">&nbsp;</span>site<span style="letter-spacing: 0.05pt;">&nbsp;</span>is<span style="letter-spacing: 0.05pt;">&nbsp;</span>suitable<span style="letter-spacing: 0.05pt;">&nbsp;</span>for<span style="letter-spacing: -3.35pt;">&nbsp;</span>establishment of<span style="letter-spacing: -0.15pt;">&nbsp;</span>PGIMER<span style="letter-spacing: -0.1pt;">&nbsp;</span>as<span style="letter-spacing: -0.05pt;">&nbsp;</span>per Board's<span style="letter-spacing: -0.15pt;">&nbsp;</span>policy<span style="letter-spacing: -0.15pt;">&nbsp;</span>under<span style="letter-spacing: -0.05pt;">&nbsp;</span>prevalence.</span></p> <p class="MsoBodyText" style="margin-right: 55.9pt; text-indent: 71.95pt; line-height: 18.4px;"><span lang="EN-US">Further, the hospital is complying with the provisions of the Water Act, 1974 and<span style="letter-spacing: 0.05pt;">&nbsp;</span>the<span style="letter-spacing: -0.1pt;">&nbsp;</span>Air Act, 1981<span style="letter-spacing: -0.15pt;">&nbsp;</span>as well<span style="letter-spacing: -0.1pt;">&nbsp;</span>as<span style="letter-spacing: -0.05pt;">&nbsp;</span>Bio-medical Waste,<span style="letter-spacing: 0.05pt;">&nbsp;</span>Rules 2016.</span></p> </div> <p style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;"><span lang="EN-US" style="font-size: 11pt; line-height: 16.8667px; font-family: Tahoma, 'sans-serif';">&nbsp;</span></p> <p class="MsoBodyText" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: 71.95pt; line-height: 18.4px; margin: 3.9pt 55.65pt 0.0001pt 14pt;"><span lang="EN-US">Accordingly, it was recommended to CEE (PBIP)that fresh consent to operate under Water<span style="letter-spacing: 0.05pt;">&nbsp;</span>(Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act,<span style="letter-spacing: -3.3pt;">&nbsp;</span>1981 may be granted to the hospital upto 30/06/2023 with suitable conditions as per policy of<span style="letter-spacing: 0.05pt;">&nbsp;</span>the Board and with a special condition that the hospital shall get the monitoring of its STP and<span style="letter-spacing: 0.05pt;">&nbsp;</span>ETP carried out from the Board's lab within 3 months and thereafter submit the analysis report<span style="letter-spacing: 0.05pt;">&nbsp;</span>to<span style="letter-spacing: -0.05pt;">&nbsp;</span>the<span style="letter-spacing: -0.05pt;">&nbsp;</span>Board<span style="letter-spacing: 0.05pt;">&nbsp;</span>within<span style="letter-spacing: -0.05pt;">&nbsp;</span>7<span style="letter-spacing: -0.15pt;">&nbsp;</span>days.</span></p> <p class="MsoBodyText" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: 71.95pt; line-height: 18.4px; margin: 3.9pt 55.65pt 0.0001pt 14pt;"><span lang="EN-US">However, a clarification was raised to the hospital by the PBIP with regard to difference in built-up area of the hospital and same is reproduced as under: "As per the application form,total land area of the project is 30 acres and total built up area is 65000 sqm. However, as per EC dated 26.11.2015 granted by SEIAA, Punjab, total land area of the project is around 25.1 acres and total built up area is 46,168 sqm. Further, as per the approved layout plan uploaded by the pp, total land area is 25 acres and total built up area is 54332 sqm. As such, the institute is required to clarify regarding the actual area and built up area of the project." But, the hospital has failed to give the reply of the clarification in stipulated time period given to it. Accordingly, the online applications of the hospital were sent to this Office with the remarks as under: RO, Sangrur to verify at their level if the project proponent has already carried out construction in total area &amp; having built-up area, more than as specified in the Environment Clearance granted to the project proponent by the SEIAA, Punjab dated 26.11.2015 and/ or as specified in the approved layout plan uploaded by the project proponent. If so, the RO, Sangrur shall process the case of the project proponent for violation to the respective Zonal Office of the Board, before processing the application to be resubmitted by the project proponent, if any However, meanwhile the hospital had submitted the reply of the clarification w.r.t. built-up area of the hospital and same is as under:- CONSTRUCTION OF PGIMER CHANDIGARH SATELLITE CENTRE AT SANGRUR, PUNJAB S. In this regard, the hospital clarified that the increased area is due to the structures constructed by the hospital for the start of the OPD and basic health care' facilities in the first phase. The reply given by the hospital is not satisfactory and as per the policy of the Board, the built-up area more than the area for which EC had been granted to the hospital cannot be permitted. Accordingly, it was decided by the PBIP to return the applications to the hospital due to above said reasons and process the case separately for violations of the conditions of EC by the hospital granted to it. The application of the hospital has been returned online due to above said reasons.