<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in;"><strong style="mso-bidi-font-weight: normal;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">Sub:-<span style="mso-tab-count: 1;"> </span>Application for renewal of the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and<span style="mso-spacerun: yes;"> </span>Air (Prevention & Control of Pollution) Act, 1981 – M/s Bua Singh Poultry Farm, Village-Naushehra, P.O. Pul Tibri, Tehsil & District-Gurdaspur. </span></strong></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">It is intimated that earlier an appeal filed by poultry farm against the orders passed by the Board was pending before the Worthy Appellate Authority-Cum-Principal Secretary, Department of Science & Technology, Chandigarh and same was disposed of vide orders dated 08.11.2021. The relevant extract of the orders passed by the Worthy Appellate Authority are reproduced as under:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 150%; margin: 0in 1.0in .0001pt 1.0in;"><em style="mso-bidi-font-style: normal;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">“I hereby allow the operation of the poultry farm of the appellant comprised in sheds A, B and C at this stage, for less than 10,000/- birds in totality. The Board is directed to restore the electricity connection and remove the seals fastened to restrain the operation of the poultry farm. The appellant is directed to apply for the consents of the Board and the Board is directed to grant consent to operate to the poultry farm under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 subject to the fulfillment of environment norms. The appellant is directed to comply with the environmental guidelines and the Board shall regulate the compliance of guidelines with regard to minimization of odor problem, management of solid waste and waste water discharge. The appellant is directed to ensure that there is no foul smell and no inconvenience is caused to the people of the area. The appellant shall not increase the number of birds and make any expansion of the poultry farm without the prior approval of the Punjab Pollution Control Board.”</span></em></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;"> In light of the orders dated 08/11/2021 issued by the Worthy Appellate Authority-Cum-Principal Secretary, Department of Science & Technology, Chandigarh directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 and 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued vide Zonal Office, Amritsar letter endst. no. 90 dated 18/01/2022 regarding de-sealing of the shed A, B & C of the subject cited poultry farm. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">In light of the orders dated 08/11/2021 issued by the Worthy Appellate Authority-Cum-Principal Secretary, Department of Science & Technology, Chandigarh, consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 were granted to the poultry farm for the operation of shed A, B & C out of shed A, B, C & D for poultry birds 9500 nos. which were valid upto 31-12-2022 with the special conditions that the consent is granted only for the operation of poultry shed A, B & C and for the bird capacity @ 9500 nos.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">Now the poultry farm has applied for obtaining renewal of the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the operation of the poultry farm through online for the bird capacity @ 9500 nos. under Green Category. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm has already deposited Rs. 18150/- vide R/No. 05/4647 dated 30/08/2018, Rs. 18150/- vide R/No. 04/4647 dated 30/08/2018 & Rs. 750/- vide R/No. 03/4647 dated 30/08/2018 as NOC Regularization fee now, Rs.</span><span style="font-family: 'Tahoma','sans-serif';"> </span><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">250/- vide UTR No. 000130290241 dated 19/12/2022 & Rs. 250/- vide UTR No. 000130290509 dated 19/12/2022 under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 fee against gross value of fixed assets of Rs. 9,72,301/- against the value as per CA certificate submitted by the poultry farm and same is adequate for one year period poultry farm and same is valid upto next 19 years.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm was visited by the undersigned on 02/01/2023 and observed as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm was in operation during visit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm has its 04 nos. sheds (pertaining A, B, C & D).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">During visit it observed that poultry birds were not present in the sheds and the representative Sh. Bua Singh informed that the last lot of poultry birds have completed few days ago therefore, no poultry birds are present in sheds. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">It observed that the poultry birds droppings of the poultry birds were collected in the same sheds and representative informed that they shift droppings directly from the sheds to the farmers and same are not being collected/stored in the storage pit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">It was observed that the sealing of all sheds i.e. A, B, C & D were broken and poultry birds droppings was collected in the same manner in all sheds. It means that the poultry farm is operating its all sheds i.e. A, B, C & D. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm has constructed cemented underground pit for collection of birds dropping, but one wall of the pit was broken and no birds dropping found stored/collected in the pit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm has also provided deep burial pit for disposal dead birds. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm has planted green belt around each shed as per guidelines.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">9.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">The poultry farm has not provided Environment Data Board at its entrance.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">As explained above, the poultry farm is operating its all sheds i.e. A, B, C & D and hence is operating against the orders passed by the Worthy Appellate Authority-Cum-Principal Secretary, Department of Science & Technology, Chandigarh. Also violating the guidelines framed for poultry farms. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">As above, SCN for refusal of the consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the poultry farm vide this office letter no. 32 dated 03/01/2023 with an opportunity of personal hearing on dated 12/01/2023 at RO level.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">In reference to the SCN issued, the Sh. Bua Singh, Prop. of farm attended this office on 05/01/2023 and submit reply and intimated that the seals earlier done by the Board on shed no. D were damaged due to rain etc. He further requested to seal shed no. D again. The Poultry farm has also informed that broken wall of underground pit has been repaired. He further ensured to comply with the guidelines and Environmental norms in all aspects. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">In view of the above, it is therefore, recommended as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 may be granted to the poultry farm for one year period (being a complainant case) with suitable conditions along with special condition that the poultry farm shall dispose bird dropping in scientific manner and shall maintain record of it.</span></p>
