Subject:         Proceedings of the personal hearing given to M/s Nayyar Motors, Moga Road, Kotkapura, Distt. Faridkot before refusal of consent to operate under the provisions of the Water Act, 1974 and authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016 by the Chief Environmental Engineer (B) on 22.12.2022.   The following were present: From Board's side: Er. Ruby Sidhu, EE, ZO, Bathinda From industry side: Sh. Darshan Kumar Garg, Authorized Representative  It was brought out that the automobile service station was granted consents to operate under the provision of the Water Act, 1974 & Air Act, 1981 on 10.05.2021 (valid upto 30.09.2022) with certain conditions mentioned therein.                  Due to certain violations, the agency was issued notice u/s 33-A of the Water Act, 1974 & u/s 31-A of Air Act, 1981 with an opportunity of personal hearing before Chief Environmental Engineer on 17.11.2022, wherein the representative of the agency submitted that the incompletions pointed out by the Board have been removed and application applied for renewal of 'consents to operate' under the Water Act, 1974; the Air Act, 1981 & authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016.  During hearing, it was decided that the Environmental Engineer, Regional Office, Faridkot shall immediately visit the agency to verify the status of compliance made by it and process the authorization & consent applications submitted by the agency, on merits.                      The agency applied for obtaining consent to operate under the Water Act, 1974 & Air Act, 1981 alongwith the authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.                      The agency was visited by officer of the Board on 09.11.2022 and it was observed that:- 1.     The ETP installed by the agency was not in operation; however same was put in operation upon arrival of the visiting officer. The dosing tank & tube settler of the ETP were lying empty and no chemicals were available for dosing. 2.     The physical condition of the ETP indicates that it has not been operated regularly and the waste water is just passed through the components of the ETP. Also, no sludge was found generated from the ETP, which further establish the fact that the waste water is not being treated in the ETP. 3.     No flow meter provided at the inlet/outlet of the ETP to adjudge the quantity of the effluent generated/treated. 4.     The plantation area developed by the agency is not maintained as lot of wild growth of shrubs & grass has developed in it. 5.     The agency has not submitted any MOU or record regarding lifting of oil contaminated filters and air filter. Also, the room provided for storage of hazardous waste is not provided with any lock & key/door facility and no board has been provided mentioning the danger sign/ category of the hazardous waste stored in the room and also no environment data display board provided at entry gate. In view of above, the agency has been issued notice before refusal of consent to operate under the provisions of Water Act, 1974 and authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016  alongwith an opportunity of personal hearing on 22.12.2022. During hearing, Sh. Darshan Kumar Garg, Representative submitted written reply w.r.t. notice issued to the agency, which has been taken on record. He further stated that the washing/servicing of approx. 2-3 vehicles is done in a week resulting in very less quantum of generation of effluent, which is stored & treated in batch type ETP once in a week. The ETP was operated in the presence of the visiting officer to show its working condition. The chemicals used for dozing purposes were stored in a separate storage room to be used only when the ETP  was to be operated. Flow meter provided at the inlet of the ETP, plantation area has now been properly maintained. Proper room has been provided alongwith lock & key facility for storage of hazardous waste and now danger sign/category of the hazardous waste has also been displayed alongwith the environmental data display board.                      After hearing the representative of the industry and officer of the Board, the Chief Environmental Engineer (B) decided that:- 1.       The agency shall maintain on daily basis the record of readings of water meter installed on fresh water supply line, flow meters installed at the inlet & outlet of ETP, energy meter installed with ETP & chemicals being used for treatment of effluent. 2.       Regional Office shall immediately visit the industry to verify the submissions made by the representative of the agency and thereafter submit report/recommendation in the matter to conclude the consent applications applied under the Water Act, 1974 & Air Act, 1981 alongwith authorization application under HOWM Rules, 2016, within 07 days. 3.       <span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: AR-SA; font-style: normal; mso-bidi-font-style: italic;">During hearing, it has been made clear to the representative of the agency that in case of any violation(s) in future, further action as deemed fit shall be initiated under the provisions of the Water Act, 1974; the Air Act, 1981 and HOWM Rules, 2016 without any further notice/opportunity.                            Submitted for confirmation of proceedings of the hearing dated 22.12.2022 and conveying to the concerned for compliance please.
