The matter was also highlighted in the monthly meeting held at the District level.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry was granted consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2020/11679588 dated 03.02.2020, valid upto 31.12.2021 for manufacturing of Ready Mix Concrete @ 50 MTD for One Plant only, subject to certain conditions mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry was served notice for violations of the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 and requested to apply for consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 within 7-days for its second plant and not to operate its second Batching plant installed without the prior permission of the Board. But the industry neither submitted reply of the notice nor applied for consents of the Board.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The site of the industry was visited by officer of the Board on 23.02.2021 and it was observed as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: Tahoma, 'sans-serif';">1)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has installed two no. RMC / Batching plants. The industry has installed silos for storing fly ash and cement.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: Tahoma, 'sans-serif';">2)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The cement is also stored in temporary shed constructed at site.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: Tahoma, 'sans-serif';">3)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has provided different sections for storage of sand and stone aggregates.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: Tahoma, 'sans-serif';">4)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The industry has provided settling tanks for the effluent/ water generated from washing of containers carrying RMC and after settling the same is used for sprinkling on raw material manually.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: Tahoma, 'sans-serif';">5)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif';">The representative was guided to obtain the permission for its entire plant and machinery.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the industry was issued show cause notice for revocation/ cancellation of consent to operate granted under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 has been served to the industry vide letter no. 4639-40 dated 16.08.2021 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 24.08.2021, due to above mentioned reasons. But neither any representative of the project proponent attended the hearing nor submitted any reply in the matter</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The matter was considered by the Competent Authority of the Board and decided to afford another opportunity before taking the proposed action as mentioned in the show cause notice issued vide Board's letter no. 4639-40 dated 16.08.2021. The project proponent is also requested to submit its written reply atleast two days before the hearing i.e. by 12.09.2021 to this office. The reply submitted by the project proponent will be considered during the hearing. Thereafter, another opportunity was given in form of show cause notice for revocation/ cancellation of consent to operate granted under the said Acts issued vide Board's letter no. 5114-15 date 06.09.2021 before the Senior Environmental Engineer (ZP-1) of the Board on 14.09.2021. But again neither any representative of the industry attended the hearing nor submitted any reply in the matter.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry was again visited by the officer of the Board on 27.12.2021 and it was observed that RMC plants are in operational conditions. The industry has not applied for consents to operate under the Water (Prevention &amp;Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the consent to operate granted under the Water (Prevention &amp;Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 were revoked/ cancelled vide Board's letter no. 5441-42 and letter no. 5443-44 dated 23.09.2021 respectively.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">Therefore, the industry was served notice to issue directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 vide Board's letter no. 1211-12 dated 15.02.2022 alongwith an opportunity to submit reply within 15-days. The said notice was got delivered through personal messenger. But the industry has not submitted its reply in the matter. Therefore, another opportunity of hearing was given to the industry u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 before the CEE (P) of the Board on 10.05.2022 (postponed to 21.07.2022).</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry applied consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 and same was processed through OCMMS.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The site of the industry was visiting on 01.06.2022 and it was observed that the above site / RMC units was visited and found that the project proponent is operating its both RMC plants at the above location. The project proponent has adopted certain pollution control measures as advised during the previous visit.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">This application was pending since long time i.e. on 09.05.2022. Hon'ble SSTE will be taken a meeting on 06.07.2022 regarding pending applications of OCMMS. Moreover, opportunity of hearing was given to the industry u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 before the CEE (P) of the Board on 21.07.2022.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">Thereafter, the industry was granted fresh consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2022/18569214 dated 08.07.2022 which was valid upto 31.12.2022 and the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2022/18569117 dated 08.07.2022 which is valid upto 31.12.2022 for the manufacturing of Ready Mix Concrete @ 100 MTD by using Sand, Bajri, Cement and Fly Ash @ 100 MTD as a raw material subject to certain terms and conditions mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">Now, the industry has applied for renewal of consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 for the manufacturing of Ready Mix Concrete @ 100 MTD by using Sand, Bajri, Cement and Fly Ash @ 100 MTD as a raw material which may kindly be perused.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry had deposited Rs. 15900/- vide UTR No. N116221931538253 dated 26.04.2022 under Water (Prevention &amp; Control of Pollution) Act, 1974 and Rs. 14500/- vide UTR No. N116221931542350 dated 26.04.2022 under Air (Prevention &amp; Control of Pollution) Act, 1981. The fee deposited by the industry was adequate upto 28.02.2029 against the total cost of the industry Rs. 45.06 lacs as per latest CA certificate submitted by the industry.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">The industry has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">Further, as per circular no. CEE (HQ)/F.No./957/2016/59 dated 02/02/2016, the case for renewal of NOC/Consent to operate for Orange &amp; Green category industries is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; the Air (Prevention &amp; Control of Pollution) Act, 1981, as such, the industry covers under green category.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif';">In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted 31.12.2023 in light of the permission given by the DTP, SAS Nagar.</span></p> <p>&nbsp;</p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><u><span style="font-family: Tahoma, 'sans-serif';">Competency: Environmental Engineer, Regional Office as per policy of the Board.</span></u></strong></p>
