<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 36.0pt; background: white;"><span style="font-family: 'Arial','sans-serif';">It is submitted that the industry has applied for consent to establish under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 after SAC clearance granted by Govt. of Punjab, Department of Labor vide no. F-SA/15/2022 dated 13.12.2022. The industry has deposited NOC fee which is adequate for one year. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 36.0pt; background: white;"><span style="font-family: 'Arial','sans-serif';">To verify the facts, the site was visited by officer of the Board on 06.01.2023 and observed as under:- </span></p>

<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo1; background: white; margin: 0cm 0cm .0001pt 54.0pt;"><!-- [if !supportLists]--><span style="font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Arial','sans-serif';">The industry has uploaded copy of registry as proof of ownership of land, carrying capacity assessment by Terrasyn Initiative, Patiala, SAC clearance granted by Govt. of Punjab, Department of Labor vide no. FSA/15/2022 dated 13.12.2022, Site Plan Location, plan, Declaration of Authorized signatory, Project and feasibility report, land use certificate. </span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l1 level1 lfo1; background: white; margin: 0cm 0cm .0001pt 54.0pt;"><!-- [if !supportLists]--><span style="font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-family: 'Arial','sans-serif';">No 15 pucca houses exist within the 100 mtr radius of industry and the land use of the site is industrial as per DTP certificate.</span></p>
<p style="margin: 0cm; margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333;">It is further submitted that in compliance to the orders dated 19.02.2019 passed by the Hon’ble National Green Tribunal in OA no. 400 of 2019 and directions issued by the Central Pollution Control Board u/s 5 of Environment (Protection) Act, 1986 vide letter no. B-29016/1 (NGT)/19/WM-III Division dated 30.12.2019 for regulating location of Tyre Pyrolysis industries in light of the carrying capacity of the area, the Punjab Pollution Control Board has decided as under:-</span></p>
<p style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2; background: white; margin: 0cm 0cm .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial; color: #333333;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333;">Henceforth, any new / expansion of existing Tyre Pyrolysis industry be granted consent to establish or amendment in consent to establish only after assessing the carrying capacity of the area. </span></p>
<p style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2; background: white; margin: 0cm 0cm .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial; color: #333333;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333;">To ensure the safeguard of health of the workers involved in the tyre pyrolysis industries, a condition may be imposed while issuing the consent to Establish / Operate to the industrial units to the effect that regular health checkups at an interval not more than 3 months shall be got carried out by the project proponent for his workers / staff. A certificate to the effect that no adverse effect has been observed to the health of workers / staff shall be obtained and submitted by the industry / project proponent to the Board at the time of consent / renewal of consent from the concerned Medical Officer/ Senior Medical Officer of the area.</span></p>
<p style="text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo2; background: white; margin: 0cm 0cm .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial; color: #333333;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333;">Till a proper mechanism is developed w.r.t. 1 and 2, applications received for obtaining consent to establish shall be referred to the Head Office for approval. </span></p>
<p style="margin: 0cm; margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333;">The copy of orders issued by the Board vide no. PPCB/SEE(HQ-2)/2020 92 dated 03.02.2020 in above regard are attached for ready reference.</span></p>
<p style="margin: 0cm; margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333;">In this case, the industry has submitted carrying capacity assessment report prepared by TERRA SYN INITIATIVES, SCF – 29, S.S.T. Nagar, Rajpura Road, Patiala. But, the contents of that report are based on the information and data provided by the industry, and it has been mentioned that TerraSyn Initiatives shall not be responsible for correctness, accuracy and reliability of the same.</span></p>
<p style="margin: 0cm; margin-bottom: .0001pt; text-align: justify; text-indent: 35.45pt; background: white;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333;">As such, the above report submitted by the industry cannot be considered for grant of NOC to industry. </span></p>
