The details of the case are given in the agenda note, which may kindly be perused. As reported by Regional Office National Highway Authority of India had obtained Environment Clearance under EIA notification, 14.09.2006 for constructing of road project for Delhi-Amritsar-Katra expressway having total stretch of 261.807 km (approx.) Km. Now, the NHAI has allotted the road construction project to M/s Shiv building Pvt. Ltd., Bhawanigarh, Sunam Road, Village Phaguwala, Sangrur, Punjab for laying of the road from Patiala-Bathinda road, Near Bhawanigarh (From KM 157+920 to 188+830) having a stretch of 30.91 km (approx.) on EPC mode.                         Now, Delhi-Amritsar-Katra expressway has applied for NOC for establishment hot mix plants, RMC plants and WMM plants to manufacture Bitumen Macadam @3500 MTD, Wet Mix Macadam @2000 MTD, Ready Mix Concrete @3500 MTD by using Aggregates 10mm @ 933 Metric Tonnes/Day, Aggregates 20mm  @ 1172 Metric Tonnes/Day, Aggregates 40mm  @ 1650 Metric Tonnes/Day,  Stone dust   @ 1725 Metric Tonnes/Day, Sand @ 67 Metric Tonnes/Day, Bitumen  @ 140 Metric Tonnes/Day and Cement  @ 37 Metric Tonnes/Day as raw material. The Authority has also submitted the report issued by SDM, Bhawanigarh vide no. 1247 dated 30.09.2022 regarding distance of the site from various parameters and the compliance of the sitting guidelines laid down by the Board dated 26.04.1999 is reproduced in agenda note. On perusal of the said report, the proposed unit is at distance of about 200 mtr from the State Highway against the prescribed parameter of 300 mtr notified by the PPCB. Accordingly, legal opinion of SLO of the Board has been obtained  (copy attached with the note of AEE) and approved by the Worthy Chairman of the Board to grant NOC from pollution angle to the Project Proponent  with certain conditions . As opined by the SLO, in the first instance, permission for one year with suitable conditions can be granted to the Project Proponent  after obtaining the undertaking, which has been submitted by the Project Proponent . In view of the facts mentioned above, if approved, NOC from NOC from pollution angle may be granted to the Project Proponent for one year with the following specific conditions : 1.         The Project Proponent shall be bound to relocate the source of pollution to safe distance, in case of any compliant regarding air pollution is received against the operation of the hot mix plant. 2.         The Project Proponent shall work only for the construction of road project namely Delhi Amritsar Katra Express being developed by National Highway Authority of India. 3.         The Project Proponent shall be bound to comply with the stipulations of NOC granted by the Deptt. of Town and Country Planning, Punjab vide letter no. 1546 dated 20/09/2022 in true letter & spirit. 4.         The Project Proponent will dismantle the machinery of hot mix plant after the completion of the construction of the project. 5.         The Project Proponent  shall adopt the following code of practice for hot mix plants notified by the Board vide Notification no. Admn/A-2/F.No.178/99/03 dated 26.04.1999, which is reproduced as under: - a) A suitable dust control system for the dryer and mixer to contain/recycle permissible lines in the mix should be provided. It should be capable of preventing the exhaust of line dust into atmosphere from both ends of the dryer drum by creating adequate negative pressure. b) The plant should have centralized control panel/cabin capable of presenting controlling/synchronizing all operations, starting from feeding of cold aggregates to the discharging of the hot mix to ensure proper mixing. It should have adequate water scrubbing mechanism to completely remove/control the dust coming out of the drier with proper provision of re-circulation system for the scrubber water. c) Bitumen must be mixed with aggregate as soon as it is heated and dried and second time of lifting of the dried aggregate for proper batching should be avoided. d) All roads/vehicular movement areas at site of hot mix plant should be pucca/stabilized with stone aggregates and regular sprinkling of water be ensured so that no dust is generated with vehicular movement. e) Hot mix plant must have proper stack heights for its scrubbed flue gases and bitumen heating system with proper platform and port holes as per the Punjab Pollution Control Board norms. f) Fine dust arrested by water scrubber and collected in there circulation water tank should be collected and fitted in a it to be covered with fresh earth. This exercise should be repeated as and when dust is removed from re-circulation tank. 6.         The industry shall install the APCD as per feasibility report submitted by it and provide adequate stack height with the APCD as well as the bitumen heaters before the commissioning of the unit. 7. The industry shall comply with the guidelines of Punjab Water Regulation and Development Authority (PWRDA) issued for the abstraction of ground water from time to time. 8. The industry will not commission its unit without obtaining consents to operate of the Board as required under the provisions of the Water Act, 1974 and Air Act, 1981.
