<p><span style="text-align: justify;">Sir, the proceedings of the personal hearing given on 09.01.2023 is attached alongwith. Further, the applicaiton is processed as below:</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">It is submitted that the unit was earlier granted consent to establish under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/RPN/2022/18855615 dated 20/06/2022 which is valid upto 19/06/2023 for operation of Crushing and Screening-cum-Washing of stone aggregates @ 4000 CFT/Day subject to the suitable conditions mentioned therein.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;"> </span>Now, the unit has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for operation of Screening & Washing of Stone aggregates @ 4000 CFT/Day only due to some financial conditions as mentioned in the undertaking attached by the applicant. The unit has submitted an undertaking regarding code of practice, site plan duly verified by the competent person registered with Director of Factories, lease deed dated 09.11.2021 valid for 20 years, letter no. 456 DTP (R)/SR-6 dated 13.05.2022 from the O/o Deptt. Of Town & Country Planning, Rupnagar regarding no requirement of CLU, mining slips, compliance of NOC granted to the unit and consent fee.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;"> </span>The unit has submitted the CA certificate, wherein the value of fixed assets of the industry as on 12.09.2022 is Rs. 37.13 lakhs with the value of plant and machinery Rs. 29.80 lakhs. There is decrease in cost of assets of the unit due to non-installation of the crusher machinery. The unit has deposited fee Rs. 14,500/- vide UTR No. N255222116429920 dated 12.09.2022 under the Water Act, 1974 and Rs. 14,500/- vide UTR No. N255222116428931 dated 12.09.2022 and Rs. 500/- as application form fee under the Air Act, 1981. </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;"><span style="mso-tab-count: 1;"> </span>As such, the fee deposited by the unit under the </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Water Act, 1974 and the Air Act, 1981 is adequate upto 31.12.2027 as per circular dated 29.10.2018.</span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;"> <span style="mso-tab-count: 1;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Further, the unit has submitted the slips of obtaining raw material from HP state, verified by O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Rupnagar dated 08.11.2022, 09.11.2022, 12.11.2022 and 14.11.2022 regarding obtaining raw material from Himachal Pradesh through check post Manguwal.<span style="mso-tab-count: 1;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;"><span style="mso-tab-count: 2;"> </span>Further, the unit was visited by the AEE on 20.12.2022 and Sh. Gurmeet Singh, Proprietor was contacted. During visit, it was observed as under:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">As such, it is clear that the unit is not complying with the code of practice stipulated for such units and is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Thereafter, the unit was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing on 09.01.2023 at 11:00 am to show cause as to why the proposed action may not be taken.</span></p>

<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">After hearing the representative of the unit and considering background of the case, the Environmental Engineer decided that the AEE will visit the unit within 03 days to verify the contention of the unit and process the application of the unit on merit as per visit.</span></p>

<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 70.9pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Tahoma;">In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and e-mail received from Executive Engineer, Deptt. of Irrigation-cum-Mining, Rupnagar and raw material mining slips, verified by their office, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed for a short period</span><span style="font-family: 'Bookman Old Style','serif'; mso-font-width: 110%;"> </span><span style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Tahoma;">upto 30.09.2023, subject to the suitable conditions and additional conditions as under:</span></p>
