<p class="MsoNormal" style="margin-bottom: 0in; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><strong><span lang="EN-IN" style="line-height: 150%;"> </span></strong><span lang="EN-IN" style="line-height: 150%;">It is intimated that the subject cited industry has applied for obtaining consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the establishment of stone crusher unit. </span></span></p>
<p class="MsoBodyText2" style="line-height: 150%; tab-stops: 24.65pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><span style="line-height: 150%;"> </span><span style="line-height: 150%;">The Sub Divisional Magistrate, Pathankot vide letter no. 1439 dated 19/12/2022, reported that the site of the industry is situated in Village-Sandhauri, Tehsil & District-Pathankot in Khasra No. 6R//4/1 & 6R//7/1 & Hadbast No. 361. As per the SDM, Pathankot report, the site is situated at more than 5 KM from MC Limit of Municipal Corporation. The site is situated more than 2 KM from A-Class City and more than 1.5 KM from B-Class Town. The site is situated more than 1 KM other towns and cities limits. The site is located more than 500 meter from village-Lal Lakir/Phirni/Approved Residential Area (15 Pucca House)/Wild Life Sanctuary/Zoological Park. The site is situated more than 300 meters from Historical Place/Educational Institute/Protected Monument. The site is situated more than 500 meter from National Highway/State Highway/Scheduled Road & more than 100 meter from Link Road and more than 300 meter from MDR. The site is situated more than 50 meter from the outer edge of the Gair Mumkin Nadi, Choe, etc or similar nomenclature identifying water body on the outer/flowing side of the choe-river 50 meter. No River Embankment exists. The site of the industry is located within 30 KM from International Border.</span></span></p>
<p class="MsoBodyText2" style="line-height: 150%; tab-stops: 24.65pt;"><span style="font-size: 12pt; line-height: 150%; font-family: tahoma, arial, helvetica, sans-serif;"> It is submitted that as per the SDM, Pathankot report the site is located more than 500 meters away from the National Highway and 100 meters away from State Highway, however, as per the comments by the Patwari on the same report it has been mentioned that the site is located more than 500 meters away from the National Highway and also located more than 400 meters away from State Highway and Scheduled Road. It seems that there is a typing error in the report. During the site visit it was observed that no State Highway/Scheduled Road was located within 500 meters of the site. The google earth image of the site is enclosed. The land where the stone crusher is being set up is with Drainage Department, which has been leased to the proprietor for establishment of the Shahpur Kandi Dam Project (construction of Barrel/Syphon off taking from the TRC of 8 MW unit of PH-II to feed Kashmir Canal on R/s of Madhopur Headworks on EPC mode). The unit is being set up on temporary basis till the completion of the construction project. </span></p>
<p class="MsoBodyText2" style="line-height: 150%; tab-stops: 24.65pt;"><span style="font-size: 12pt; line-height: 150%; font-family: tahoma, arial, helvetica, sans-serif;"> The District Forest Officer (Wild Life), Pathankot vide letter no. 1649 dated 27/10/2022, reported that the site of the industry is situated 18 KM from Kaushalya Kathlour Wild Life Sanctuary. </span></p>
<p class="MsoBodyText2" style="line-height: 150%; tab-stops: 24.65pt;"><span style="font-size: 12pt; line-height: 150%; font-family: tahoma, arial, helvetica, sans-serif;"> The industry has submitted policy of Government of Punjab, Department of Industries & Commerce, Notification dated 17.11.2017 which states as under:- </span></p>
<p class="MsoBodyText2" style="line-height: 150%; tab-stops: 24.65pt;"><span style="font-size: 12pt; line-height: 150%; font-family: tahoma, arial, helvetica, sans-serif;"> “In pursuance of the approval of the Council of Ministers, Government of Punjab conveyed vide no. 1/152/2017-1Cabinet/4639 dated 16.10.2017, the Governor of Punjab is pleased to notify ‘Industrial and Business Development Policy’ 2017 as per Annexure – A i.e. 10.19.2 (i) No CLU will be required in this Extreme Border Zone to set up industry. (ii) 100 % exemption from EDC charges. (iii) 75 % exemptions of all the State duties, taxes and fees such as Rural Development Fee, Market Development Fee, State Excise Duty etc. to the first unit, which comes into operations in EBZ for each sector of manufacturing and service industry. If there are higher incentives available under any other section of the policy, then the same would also be available to these units.” </span></p>