</span></p> <p class="MsoBodyText" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: 71.95pt; line-height: 18.4px; margin: 3.9pt 55.65pt 0.0001pt 14pt;"><span lang="EN-US">From above, it is evident that the hospital has neither obtained consent to establish / NOC nor consent to operate under the provisions of the Water Act, 1974 and the Air Act, 1981. Thus, the hospital is violating the provisions of the Water Act, 1974 and the Air Act, 1981 and also violating the conditions of Environmental clearance granted to it.</span></p> <p class="MsoBodyText" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: 71.95pt; line-height: 18.4px; margin: 3.9pt 55.65pt 0.0001pt 14pt;"><span lang="EN-US">Accordingly, Show cause notice for violations of the provisions of the Water Act, 1974 and Air&nbsp;&nbsp;Act, 1981 have been issued to the PGI vide no. 2990 dated 20/10/2022 with an opportunity of personal hearing before the Worthy Chairman of the Board on 03/11/2022 at 11.00 am.</span></p> <p class="MsoBodyText" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: 71.95pt; line-height: 18.4px; margin: 3.9pt 55.65pt 0.0001pt 14pt;"><span lang="EN-US">The representatives of the hospital attended the hearing and stated that the Govt. of India directed that before full commissioning of the Satellite Centre of PGIMER, Chandigarh at Sangrur, a start-up OPD facility will be started by the institute and accordingly institute under Phase-I had constructed the temporary OPD, guest house and boundary wall in the year 2016. Thereafter, the work of construction of main hospital, OPD block, visitor hostel and residential units type III, IV &amp; V and Director's Bungalow was got constructed and presently the buildings are substantially completed and services work is going on in the hospital block. The total constructed area of above building is 46,488.14 sqm (excluding the area of temporary OPD &amp; guest house of Phase-I). They also informed that PGIMER, Sangrur was granted Environmental Clearance vide letter no. SEIAA/2015/7482 dated 26/11/2015 mentioned the total land area of the project 1,01,766.72 sqm and the total built up area as 46,168 sqm. Whereas, the total land area remains the same, however the total built up area is 46.488.14 sqm (excluding the area of temporary OPD &amp; Guest house of Phase-I) against 46.168.14 sqm. They also submitted that the Satellite Centre of PGIMER at Sangrur is being created for the benefit and welfare of the people of Punjab to minimize their plan of coming to Chandigarh for their medical treatment.</span></p> <p class="MsoBodyText" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: 71.95pt; line-height: 18.4px; margin: 3.9pt 55.65pt 0.0001pt 14pt;"><span lang="EN-US">The proceedings of the personal hearing held before the Worthy Chairman of the Board on 03/11/2022 has been conveyed to the PGI as well as Regional Office vide letter no. 3163-64&nbsp;&nbsp;dated 22/11/2022 for ensuring compliance.</span></p> <p class="MsoBodyText" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: 71.95pt; line-height: 18.4px; margin: 3.9pt 55.65pt 0.0001pt 14pt;"><span lang="EN-US">Now, the PGIMER has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents.</span></p> <p class="MsoBodyText" style="text-indent: 71.95pt; line-height: 115%; margin: 3.9pt 55.65pt .0001pt 14.0pt;"><span lang="EN-US" style="font-size: 13.5pt; line-height: 115%; font-family: 'Verdana','sans-serif'; color: #5d5d5d; background: white;">In compliance to the proceedings of the personal hearing given before the worthy Chairman of the Board before deciding the applications for consent to operate, the Senior Law Officer of the Board has given legal opinion in view of recent judgment of Hon'ble Supreme Court in such cases vide letter no. 75 dated 03/01/2023. The legal opinion given by SLO is reproduced as under:-</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 58.5pt; line-height: 140%; margin: 0in 25.0pt 6.0pt .25in;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">''I have examined the case, the PGIMER Satellite Centre, Village Ghabdan, Tehsil and District Sangrur was granted Environmental Clearance under EIA notification dated 14.9.2006 for PGI Satellite Centre, in the revenue Estate of Village Ghabdan, Tehsil and District Sangrur vide no. SEIAA./2015/7482 dated 26.11.2015 for the total land area of the project 1,01,766.72 sqm and the total built up area 46,168 sqm, with certain conditions mentioned therein and specific condition that the consent to establish shall be obtained from the Punjab Pollution Control Board under Water (Prevention and Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the MoEF&amp;CC/SEIAA before the start of any construction work at site. But, the Centre neither obtained consent to establish nor consent to operate from the Board under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 140%; margin: 0in 25.0pt 6.0pt .25in;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">2) <span style="mso-tab-count: 1;"> </span><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The PGIMER Satellite Centre has applied for consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The centre has submitted change of land use issued vide DTP letter no. 13157 dated 16.9.2013 and<span style="mso-spacerun: yes;">&nbsp; </span>building plan approved by Chief Town Planner, Punjab vide letter no. 4325/CTP(PB)/SS-83 dated 1.9.2016. </span><span style="mso-spacerun: yes;">&nbsp;</span>Upon examination of the entire matter including the reply given by the PGIMER Satellite Centre, Sangrur, following observations are made:</span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">a)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The SEIAA, Punjab has granted Environmental Clearance dated 26.11.2015, for total land area of the project <strong>@ 101766.72 sqm</strong>. for the total built up area <strong>@ 46168 sqm.