<p class="MsoNormal" style="text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is submitted that earlier the brick kiln was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/RPN/2019/9424770 dated 18/03/2019 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/RPN/2019/9424316 dated 18/03/2019, both were valid upto 30/09/2022 for manufacturing of Bricks & Tiles @ 30,000 Number/Day subject to the suitable conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the brick kiln has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith undertaking regarding code of practice, compliance of previous consent and consent fee.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Further, the unit has submitted the CA certificate, wherein, the value of fixed assets as on 30.11.2022 is Rs. 13.27 lakhs. Now, the unit has deposited Rs. 9,000/- vide R. No. 21441572 dated 15.12.2022 under the Water Act, 1974 and Rs. 9,000/- vide R. No. 512551825 dated 15.12.2022, Rs. 500/- as application form fee under the Air Act, 1981. As such, the fee deposited by the unit is adequate upto 30.09.2027 after deducting 10% penalty under the Water Act, 1974 and the Air Act, 1981 as per circular dated 29.10.2018.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is also informed that the brick kiln was granted NOC vide no. RPN-14 dated 07.06.1999. Further, as per Master Plan, of Rupnagar uploaded on the website of GMADA, Village Sanana does not fall within the limits of master plan and the unit is an existing unit.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is added here the unit has also submitted Rs. 7198/- vide R. No. </span><span style="font-family: 'Bookman Old Style', 'serif';">512551825 dated 15.12.2022</span><span style="font-family: 'Bookman Old Style', 'serif';">, as advance fee w.r.t the stack emission samples and has requested to conduct the sampling through the Board, which shall be conducted shortly<span style="color: red;">.</span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Further, the unit was visited by the AEE of this office on 04.01.2023 and Sh. Kapil Sharma, representative was contacted. During visit, it was observed as under:</span></p>

<p class="MsoListParagraph" style="margin: 6.6pt 0cm 0.0001pt 46pt; text-align: justify; text-indent: -18.05pt; line-height: normal;"><span lang="EN-US" style="font-family: 'Bookman Uralic'; letter-spacing: -0.05pt;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln has provided sampling arrangements &<span style="letter-spacing: -0.65pt;"> </span>platform.</span></p>
<p class="MsoListParagraph" style="margin: 6.45pt 6.05pt 0.0001pt 46pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Uralic'; letter-spacing: -0.05pt;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln has provided adequate plantation around the boundary.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 6.25pt 0.0001pt 46pt; text-align: justify; text-indent: -18pt; line-height: 24.16px;"><span lang="EN-US" style="font-family: 'Bookman Uralic'; letter-spacing: -0.05pt;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln has provided bathroom for labour quarters and has provided the provision of septic tank for the treatment of domestic<span style="letter-spacing: -1.05pt;"> </span>effluent.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 0cm 12pt 46pt; text-align: justify; text-indent: -18.05pt; line-height: 12.6pt;"><span lang="EN-US" style="font-family: 'Bookman Uralic'; letter-spacing: -0.05pt;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln has stabilized the inner movement area with brick<span style="letter-spacing: -1.35pt;"> </span>bats.</span></p>
<p class="MsoBodyText" style="margin: 4.3pt 6.25pt 12pt 0cm; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">From above, it is clear that the brick kiln is complying with the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">In view of above, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be renewed upto 30.09.2027, subject to the suitable conditions and additional conditions as under:</span></p>

<p class="MsoListParagraph" style="margin: 0cm 6.3pt 0.0001pt 49.65pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln shall comply with the zoning regulations of Master Plan, Rupnagar for Village Sanana as and when prepared.</span></p>

S.O. 763 (E) dated 14.09.1999 as amended from time to time.</span></p>

<p class="MsoListParagraph" style="margin: 0cm 6.35pt 0.0001pt 46pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall not use any illegal fuel at any stage of firing of the brick kiln.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 6pt 0.0001pt 46pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall operate the brick kiln on induced draft technology with Zig- Zag brick setting and shall not operate it on natural draft in any<span style="letter-spacing: -1.05pt;"> </span>case.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 6.2pt 0.0001pt 46pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln will obtain Environmental Clearance under the EIA notification dated 14.09.2006 for the mining of brick clay/earth to be used as raw<span style="letter-spacing: -1.8pt;"> </span>material for manufacturing of<span style="letter-spacing: -0.4pt;"> </span>bricks </span><span style="font-family: 'Bookman Old Style', 'serif';">as amended from time to time.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 0cm 0.0001pt 46pt; text-align: justify; text-indent: -18.05pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln shall not use any DG set in its premises without<span style="letter-spacing: -1.05pt;"> </span>canopy.</span></p>
<p class="MsoListParagraph" style="margin: 6.35pt 6.4pt 0.0001pt 46pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The brick kiln shall obtain permission for abstraction of ground water from CGWA, if<span style="letter-spacing: -0.25pt;"> </span>required.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 6.2pt 0.0001pt 46pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif'; letter-spacing: -0.05pt;">10.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The consents granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked, if found violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act,<span style="letter-spacing: -0.15pt;"> </span>1981.</span></p>