<p class="MsoBodyText2" style="line-height: 150%; tab-stops: 24.65pt;"><span style="font-size: 12pt; line-height: 150%; font-family: tahoma, arial, helvetica, sans-serif;"> As per the project report submitted by the industry, the industry has proposed to install One no. Jaw Crusher, One no. Screener Plant, One no. Viabrator Machine and one no. Sand Screw. The industry has proposed to install one no. D.G. set of capacity 500 KVA, 250 KVA & 125 KVA with canopies and adequate stack. The industry will generate trade effluent from washing @ 45 KLD and same will be 100% re-circulated after passing through settling tanks. The domestic effluent will be generated @ 0.5 KLD and same will be discharged into septic tank. </span></p>
<p><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"> <span lang="EN-IN" style="line-height: 115%;"> The industry was visited by the officer of the Board on <strong>15</strong>/<strong>12</strong>/202<strong>2</strong> and observed that no physical construction has been started at the site. No residential house/Mandir/ Gurudwara was found within 500 meters radius of the site. The stone crusher will install recirculation tank consisting of 3 chambers for the settling of silt and for recirculation of effluent into the washing process. The representative of the stone crusher informed that the construction work of the stone crusher will be completed within 2 to 3 months (Agenda Note is also attached herewith).</span></span></p>
<p class="MsoNormal" style="margin-bottom: 0in; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><strong><span lang="EN-IN" style="line-height: 150%;">Recommendations:-</span></strong><span lang="EN-IN" style="line-height: 150%;"> In view of above, It is recommended that consent to establish (NOC) from pollution angle may be granted to the industry for one year period and with following special conditions :-</span></span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="line-height: 150%;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]--><span lang="EN-IN" style="line-height: 150%;">The project proponent shall submit clarification from Revenue Department regarding distance from Scheduled Road and State Highway. If any discrepancy is there, the NOC shall be cancelled. </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="line-height: 150%;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]--><span lang="EN-IN" style="line-height: 150%;">The industry shall liable to comply with any future policy decision to be taken with regard to the Hon’ble Supreme Court of India’s Judgement dated 03/06/2022 in I.A. No. 1000 of 2003 in WP (C) No. 202 of 1995. The Board shall not liable for any loss if any to be incurred by the occupier due to any such policy decision. </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="line-height: 150%;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]--><span lang="EN-IN" style="line-height: 150%;">The industry will obtain consent to operate from the Board before starting the operation of the industry. </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="line-height: 150%;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]--><span lang="EN-IN" style="line-height: 150%;">The industry will obtain necessary approvals/permissions from other concerned departments before the commissioning of project. </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="line-height: 150%;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]--><span lang="EN-IN" style="line-height: 150%;">The industry will follow the guidelines and standards prescribed by the Board for stone crushers. </span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="line-height: 150%;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]--><span lang="EN-IN" style="line-height: 150%;">The industry will follow the code of practice prescribed by the Board for the operation of stone crusher.</span></span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="line-height: 150%;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"> </span></span><!--[endif]--><span lang="EN-IN" style="line-height: 150%;">The industry shall ensure that the raw material used is as per Punjab Mining Rules and is legal in all ways.</span></span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in 0in 15.85pt;"><span style="font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;"><span lang="EN-IN" style="line-height: 150%;">8. </span><span lang="EN-IN" style="line-height: 115%;"> <span lang="EN-IN" style="line-height: 115%;">The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter. </span></span></span></p> |
