From the perusal of the documents submitted by the agency it was found that the agency has failed to submit certificate from the authorities concerned (Department of Town & Country Planning/Local Body) to the effect that the activities of the agency are permissible at the present location in accordance with the Zoning regulations of the Master Plan, Bathinda.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;">The agency was visited by the officer of the Board on 26.10.2022 and observed that the hazardous waste of category 5.1 is stored in the scrap room and no specific area has been provided for the storage of the hazardous waste. Also, the agency has not applied/obtained authorization as required under the HOWM Rules, 2016.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;">In view of above, the agency has been issued show cause notice before refusal of consents to operate under the provisions of Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing on 01.12.2022, wherein the representative of the industry requested for grant of 10 days time for getting requisite site suitability certificate from the authorities concerned (Department of Town & Country Planning / Local Body) and to make compliance under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;">After hearing the representative of the industry and officer of the Board, the Chief Environmental Engineer (B) has decided that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in 6.0pt 27.0pt;"><!-- [if !supportLists]--><span style="mso-bidi-font-size: 13.5pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black; mso-themecolor: text1; mso-bidi-language: PA;"><span style="mso-list: Ignore;">a)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;">The industry shall submit requisite site suitability certificate from the authorities concerned (Department of Town & Country Planning / Local Body) and to make compliance under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016, within 10 days.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in 6.0pt 27.0pt;"><!-- [if !supportLists]--><span style="mso-bidi-font-size: 13.5pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black; mso-themecolor: text1; mso-bidi-language: PA;"><span style="mso-list: Ignore;">b)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;">Regional Office shall visit the industry immediately after 10 days to verify the compliance and thereafter, send afresh report / recommendations for disposal of pending consent applications.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in 6.0pt 27.0pt;"><!-- [if !supportLists]--><span style="mso-bidi-font-size: 13.5pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black; mso-themecolor: text1; mso-bidi-language: PA;"><span style="mso-list: Ignore;">c)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;">The industry shall apply for obtaining authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules 2016 within one week immediately after making compliances under the said Rules, within 10 days as per decision no. (a) above.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in .0001pt 27.0pt;"><!-- [if !supportLists]--><span style="mso-bidi-font-size: 13.5pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black; mso-themecolor: text1; mso-bidi-language: PA;"><span style="mso-list: Ignore;">d)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;">During hearing, representative of the industry was made clear that in case of non-compliance of above decisions within stipulated time, no further opportunity shall be given to the industry and further action as deemed fit would be taken in the matter.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; background: white; margin: 0in 0in .0001pt 9.0pt;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span>Now the Regional Office has reported vide note dated 04.01.2023 that the agency has failed to submit the requisite site suitability certificate from the concerned authorities. The agency has provided separate room for storage of hazardous waste for category 5.1 & 5.2, for which the record is also being maintained, however the agency has failed to apply for obtaining authorization under HOWM Rules, 2016.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span>In view of above, if approved, the application applied by the industry under the Water Act, 1974 & Air Act, 1981 be refused. </span></p> |
