<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The South City area was visited by undersigned on 07.11.2020 and it was observed that the South City area is divided into 08 colonies namely M/s S. Sukhdev Nagar (Farm Land, 35.65 acres), M/s S. Sukhdev Nagar Ext-I(3.05 acres), M/s S. Sukhdev Nagar Ext-II(7.54 acres), M/s S. Sukhdev Nagar Ext-III-A(10.52 acres), M/s S. Sukhdev Nagar Ext-III-B(26.44 acres), M/s S. Sukhdev Nagar Ext-IV(4.61 acres), M/s S. Sukhdev Nagar Ext-V(19.71 acres) & M/s S. Sukhdev Nagar Ext-VI(36.66 acres) in the Revenue Estate of Village Ayali Khurd. Total area of South City is 144.18 acres. Separate reports of all 08 colonies were sent to the Competent Authority through E-office and accordingly, the project proponent i.e. M/s Vikas House Building Co. (P) Ltd. was given personal hearing before the Chief Environmental Engineer, Ludhiana in all above said colonies. The Chief Environmental Engineer, Ludhiana decided in all the matters that the project proponent shall apply for ‘Consents to Operate’ under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and to submit approvals obtained by the project proponent from GLADA / Competent Authority. The project proponent failed to apply for ‘Consents to Operate’ under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and accordingly, the project proponent i.e. M/s Vikas House Building Co. (P) Ltd. was given personal hearing before the Hon’ble Chairman of the Board on 20.12.2022 in the above said matter. The proceedings of the same are awaited in this office. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Now, the project proponent has applied for obtaining fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 for entire South City area i.e. 144.18 acres. The detail of the case is as under:</span></p>
<ol style="margin-top: 0in;" start="1" type="1">
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has submitted copy of the ‘Consent to Establish’ (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 granted vide no. 5860 dated 26.03.2001 for development of residential colony named South City i.e. (Main Extension, Extension–I, II, III-A, III-B, IV, V, VI) in an area of 144.18 acres at Village Ayali Khurd, District Ludhiana. However, record file of the South City is not available in the record of this office. At the time of grant of the above said ‘Consent to Establish’ / NOC from pollution angle, the area was under the jurisdiction of Regional Office-II, Ludhiana and accordingly, the matter was taken up with Regional Office-II, Ludhiana, however, the same is also not available in the record of Regional Office-II, Ludhiana. Accordingly, the office of GLADA was attended by undersigned and details / license / approved layout plans were obtained from GLADA office. The details of each colony is attached. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has submitted declaration of the assets of the project as Rs. 141.90 lacs as on 31.12.2021. </span></li>
<li class="MsoNormal" style="text-align: justify; line-height: 150%; mso-list: l0 level1 lfo1;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has deposited Rs. 1,14,200/- vide UTR. No. SBIN222348861266 dated 14.12.2022 & Rs. 8400/- vide UTR. No. SBIN222347235197 dated 13.12.2022 under the Water Act, 1974. </span></li>
</ol>
<p class="MsoNormal" style="text-align: justify; text-indent: 45.0pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 1;"> </span>It is pertinent to mention here that the project proponent has not obtained ‘Consent to Operate’ after its commissioning and had also not obtained any Extension in ‘Consent to Establish’ / NOC granted to it. Thereafter, the Ministry of Environment and Forests had notified Environment Impact Assessment Notification dated 14.09.2006 and this project is covered under this notification as its area is more than 50 Hectares. Moreover, the project proponent has obtained separate license no. for each colony and layout plans of each colony have been separately approved by GLADA. Thus, there is no colony titled as “South City” having an area of 144.18 acres in the records of GLADA i.e. Regulatory Authority for colonies and legal opinion is required before granting ‘Consent to Operate’ under the Water Act, 1974 to single project having an area of 144.18 acres. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 45.0pt; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Total plots in 144.18 acre area are 1510 and estimated population of this area is about 9060 persons. Thus, estimated discharge of this area is about 1223 KLD. The project proponent has installed STP of capacity 400 KLD only and treated / partially treated and remaining untreated water of colony is discharged into sewer line leading to STP Balloke. The project proponent has not provided any mechanism to re-use treated water into parks. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>Keeping the above in view, it is recommended that Show Cause Notice for refusal of the application for obtaining fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 may be issued to the project proponent with an opportunity of personal hearing and legal opinion may be taken from the Senior Law Officer regarding considering the above said 08 colonies as single project and applicability of EIA Notification, 2006 on the above said project. <span style="mso-spacerun: yes;"> </span></span></p>