</strong> with certain conditions as mentioned therein. </span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">b)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The building plan approved by the Chief Town Planner, Punjab disclosed the built up area <strong>@ 54332.01 sqm</strong>. </span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">c)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The difference between the built up area as allowed by State Level Environment Impact Assessment Authority, Punjab <strong>(46168 sqm)</strong> and the building plan as approved by the Chief Town Planner, Punjab (<strong>54332.01 sqm)</strong> is calculated to be <strong>(54332.01 &ndash; 46168) = 8164.01 sqm</strong>. </span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">d)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The explanation given by the project proponent is as under:</span></p> <p class="MsoListParagraph" style="line-height: 140%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo2; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">i)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The Government of India directed that the before full commissioning of PGIMER Satellite Centre, Chandigarh at Sangrur, a start up OPD facility will be started by the institute.</span></p> <p class="MsoListParagraph" style="line-height: 140%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo2; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">ii)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">Accordingly, the institute under phase-1 had constructed the temporary OPD, guest house and boundary wall in the year 2016. </span></p> <p class="MsoListParagraph" style="line-height: 140%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo2; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">iii)<span style="font: 7.0pt 'Times New Roman';">&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">Thereafter, work of construction of main hospital, OPD block, visitor hostel, residential units type-III, IV and V and Director&rsquo;s Bunglow was got constructed. </span></p> <p class="MsoListParagraph" style="line-height: 140%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo2; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">iv)<span style="font: 7.0pt 'Times New Roman';">&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">Presently the buildings are substantially completed and service work is going on in the hospital. </span></p> <p class="MsoListParagraph" style="line-height: 140%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo2; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">v)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The total constructed area of above building is <strong>46,488.14 sqm</strong> (excluding the area of temporary OPD and guest house of phase-1)<span style="mso-spacerun: yes;">&nbsp;&nbsp; </span></span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">e)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The difference in the built up area as approved in the EC (46,168 sqm.) and actual construction made by the institute (46,488.14 sqm) excluding the temporary construction of phase-1 is calculated to be (<strong>46,488.14 &ndash; 46168) 320.14 sqm</strong>. </span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">f)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">Actual difference in built up area if calculated as per the approval of the building plan given by Chief Town Planner and approval given in the EC is works out to be (<strong>54332.01 - 46,168) 8164.01 sqm</strong></span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">g)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The temporary structure of OPD, guest house and boundary wall constructed by the institute in the year 2016, thus calculated to be <strong>(8164.01-320.14) 7843.87 sqm.</strong><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></p> <p class="MsoListParagraph" style="text-indent: -31.5pt; line-height: 140%; mso-pagination: widow-orphan; mso-list: l1 level1 lfo1; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">h)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The total land area of the institute is 1,01,766.72 sqm and there is no confusion in this regard.