The industry is engaged in production of HDPE/PVC pipes by using plastic granules as raw material.      ·         Regular complaints were received against the industry regarding the pollution being caused by it. The industry has been afforded no. of opportunities by way of issuing show cause notices / affording opportunity of personal hearings, but the industry failed to ensure the compliance.     ·         Subsequently, notice u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 was issued to the industry alongwith an opportunity of personal hearing before the CEE (B) on 28.07.2022, wherein it was decided that:- 1.  The industry shall apply for obtaining registration under the plastic waste management Rules, 2016 within a week. 2.       The industry shall operate & maintain its APCD so as to ensure that no air pollution is caused due to its manufacturing activities. 3.       The industry shall apply for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981, within one week.     ·         The industry failed to comply with the decisions of the personal hearing dated 28.07.2022. Therefore, another opportunity of personal hearing was afforded to the industry on 01.12.2022, which was attended by Sh. Vijay Kumar, Director who stated that the industry is not in operation for the last one month. As such, directions u/s 33-A of Water Act, 1974 and u/s 31-A of Air Act, 1981 have been issued to the industry on 15.12.2022 to the effect that the industry shall not re-start its manufacturing activities without obtaining consents to operate under the Water Act, 1974 & Air Act, 1981.     ·         Now the industry has applied for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981 for production of HDPE/PVC pipes @ 300 kg/day by using plastic granules as raw material.     ·         The industry is located in E-50, Old Focal Point, Bathinda. The said plot is in the name Mrs. Usha Rani W/o Sh. Vijay Kumar. The deed of conveyance between PSIEC and Smt. Usha Rani has been executed on 28.03.2003. The said plot is now on lease with the industry i.e. M/s G.M. Plastic through its Director Sh. Vijay Kumar and the lease deed has been executed on 02.11.2021 upto 30.11.2026 for Rs. 30,000/annnum.      ·         The site was visited by the Regional Office on 03.01.2023 and it has been reported that the industry was in operation, wet scrubber installed as APCD was also in operation. No usage of plastic waste envelopes to make gitty was observed during the visit. No source of generation of trade effluent and domestic effluent is discharged into PSIEC sewer. In view of above, if approved, consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981 be granted to the industry with validity upto 30.09.2027 as per the adequacy of consent fees, subject to the following specific conditions:- 1.       <span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; background: white;">The industry will ensure not to use plastic carry bags in any form to manufacture its product and will ensure compliance of the notification issued by the Department of Local Govt., Punjab dated 18.02.2016, wherein manufacturing, stocking, distribution, re-cycling, selling and use of plastic carry bags is completely prohibited in the State of Punjab. 2.       <span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; background: white;">The industry shall regularly operate & maintain its air pollution control device so as to ensure that no air pollution is caused due to its manufacturing activities.          3.       The industry will not generate any trade effluent without obtaining prior permission of the Board.       4.       The industry shall obtain the registration under the Plastic Waste Management Rules, 2016, within one week. <ol style="margin-top: 0in;" start="5" type="1"> <li class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; mso-list: l2 level1 lfo2;">This consent to operate is issued from pollution angle and the industry shall obtain all the statutory clearances / permissions from other departments, as required.</li> </ol> Competency: CEE (B)
