The project proponent was granted Consent to Establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2022/20005076 dated 04.10.2022, valid till 19.09.2023 for Restaurant & Cafe Bar (60 chairs capacity) with special conditions as under: 1)      The restaurant will operate the ETP regularly and maintain proper record. 2)      The restaurant will make arrangement for in-situ management of biodegradable solid waste within the premises. 3)      The restaurant shall use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021 4)      The project proponent will not carry out any modification/ expansion in the restaurant without obtaining prior permission of the Board. 5)      The restaurant will get the building plan approved from Competent Person approved under Factories Act, 1948 and submit at the time of obtaining Consent to Operate. Now, the project proponent has applied fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974  and Air (Prevention & Control of Pollution) Act, 1981 for Restaurant & Cafe Bar (60 chairs capacity) along with requisite documents. The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 3.02 crore on 23.10.2022. The project proponent has deposited Rs. 42,000/- vide UTR no. INDBN30127951187 dated 30.12.2022 under Water Act, 1974 and Rs. 42,500/- vide UTR no. INDBN30127951198 dated 30.12.2022 under Air Act, 1981. After deduction NOC regularization fees, the consent fee under Water Act, 1974 is adequate till ------ and the consent fee under Air Act, 1981 is adequate till The project proponent has submitted lease agreement between Maninderjit Singh Sidhu and Burman Hospitality Private Limited. The project proponent has submitted memorandum of association of Burman Hospitality Private Limited. As per the application form, as per which the quantity of water used for domestic purposes for 60.0 persons @ 70.0 Litres/person/day will be approximately 4.2 KL/day. The domestic waste water generated will be 3.3 KL/day. The effluent generated from the kitchen section @ 1.5 KLD will be passed through oil & grease trap and ETP (5 KLD based on SBR technology) and thereafter it will be discharged into sewer line.                On scrutinizing the application of the project proponent following observations were observed on 11.01.2023 with request to submit reply within 2 days. 1.       The project proponent has not submitted approved building plan from competent person under Factory Act, 1948 or NOC from Director of Factories regarding non-requirement for approved building plan. 2.       The project proponent has not submitted completion certificate of ETP along with dimensional drawing. 3.       The project proponent is required to submit proper proof regarding date of commissioning of restaurant so that adequacy of fee can be adjudged. 4.       The project proponent has not submitted manufacturing process. No reply received till date. The project proponent has submitted compliance report of the Consent to Establish under the provisions of Water Act, 1974 and Air Act, 1981 granted to it. The site was visited by the undersigned on 11.01.2023 and contacted Sh. Shatrughan, RGM (9878760744). During visit it was observed as under: 1.              The restaurant was in operation in a show room located in Phase- 3B2, Mohali. The representative informed that the restaurant has started operated w.e.f  10.10.2022. 2.              In basement of the restaurant provision of offices and cold room is there. In ground floor the project proponent has provided kitchen and counter for purchase of fast food items. In first floor, the project proponent has provided sitting arrangement of 40 chairs. The representative informed that they are procuring keg of beer from the beer making companies which is served in the restaurant and empty keg will be taken back by the company and replaced with keg filled with beer. 3.              Electricity and LPG is used as fuel in the kitchen. The restaurant has made provision of channelizing the emission generated from the kitchen and the duct is raised above the roof level. 4.              The project proponent has installed 1 no. DG set of capacity 160 KVA with canopy and adequate stack height. 5.              The restaurant has provided the arrangement for collection of wastewater generated from kitchen in the collection tanks provided at back side of show room from where the wastewater is pumped into the ETP provided at roof level. However, the restaurant has provided a bye pass arrangement in the collection tank as a result of which untreated water is being disposed off into sewer directly. Further, the ETP was not in operation during visit. No water meter has been provided at the outlet of ETP and no energy meter has been provided with the ETP. No record of operation of ETP was maintained. The restaurant has installed RO at the roof level and RO reject is used in flushing. 6.              As per master plan, the site is a commercial zone and restaurants are allowed to be established in this zone. 7.              Sewer has been laid down by MC in the area. 8.              The restaurant is getting cut vegetables packed in Single Use Plastic wrapping, however, no marking of thickness  was there on the plastic wrapping in compliance of Plastic Waste Management Rules, 2016. 9.              The solid waste generated from the restaurant is disposed off to third party. No arrangement for insitu management of wet solid waste was there. In view of above, it is recommended that show cause notice for refusal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Environmental Engineer. *Competency – Environmental Engineer