<span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoNormal" style="text-align: justify; line-height: 140%; margin: 0in 25.0pt 6.0pt .25in;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">4)<span style="mso-spacerun: yes;">&nbsp; </span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>From the above observations, it is clear that the PGIMER Satellite Centre, Sangrur has obtained environmental clearance for built up area of 46,168 sqm in total land area of 1,01,766.72 sqm. Clear inference can be drawn from the reply of the institute that the temporary OPD, guest house which was constructed in the year 2016, will not be used by the institute after the construction of main hospital and OPD block. The difference between the actual permanent construction @46488.14 sqm (excluding the temporary construction of OPD and guest house) and approval for built up area given in the EC @ 46168 sqm, works out to be 320.14 sqm. In view of the observations and explanation, the PGIMER Satellite Centre is required to obtain revised EC for total built up area @ 46488.14 sqm. (actual 320.14 sqm), if the institute does not want to use the temporary structure of OPD and guest house and for 54332.01 sqm. (actual 8164.01 sqm), if the institute wants to put into use permanent construction as well as temporary construction. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 140%; margin: 0in 25.0pt 6.0pt .25in;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">5)<span style="mso-spacerun: yes;">&nbsp; </span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><span style="mso-spacerun: yes;">&nbsp;&nbsp;</span>The case has also been examined with regard to the grant of ex-post facto approval by the Competent Authority. The Ld National Green Tribunal vide order dated 3.6.2021 passed in O.A No. 287 of 2020 has held that the manufacturing unit which did not have prior Environmental Clearance could not be allowed to operate. The said order dated 3.6.2021 of the Ld. National Green Tribunal was challenged before the Hon&rsquo;ble Supreme Court of India by way of Civil Appeal no. 4795 of 2021. The observations and decisions of the Hon&rsquo;ble Supreme Court of India given vide Judgment dated 25.3.2022 are summarized herein below:</span></p> <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; line-height: 140%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo3; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">i)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The 1986 Act does not prohibit ex post facto Environmental Clearance. Grant of ex post facto EC in accordance with law, in strict compliance with Rules, Regulations, Notifications and/or applicable orders, in appropriate cases, where the projects are in compliance with, or can be made to comply with environment norms, is in our view not impermissible. The Court cannot be oblivious to the economy or the need to protect the livelihood of hundreds of employees and others employed in the project and others dependent on the project, if such projects comply with environmental norms.<span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; line-height: 140%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo3; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">ii)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The question as to whether a unit contributing to economy of the country and providing livelihood to hundreds of people which has been set up pursuant to requisite approvals from the concerned statutory authorities and has applied for ex-post facto EC should be closed down for technical irregularity for want of prior Environmental Clearance pending the issuance of EC, even though it may not cause pollution and / or may be found to comply with the required norms. The answer to the aforesaid question has to be in the negative. </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; line-height: 140%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo3; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">iii)<span style="font: 7.0pt 'Times New Roman';">&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The Hon'ble Supreme Court has decided that ex-post facto clearances and / or approvals cannot be declined with pedantic rigidity, regardless of stopping the operation. </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; line-height: 140%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo3; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">iv)<span style="font: 7.0pt 'Times New Roman';">&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The Court is of the view that the National Green Tribunal has erred in Law in directing that the units cannot be allowed to function till compliance of the statutory mandate. </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; line-height: 140%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo3; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">v)<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">The order of the National Green Tribunal was set aside and the appellants were allowed to operate the units subject to the condition that if the application for EC is rejected on the ground of any contravention on the part of the appellants, it will be open to the respondents to disconnect the supply of electricity. </span></p> <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; line-height: 140%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo3; text-autospace: ideograph-numeric ideograph-other; margin: 0in 25.0pt 6.