<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">Accordingly, the fresh Consent to Operate’ applied under the Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Sweets 210.0 kgs/day, Samosa 300.0 Numbers/Day and Bhaji (Namkeen) 20.0 Kgs/day., was refused on 06.10.2022 vide no. CTOW/Fresh/SAS/2022/19906003 and the application under Air (Prevention & Control of Pollution) Act, 1981 was refused on 22.09.2022 vide no. CTOA/Fresh/SAS/2022/18935732.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">Further, the board has issued following directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 to the industry vide letter no. 7364 dated 02.12.2022 as under:</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">This office vide letter no. 5245 dated 07.12.2022 has also written to PSPCL authorities for disconnection of electricity supply of the industry and share TDCO details failing which the Authority/ person/ Officer responsible to comply with the above direction will be liable for action u/s 41 of Water (Prevention & Control of Pollution) Act, 1974, however the compliance is yet to be made by the PSPCL.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">Meanwhile, the project proponent has again applied fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Sweets 210.0 kgs/day, Samosa 300.0 Numbers/Day and<span style="mso-spacerun: yes;"> </span>Bhaji (Namkeen) 20.0 Kgs/day along with requisite documents.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 12.81 lakh on 04.04.2022. After including rent of 5 years, the value of fixed assets is increased to Rs 42.81 lakhs. The project proponent has deposited Rs. 15,400/- vide UTR no. N126221946261899 dated 06.05.2022 under Water (Prevention & Control of Pollution) Act, 1974. The industry has submitted the consent fee under both the act with the water application, hence on dividing the fees equally under both the acts, the fees under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 are adequate till 31.12.2023 after deduction of late fees and NOC regularization fees.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The project proponent has submitted rent agreement made on 12.01.2022 between Manjit Singh and M/s Shakti Food Products as proof of date of commissioning. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The project proponent has submitted GST certificate as proof of proprietor ship. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">The project proponent has submitted manufacturing process as under:</span></p>

The project proponent has not submitted completion certificate & dimensional drawing of ETP. You are therefore requested to submit the reply of the above said observation within 2 days.</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-hansi-theme-font: major-latin;">In view of above, it is recommended that directions u/s 33-A of the Water Act, 1974 issued to industry may be dropped and the industry may be issued by the ‘consent to operate’ under the Air (Prevention & Control of Pollution) Act, 1981 for a short-term of 6 months till 30.06.2023 subject to special conditions as under:</span></p>
