<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="mso-bidi-font-family: Raavi; background: white;">It is submitted that the colony was granted consent to operate under the Water Act, 1974 on 14.02.2020 (valid upto 30.09.2020) for operation of a temporary residential colony having 137 rooms & for discharge of domestic effluent @ 43.2 KLD, onto land for plantation after treatment in common STP (with M/s Aman Colony-II), subject to one of the special condition that the labour colony is given permission considering it to be a temporary establishment only for executing the expansion work of M/s HMEL Refinery. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="mso-bidi-font-family: Raavi; background: white;"><span style="mso-tab-count: 1;"> </span>Thereafter, the colony failed to submit any compliance w.r.t. conditions imposed in the consent granted to it and continued its operation without valid consent of the Board under Water Act, 1974.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .25in;"><span style="mso-bidi-font-family: Raavi; background: white;"><span style="mso-tab-count: 1;"> </span>The colony was visited on 27.08.2022 and found that the STP installed was found lying defunct and the untreated effluent was being discharged onto land for stagnation in the plantation area and the solid waste generated from the premises was found burnt in underground pits. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .25in;"><span style="mso-bidi-font-family: Raavi; background: white;"><span style="mso-tab-count: 1;"> </span>Notice u/s 33-A of Water Act, 1974 was issued to the colony before the Chief Environmental Engineer (B), wherein it was observed that the colony was allowed to operate at the said site only on temporarily basis upto 30.09.2020 so as to enable the labour/manpower to carry out the expansion work of M/s HMEL-Refinery. Further, as the residential labour colony is established in PCPIR Zone of notified Master Plan, Raman Mandi, it cannot be regularized in the non-designated area on permanent basis. Moreover, the PP has not made any effort to ensure the compliance of the provisions of the Water Act, 1974 and is discharging its untreated effluent onto land for stagnation.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .25in;"><span style="mso-bidi-font-family: Raavi; background: white;"><span style="mso-tab-count: 1;"> </span>Directions u/s 33-A of the Water Act, 1974 was issued to the colony for its closure vide Board's letter no. 5270 dated 04.11.2022 and also PSPCL authorities were directed to disconnect the supply of electric connection of the colony vide Board's letter no. 5272-73 dated 04.11.2022.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="mso-bidi-font-family: Raavi; background: white;"><span style="mso-tab-count: 1;"> </span>Now the application has been applied for obtaining consent to operate under the Water Act, 1974 alongwith a letter issued by the DTP, Bathinda vide his office memo no. 2045 dated 08.12.2022, wherein it has been mentioned as under:-</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="mso-bidi-font-family: Raavi; background: white;"><span style="mso-tab-count: 1;"> </span>The Regional Office has reported that the site of the colony was visited on 31.12.2022 and it was observed that the colony was in operation with about 60 rooms, STP installed was in operation and treated effluent was discharged onto land for plantation developed as per kernal technology, stagnation removed, the wet solid waste is lifted to the piggery and the dry solid waste is lifted by the local kabadiwala. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="mso-bidi-font-family: Raavi; background: white;"><span style="mso-tab-count: 1;"> </span>If approved, the Regional Office be requested to submit the compliance of the directions issued u/s 33-A of the Water Act, 1974 for the closure of the colony and the status of the electric connection of the colony, before further processing the application. </span></p>