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;"><span style="mso-list: Ignore;">vi)<span style="font: 7.0pt 'Times New Roman';">&nbsp; </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">Copy of Judgment dated 25.3.2022 of the Hon'ble Supreme Court of India in Civil Appeal no. 4795 of 2021 is attached for perusal. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 140%; margin: 0in 25.0pt 6.0pt .25in;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">6) <span style="mso-tab-count: 1;"> </span><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>It is further stated that the setting up of PGIMER Satellite Centre at Sangrur will immensely benefit the people of the State of Punjab and allowing the operation of the centre (in accordance with environmental norms) will serve the larger interest of the public. The PGIMER Satellite Centre at Sangrur is a development project and will not cause any environmental pollution in the area except the generation of domestic effluent and bio medical waste which can be taken care of in accordance with law. It is not the case that the project proponent has not obtained the Environmental Clearance under the EIA notification dated 14.9.2006, but the case relates to marginal increase in built up area made by the project proponent beyond the permissible built up area as per Environmental Clearance granted vide letter dated 26.11.2015 by SEIAA and the violation in the case may be termed as technical irregularity. The technical irregularity committed by the project proponent is curable with the issuance of suitable corrective directions to the project proponent to obtain revised Environmental Clearance for the increased built up area. However, the stalling or pausing the operation of such a prestigious and high status satellite centre of PGIMER at Sangrur would not be a fruitful and productive exercise in view of the fact that the technical irregularity of the project activity can be cured and corrected with the obtaining of ex post facto Environmental Clearance for the increased built up area. <span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span></p> <p class="MsoNormal" style="text-align: justify; line-height: 140%; margin: 0in 25.0pt 6.0pt .25in;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 140%;">7) <span style="mso-tab-count: 1;"> </span><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>In view of the above facts, I do not find any restriction if consent to establish / consent to operate is granted to the PGIMER Satellite Centre at Sangrur with the condition that the centre will obtain revised Environmental Clearance of the project for the increased built up area @ 320.14 sqm, if temporary construction is not to be put in operation and for the increased area of 8164.01 sqm, if the temporary construction is to be used. Till the centre obtains the revised EC, the Board may opt to seal the constructed area of phase-1 (temporary OPD and guest house) and may also impose Bank Guarantee of a reasonable amount upon project proponent with other suitable conditions not to use the temporary constructed area, but the operation of the acclaimed and high ranking satellite centre of PGIMER at Sangrur may not be stalled in my opinion, for want of revised Environmental Clearance, which is only a technical irregularity.''<span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp; </span></span></p> <p class="MsoBodyText" style="text-indent: 71.95pt; line-height: 115%; margin: 3.9pt 55.65pt .0001pt 14.0pt;"><span lang="EN-US" style="font-size: 13.5pt; line-height: 115%; font-family: 'Verdana','sans-serif'; color: #5d5d5d; background: white;">In the view of above mentioned facts and legal opinion given by the SLO, it is recommended that fresh consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted to the hospital upto 30/06/2023 with suitable conditions as per policy of the Board and with a special conditions as mentioned below:-</span></p> <p class="MsoBodyText" style="text-indent: 71.95pt; line-height: 115%; margin: 3.9pt 55.65pt .0001pt 14.0pt;"><span lang="EN-US" style="font-size: 13.5pt; line-height: 115%; font-family: 'Verdana','sans-serif'; color: #5d5d5d; background: white;">The centre shall get the monitoring of its STP and ETP carried out from the Board's lab within 3 months and thereafter submit the analysis report to the Board within 7 days.</span></p> <p class="MsoBodyText" style="text-indent: 71.95pt; line-height: 115%; margin: 3.9pt 55.65pt .0001pt 14.0pt;"><span lang="EN-US" style="font-size: 13.5pt; line-height: 115%; font-family: 'Verdana','sans-serif'; color: #5d5d5d; background: white;">The centre will obtain revised Environmental Clearance of the project for the increased built up area @ 320.14 sqm, if temporary construction is not to be put in operation and for the increased area of 8164.01 sqm, if the temporary construction is to be used. </span></p>
