A.   It is intimated that earlier subject cited industry was engaged in manufacturing of army cap by using dyed yarn as raw material including washing at above said location. This unit was issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 by the Zonal Office-II, Ludhiana vide letter no. 4889-92 dated 27.07.2022 for disconnection of the electric connection of the unit as it was being operated at above said location without treating its trade effluent generated from washing process and was discharging its untreated effluent into the conveyance system of CETP 50 MLD, Ludhiana.                In compliance the electric connection of the unit was disconnected by the PSPCL vide TDCO no. 77/298 dated 16.08.2022 and report in this regard already sent by this office vide letter no. 5375 dated 22.08.2022. B.   Thereafter, the industry vide its letter dated 25.08.2022 had informed that the washing has closed and all washing machines removed from above said location and now industry has planned to do only dry work i.e. hosiery work and requested to restore the electric connection for dry hosiery work only. C.   To verify the facts the site of the unit was visited by the officer of the Board on 06.09.2022 and observed that the washing process was closed by the industry and no washing machinery was seen at site, during visit. The industry had installed only some stitching machines. D.   The report in this regard had been already sent by this office through e-office computer no. 126954 dated 07.09.2022 for restoration of the electric connection of the industry for dry process only. However, as per the record of this office till date no correspondence has been received from the Zonal Office in this regard. E.    Thereafter, during visit to the area on 16.12.2022 the trade effluent was being discharged by the industry near its main gate to the adjoining plot. To check the status the industry was visited from the inside and it was observed as under:- 1.    The industry was in operation during visit and its electric connection was found intact. 2.    The industry has installed new cap dyeing and washing machinery in the adjoining plot and was discharging its blue colored untreated trade effluent through mono block pump and flexible pipe to the adjoining plot. 3.    The industry has installed the ETP, but same is yet not put in operation and no effluent was seen near the ETP area. 4.    The industry has again started its washing and dyeing process without obtaining NOC/ Consents of the Board. Hence, the industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974. F.    Accordingly, action taken report for issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 against the industry for disconnection of its electric connection has been sent to the Zonal Office vide e-office no. 143808 dated 27.12.2022. G.   Now, the industry has applied for fresh ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for dyeing & washing of caps @ 300000 Nos/day with discharge of trade effluent @ 5 KLD onto land for plantation after treated through ETP & domestic effluent @ 0.5 KLD into sewer along with 01 baby boiler of capacity 0.5 TPH. H.   The industry has deposited consent fee of Rs. 40,100/- (34200/- Water + 5400/- NOC + 500 Form fee) vide receipt No. 880084061 dated 30.12.2022 under Water Act, 1974 and Rs. 34,200/- vide UTR No. 437967741 dated 30.12.2022 under Air Act, 1981, which is adequate upto 30.06.2025 under both acts after deducting of Rs. 10,800/- as penalty. The industry has submitted C.A certificate, proprietor certificate, certificate regarding classification of the area, copy of registry, feasibility report of ETP, manufacturing chart & approved building map from competent person approved by Director of Factory etc. I.     The industry has submitted certificate regarding classification of area from ATP, Municipal Corporation, Ludhiana vide no. 2850/ATP/B/D dated 24.08.2022 is stating that the site of the industry falls in industrial zone.                     In view of above, as the report before applying the CTO has been already send by this office and action on the same is still under process, it is therefore recommended that: 1.    Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be refused in light of the report already sent by this office through e-office no. 143808 dated 27.12.2022.  (Competency: SEE, ZO-II, Ludhiana)
