RO/MOH/WPC/2012/V-236 dated 12.12.2012, valid upto 12.06.2013 further extended upto 31.12.2022 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. RO/MOH/APC/2012/V-291 darted 12.12.2012, valid upto 12.06.2013 further extended upto 31.12.2022 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry was surprisingly visited by AEE of this office on 03.11.2022. During the visit, it was observed as under:</span></p>

The industry has increase the capacity without obtaining the prior permission of the Board.</span></p>

However, the same found split on floor and the industry was advised to channelize its scientifically and shall be re-circulated.</span></p>

<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1;">Thereafter, the industry was issue show cause notice alongwith opportunity of personal hearing before the Environmental Engineer of the Board </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">to explain your position as to why further action under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 may not be taken against the project proponent, failing which, it will be presumed that the industry has nothing to say and action under the provisions of the aforesaid act will be taken as per law, without any further notice / opportunity. </span></p>
<p class="MsoBodyText" style="margin-right: .7pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">The industry was given personal hearing before the Environmental Engineer of the Board on 01.12.2022, wherein, it was decided as under:</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the industry has applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the manufacturing of C.R. Pipes @ 24 MTD by using HR coil/CR strips @ 25 MTD as a raw material alongwith requisite documents which may kindly be perused.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry has deposited Rs. 45400/- vide UTR No. KKBKH22362844722 dated 28.12.2022 under Water (Prevention & Control of Pollution) Act, 1974 including Rs. 2900/- as NOC regularization and Rs. 500/- as FDF and Rs. 42000/- vide UTR No. KKBKH22362840367 dated 28.12.2022 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the industry is adequate upto 25.11.2027 after adjusting late fee / penalty i.e. 10 % of one year fee deposited by the industry against the total cost of the industry Rs. 237.05 lacs as per latest CA certificate submitted by the industry.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The industry has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be renewed upto 30.09.2027 subject to suitable terms and conditions as per earlier consents granted by the Board.</span></p>
